WHEREAS, said annexation has been approved by the Franklin County Commissioners and Council is of the opinion that said territory should be annexed; NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State of Ohio, 7 of the elected members concurring: SECTION 1. That the petition for the annexation of 4.9 acres of Roadway Only (See attached legal description) to the Village of Dublin, Ohio is hereby accepted. SECTION 2. RESOLUTION TO APPROVE ANNEXATION OF 4.9 ACRES IN WASHINGTON TOWNSHIP TO THE YILLAG'EOFDUBLINOHIO. I WHEREAS, THE Board of County Commissioners of Franklin I County, Ohio, met in regular session October 24, 1984; to con- I sider a petition for ~he annexation of 4.9 acres in Norwich i Township to the Village of Dublin, Ohio) said petition being described as follows: Situated in the State of Ohio, County of Franklin, Town- ship of Wash~ngton and be~nglocated in Virginia Military Survey. No. 2419, and also being located within the highway right of way of Rings Road and Frantz Road, more particularly described as follows: I Beginning at a point on the Village of Dublin Corporation Line, Dublin Ord. No. 49-80, Official Records No. 505-C-IO, all records are recorded in the Franklin County Recorder's Office, Franklin County Ohio, said point also being at the southwest intersection corner of the original right of way lines of Dublin Road (50 feet wide at that time) with Rings Road (60 feet at that time) . Thence, westerly along said Dublin Corporation line, said line also being the original south right of way line of Rings Road, for a distance of 1170 ~ feet to a point; on the existing south right of way line of Rings Road; Thence along the existing south right of way line of Rings, Road, said line also being the existing Village of Dublin Corporation Line, Dublin Ord. WHEREAS, the said 4.9 acres consists entirely of public right of way for Rings Road and Frantz Road, and WHEREAS, under Section 70~.16 of the Ohio Revised Code the Board of County Commissioners may with an entry upon its Journal approve annexation ofpubl~c right of way. Now, therefore BE IT RESOLVED, on motion of Commissioner Ryan, seconded by Commissioner Foulk, that the petition for annexation of 4.9 acres in Washington Township to the Village of Dublin, Ohio, be and it hereby is granted. REC. 163 PG.281 OFF'ICAL REC. 505 C-IO 5 u HAYMAKER LANE . - P/#./ 8/Jo/6>Y - - "':'!! -_u.~ __ ~ - ~ - - ....... _ _...... _~ __ _ _ _ _ _ _ . .. _ _ _ _ _ __ __ T - ..- # DEED OF EASEMENT KNOW ALL MEN BY THESE PRESENTS, That Bertha May Headlee, hereinafter called "Grantor", for and in consider- , ation of One Dollar ($1.00) and other valuable consideration (101"./ ; 1J11fJ,Dt.) paid by the Village of Dublin, Ohio, a municipal corporation, the "Grantee" herein, receipt of which is hereby acknowledged, hereby grants with general warranty covenants to Grantee, its successors and assigns forever, a permanent easement in, through, over, and under the following described real estate for the purpose of constructing, using, operating, installing, maintaining, cleaning, repairing, removing, replacing, and caring for sanitary sewer lines and tributary connections and appurtenant work in any part of said easement. Said easement strip overlaps part of an existing roadway easement held by the Grantee. It is not the intent of the parties to this agreement to limit the use of said existing easement in any manner. The total width of the described easement may fall only in part on the Grantor's property. The intended easement lS that portion falling within the Grantor's property and all sidelines are extended to intersect the property lines. Said real estate is situated in the State of Ohio, County of Franklin, Township of Perry, and being more parti- cularly described as follows: Situated in Quarter Township 2, Township 2 , Range 19, United States Military Lands, Village of Dublin, County of Franklin, State of Ohio, and being a sanitary sewer easement located within those 0.36 and 3.0 acre tracts of land as described in a deed to Bertha May Headlee of record in Official Record Volume 59, Page J07, Recorder's Office, Franklin County, Ohio, said sanitary sewer easement being more particularly described as follows. PERMANENT EASEMENT Being a Fifty (50 ) foot strip off the southern side of said 0.36 and 3.0 acre tracts, the southerly line of said easement being the southerly line of said 0.36 and 3.0 acre tracts, extending from the westerly line of said 3.0 acre tract to the easterly line of said 0.36 acre tract. . TEMPORARY EASEMENT The right to use only during the time of construction of the sanitary sewer herein provided for, an additional strip of land laying fifteen (15 ) feet north of the above described fifty (50 ) foot permanent easement and fifteen (15 ) foot strip being parallel to and coincident with the fifty (50 ) foot permanent easement. The Village of Dublin, as soon as practicable after construction of said utility and all subsequent altera- tions and repairs thereto, shall cause all affected property of Grantor to be restored to the original condition. The rights granted herein shall not be construed to interfere with or restrict the use of the premises with respect to the construction and maintenance of property improvements along and over the premises herein described so long as the same are so constructed as not to impair the strength or interfere with the use and maintenance of said utility, or ingress and egress to or over the easement area. This easement, however, shall not be construed as giving to Grantee any right of ingress and egress to or over the remainder of said premises owned by Grantor.
