AN ORDINANCE AUTHORIZING THE
CITY MANAGER TO EXECUTE AN
INGRESS AND EGRESS EASEMENT
FROM THE CITY OF DUBLIN TO
PATSY K. KERSTON
WHEREAS, the City of Dublin is in the process of developing a passive
park known as Riverview Park and located south of Bridge Street and
west of Lower Street along the Scioto River; and
WHEREAS, only pedestrian acess will be provided to said park with
the exception of City park maintenance vehicles; and
WHEREAS, park maintenance vehicular access can only be accomplished
through the parcel located immediately to the south of the subject
park owned by Patsy K. Kerston; and
WHEREAS, Patsy K. Kerston has granted an ingress, egress and utility
easement to the City of Dublin in exchange for the City of Dublin
granting her an ingress, egress easement on its adjacent park
property for use as a turn-around.
NOW, THEREFORE BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, 6 members concurring that:
Section 1. The City Manager is hereby authorized to execute an ease-
ment from the City of Dublin to Patsy K. Kerston for ingress and
egress over a portion of the approximately 1.15 acre tract of land
owned by the City of Dublin south of Bridge Street and west of
Lower Street along the Scioto River, known as Riverview Park.
Section 2. This Ordinance shall take effect and be in force from and
after the earliest period allowed by law.
Passed this 7th day of March 1988.

EASEMENT
CITY OF DUBLIN
Being a non-exclusive ingress and egress easement for
the purpose of providing vehicular access. Grantee acknowledges
that innowaywill the use of this easement impair the access to
the residual property of the Grantor.
Situated in the City of Dublin, County of Franklin, State of
Ohio, and being a portion of that approximately 1.15 acres tract
of land conveyed to the C i t Y of Dub Ii n by Official Record 8095-
E 1 7. Recorder's Office, Franklin County, Ohio and bounded and
described as fol'lows:
Commencing at an existing P.K. na i I at the centerline of the
intersection of Riverview Street and the 16.5' alley between Lots
102 and 103 as recorded in P I a t Book 3, Page 199, Recorder's
Office, Frank Ii n County, Ohio;
Thence North r 20'00" West, along the centerline of
Riverview Street a distance of 206.25 feet fo a P.K. na i I set;
Thence North 820 40' 00 " East, a distance of 17.50 feet to a
personalized survey marker, being the place of beginning;

of an approximately 0136 acre tract of land conveyed to Patsy K.

KNOW ALL MEN BY THESE PRESENTS, that PATSY K. KERSTON
"Grantor" of the County of Franklin, State of Ohio, for valuable
consideration to be paid by the CITY OF DUBLIN, an Ohio municipal
corporation "Grantee", the receipt of which is hereby acknowledged,
does hereby grant and release to the Gran~ee, its successors and
assigns forever, a perpetual non-exclusive ingress, egress and
utility easement for the purpose of providing vehicular access,
drainage outlets and any utility service necessary to serve
Grantee's adjacent parcel located immediately to the North, over the
real estate fully described in Exhibits "A" and "B", attached hereto
and incorporated herein as if fully rewritten and entitled

respectively, lIEasement Patsy K. Kerston." and "City of Dublin
Survey of 0.36 Acre Tract East of Lot Number 105 and North Half of
Lot Number 104."
To have and to hold said easement to Grantee, its successors

and assigns forever, for the uses and purposes herein before

The rights herein granted will in no way impair the access
to the residential property owned by the Grantor.
