AN ORDINANCE AMENDING CHAPTER 1187
OF THE DUBLIN PLANNING AND ZONING
CODE RELATING TO PERIMETER LAND-
SCAPING, AND SCREENING OF SERVICE
STRUCTURES
WHEREAS, several words were inadvertently deleted from Chapter 1187,
Landscaping, at the time of its enactment; and
WHEREAS, this has led to uneven enforcement of restrictions therein
contained; and
WHEREAS, consistent application of landscaping is a benefit to the
community; and
WHEREAS, the Tree and Landscape Advisory Commission has reviewed this
Ordinance and after careful consideration made revisions to it; and
WHEREAS, this Ordinance should lead toward more equal landscape treatment
throughout the Community and a more aesthetically pleasing environment
generally; and
WHEREAS, this Ordinance should not adversely affect the conduct of free
trade and commerce within the community; and
WHEREAS, periodic amendments to the Planning and Zoning Code are
necessary to accommodate the needs and desires of the community and
to protect the health, safety and welfare of the residents.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, 7 of the elected members concurring:
Section 1. That Section 1187.04(a)(1) Property Perimeter Requirements,
Appendix A, Line 6, Column A, be amended to read as follows: Any zone
except rural zones.
Section 2. That Section 1187.04(a)(1) Appendix A, Line 9, be deleted in
its entirety.
Section 3. That Section 1187.04(a)(2) Vehicular Use Area Perimeter
Requirements, Appendix B, Line 2, Column B, be amended as follows: Any
vehicular use areas, outside of CB or CCC(except vehicular sales facilities
in any zone.
Section 4. That Section 1187.04(a)(2) Vehicular Use Area Perimeter
Requirements, Appendix B, Line 3, Column B, be amended to read as follows:
Any vehicular use area in a vehicular sales facility.
Section 5. That Section 1187.04(a)(2) Vehicular Use Area Perimeter
Requirements, Appendix B, Line 3, Column D, be amended to read as follows:
1 tree/30 feet, OFT from Group A or B, with at least a 3 inch caliper
along the entire street frontage, plus a 3 foot average height continuous
planting hedge, fence, wall or earth mound along at least 75 percent of
the street frontage. The remaining street frontage, not to exceed 25 per-
cent, sha 11 include a 12 inch height vegetative planting. (See #5)
Section 6. That Section 1187.04(a)(2) Vehicular Use Area Perimeter
Requirements, Appendix B, Notes, be amended to read as follows:

(5) Purpose Statement
The intent of these requirements is to improve the appearance of vehicula
use areas and property abutting streets. The vehicular use area perimete
requirement for vehicular sales facilities allows the creation of
'picture frame(s)' along streets for vehicular sales display. The
following formula shall be used to determine the display area allowed per
street frontage: Linear Distance of Street Frontage (from lot line to
lot line or from lot line to corner in feet) x .25 = Display Area (in
feet). Vehicles in the display area shall be located behind the 12 inch
height planting and all vehicles shall be parked at grade. Screening
requirements for the remaining vehicular use areas that adjoin a street
frontage shall be similar to those for other uses with two exceptions.
The size of trees at installation is increased and the spacing between
trees is reduced. These requirements will help to mitigate the glare
from artificial lights.
Section 7. That Section 1187.04(c) Lanadscaping for Service Structures,
be amended as follows: Service structures shall be screened in all zoning
districts. For the purposes of this Section, service structures shall
include but not be limited to loading docks, propane tanks, dumpsters,
electrical transformers, utility vaults which extend about the surface,
and other equipment or elements providing service to a building or a site.
Structures may be grouped together; however, screening height sha 11 be
based upon the tallest of the structures.
Section 8. That this Ordinance shall take effect and be in force from
and after the earliest period permitted by law.

As directed at the Dublin City Council Meeting on December 19, 1988, enclosed
is a copy of Orainance No. 17-8a as Amended, Amended. My instructions were to
see that you got the final draft in order that you might have an opportunity
to make any corrections, etc. that you might deem to be necessary. If you do
not respond prior to Wednesday, January 11, 1989, I will assume that the
Ordinance may be placed on the Agenda for January 16, 1989.
