AN ORDINANCE PROVIDING FOR A CHANGE OF
ZONING ON A 3.84 ACRE TRACT ON THE SOUTH
SIDE OF WEST DUBLIN-GRANVILLE ROAD
APPROXIMATELY 200 FEET EAST OF THE INTER-
SECTION OF DAVID ROAD AND WEST DUBLIN-
GRANVILLE ROAD. TO BE REZONED FROM:
R-4, SUBURBAN RESIDENTIAL DISTRICT, TO:
SO, SUBURBAN OFFICE AND INSTITUTIONAL.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of
Dublin, State of Ohio 7 of the elected members concurring:
Section 1. That the following described real estate (see attached
legal description marked Exhibit "A"), situated in the Village of
Dublin, State of Ohio is hereby rezoned to SO, SUBURBAN OFFICE AND
INSTITUTIONAL DISTRICT and shall be subject to regulations and
procedures contained in Ordinance No. 21-70, (Chapter Eleven of
the Codified Ordinances) the Village of Dublin Zoning Code and
amendments thereto.
Section 2. That application, Exhibit liB", including the list of
contiguous property owners, and the recommendation of the Planning
and Zoning Commission Exhibit "C", are all incorporated into and
made an official part of this Ordinance and said real estate shall
be developed and used in accordance therewith.
Section 3. That this Ordinance shall take effect and be in force

Two (2) copies of map accurately drawn to an appropriate scale (to fill a sheet
of not less than 8- 1/2 x 11 inches and not more than 16 x 20 inches). The map
shall be identified and submitted in addition to the General Description of Land.
The map shall include all land in the proposed change and all land within five
hundred (500) feet beyond the limits of the proposed change.
To be shown on the map - all property lines. street right of way. easements and
other information related to the location of the proposed boundaries and shall
be fully dimensioned.
The map shall show the existing and proposed Zoning District or Special District
Boundaries.
List all owners of property within and contiguous to and directly across the street
from such area proposed to be rezoned. The addresses of the owners shall be those
appearing on the County Auditor's current tax list or the Treasurer's mailing list.

Mr. Reiner suggested the applicant seek some professional help in laytng
out the development. Mr. Bowman said there could possibly be some type
of retention requirement which would alter the existing site plan. Mr.
Reiner mentioned the Commission's responsibility to the surrounding
developments to maintain equal standards. Responding to Mrs. Headlee's
questions, Mr. Jeisel mentioned that Mrs. Green's home would be removed;
the line to the water line would have to go 700 feet east; and 200 feet
west to the sewer line, resulting in a rather costly expense (plus a street).
Discussion continued with Mr. Jezerinac suggesting that perhaps the
applicant would consider PLR zoning. The 60 day requirement would be
waived by the applicant and the applicant would present an actual
development plan before getting zoning approval. Compatibility with the
surrounding P.U.D. was mentioned. Mr. Gunner cited the PLR requirements
as required in the Dublin Zoning Code. Residents and surrounding developers
and landowners mentioned the possible future traffic problems and the
desire to keep the continuity and compatibility of the surrounding P.U.D.
in the area. The dens ity issue was again mentioned.
\ Mr. Miller moved to table the application until the next Planning and
Zoning Commission Meeting. In the interim, the Planner and the applicant
will get together and see what can be worked out with consideration of
PLR zoning for the 24 units. The applicant agreed to waive the 60 day
reporting time. Mrs. Headlee seconded the motion and the vote was
5-0 for tabling.
7. Rezoning Application Z84-003.
A 5.81 acre tract on the south side of West Dublin-Granville Road. A
request to rezone from R-4 to SO (Suburban Office and Inst itut iona 1
District). Mr. Bowman noted that the COD requirements and procedures have
been discussed with the applicant. Mr. Ronald Leslie, representing
Dublin Development Corporation spoke. The developer, going along with
Staff recommendations, agreed not to build any multi-family units
but request only SO rezoning. The plan is for a single story detached
and/or attached 1800 sq. ft. plus units. The intersection, service road, etc.
have also been discussed with the applicant.
Mr. Michael Ward, an adjacent property owner on Martin Road, asked how far
from S.R. 161 would the building be situated as well as landscaping
requirements. Mr. Bowman said that the rear yard dimensions are based
on the size of the building being constructed - the minimum is 15' .
Such details, again, will be part of the COD review. Mr. Reiner noted
that a 6' high screen (mound or fence) must be built between residential
and SO. The building will have to be 56' from the front property line.

Mr. Callahan moved to recommend approval. He also mentioned that on the
rezoning application the R-12 designation be stricken. Mr. Miller
seconded the motion. The vote was 5-0 for approval.
8. Fergus Plat - Preliminary Plat
The re'ques CTs" f()r- a private 11 '-uoi t subdivision to be Tocafed Oh"L5
acres at the Delaware County Line and Dublin-Bellpoint Road. Sewer and
water will be available. The Fire Department will continue to be
consulted; noting especially the 12' single lane bridge; the placement
of fire hydrants. The applicant requests a waiver of the curb and
gutter requirements. The development will reserve 2.32 acres of common
open space. The site is heavily wooded, with a pond in the middle with
20' cliffs on the side. There wi 11 be 11 housing sites; .49 units/acre;
lots will cost approximately $150,000 to $200,000; there wi 11 be a
18' wide private drive and a 12' wide single-lane bridge. Mr. Warner
said that the Fire Department would like to see the private roadway be
20 I. A concern was also expressed regarding the one way "in and out"
situation. Mr. Bowman said he felt these details could be worked out
I among the Staff, the applicant, and the Fire Department. A donation
wi 11 be made to the park fund. Garbage collection will be private.
Mrs. Headlee moved to accept the preliminary plat - Fergus Property.
Mr. Miller seconded the motion. The vote was 5-0 for acceptance.
9. Final Development Plan - Indian Run Meadow
A portion of the 198 Indian Run Meadow acreage (Phase 1 - 84 single
family lots) was submitted for Final Development Plan. Mr. Bowman
mentioned several major issues which he felt the Commission should be
assured about before going ahead with the actual engineering:
A. Consistency with the preliminary development plan.
B. The status, timing, and improvements of the entire development.
Given the purpose of the P.U.D. Ordinance is to promote a coordinated
and comprehensive development. Staff did request Mr. Gunner to examine
the Ordinance to see just what the Commission can expect "preliminary
plan wise" in order to proceed to the fi na I development plan state.
He mentioned that the first issue to be apoken to is the preliminary
development plan itself (the timing, the improvements, the actual
validity of the development plan). The applicant has been so informed.
