AN ORDINANCE AMENDING CERTAIN REQUIREMENTS
OF SECTION 1181.07 (PLANNED UNIT DEVELOPMENT
DISTRICT) REGARDING FINAL DEVELOPMENT PLAN
SUBMISSION. PLAT APPROVAL AND ESTABLISHING
CERTAIN TIME DEADLINES.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL of the Village of Dublin,
7 members concurring, that:
Section 1. Section 1181.07 (i)(5) be and the same hereby is amended
so that as amended the same sha 11 read as follows:
(5) "Within 240 days of notice of approval of the preliminary
development plan, the applicant shall submit a final
development plan for at least twenty percent ( 20/0) of the
gross area contained within the approved preliminary
development. Such 20% submitted shall consist of the
substantive part of the development and shall not be
comprised of open space parklands, etc. , to the extent
of more than one fourth Cd of the 20/0 submitted in the
final development plan. Upon good cause shown by the
applicant and by a majority vote of the Planning and
Zoning Commission, the Commission may extend the 240
day period if the request is submitted prior to the
expiration date. Submittal of such plan shall be to
the Manager. The failure to submit a final development
plan for at least 20/0 of the development within said
240-day period shall invalidate any prior approvals given
or fee payments. Within three days of official acceptance,
the final development plan and accompanying documents sha 11
be forwarded to the Commission for study and approval.
Copies of the final development plan shall also be forwarded
to the Municipal Engineer, Municioal Planner, and Solicitor
for report, which report shall have been received by the
Commission prior to the Commission's approval of the final
development plan."
Section 2. Section 1181.07 (U(8) be and the same hereby is amended
so that as amended the same sha 11 read as follows:
(8) "No later than six (6) months following approval of a final
development plan by the Planning and Zoning Commission, a
final subdivision plat prepared in accordance with all
apolicable requirements of Ordinance 27-74 for the area
covered by the final development plan shall be prepared for
Council approval prior to appropriate recording. Said six (6)
month period may be extended by the Commission for good cause."
Section 3. Section 1181.07 ( j ) be and the same hereby is amended so
that as amended the same shall read as follows:
( j ) "Recording and Transfer. When a final plat is approved by
Council, the owner sha 11 file and record the same in the
Office of the County Recorder within three (3) months unless
such time is, for good cause shown, extended by resolution
of Council. If not recorded within this time, the approval

of Council shall become null and void. If construction
is not begun within two years of approval of the final
development plan, all approvals and permits shall be
invalidated and cancelled. Original tracings will become
the permanent record of the County Recorder. One copy of
this tracing, reproduced on mylar, showing the date and
place of recording, shall be supplied by the owner to
Council as local public records. Said two (2) year period
may be extended by the Commission for good cause."
Section 4. This Ordinance shall take effect and be in force from
and after the earliest period permitted by law.
