AN ORDINANCE ACCEPTING PETITION FOR ANNEXATION
OF TERRITORY TO THE VILLAGE OF DUBLIN, OHIO, A
I 1.973 ACRE TRACT IN "DUBLIN ESTATES" - BELLAIRE
SUBDIVISION.
WHEREAS, said annexation has been approved by the Franklin County Commissioner
and, Council is of the opinion that said territory should be annexed;
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State
of Ohio, 7 of the elected members concurring:
SECTION 1. That the petition of Samuel B. and Mary A. Davis for the annexatio
to the Village of Dublin, of the following described territory (See Attachment
"A" - the legal description) which is hereby made an official part of this
Ordinance, and an accurate map, together with its petition and a certified
transcript of the proceedings of the County Commissioners being on file in the
office of the Village Manager, this petition is hereby accepted.
SECTION 2. That this Ordinance shall take effect and be in force from and
after the earliest period allowed by law.

Beginning at' a point in the existing corporation line of the Village
of Dubliri as established by Ordinance #38-74 and shown of record in
'Mi.sc;ellaneous Record Volurre 163, Page 404, Recorder's Office, Franklin
County, Ohio, said point reing the soutJleast corner of Lot 10 and the
northeast comer of Lot 4 of Iancashire . as recorded in Plat Book 36, Page
112, 113, said IX>int also being in the westerly right-of-\vay line of
Bellaire Avenue, (50' wide);
Thence, westerly, along the ~isting DOblin Corporation line and. along
the soui;h line of lot 10, and along the north lines of tots 4 and 3 and
part of the north line of lot 2 of said Lancashire,' a distance of approxi-
nately 566 feet to a IX>int, said IX>int being the southwest Corner of lot 10
and the southeast corner of the Joseph G. Mann 1.59 acre tract (6-3-' 54);

of Franklin County, Ohio, do hereby certify that the papers
hereto attached constitute the original papers and a true
transcript of all proceedings had by the Board of County Com-
missioners of Franklin County, Ohio, in connection with the
petition filed by Samuel B. D.ayis, et al., owning real estate
within the territory sought to be annexed; praying for the
annexation of certain adjacent and contiguous territory in

OF DUBLIN, OHIO - GRANTED .
The Commissioners of Franklin County, State of Ohio,
proceeding this day to hear and consider the.petition of
Samuel B. Davis, et al., filed January 7, 1982, and having
in open hearing heard all of the persons desiring to be heard
for or against the granting of said petition, and having consider d
all the facts with reference thereto, and being fully advised,
FIND, that said petition contains all of the matters
required by law; that the territory sought to be annexed is
adjacent and contiguous to the said Village of Dublin, Ohio;
that the petition contains a full and complete description
of said territory sought to be annexed; that the map for said
territory is accurate; that the petition for said territory
is signed by a majority of the owners of real estate within
the territory sought to be annexed; that the required legal
notice has been published; that the territory sought to be
annexed is not unreasonably large; and that the general good
of the territory sought to be annexed will be served if this
annexation is granted, all in accordance with the provisions
I of the Ohio Revised Code 709.033; therefore,
I IT IS HEREBY ORDERED: On motion of Mr. Cooper, seconded
by Mr. Foulk, that the prayer of said petition be granted
and that the te.rritory described in said petition be annexed
to the Village of Dublin, Ohio, in accordance witp the law;
that the orders and proceedings of this Board relating to
said petition and map attached thereto, and all papers on
file relating to said matter be deposited at once with the
Clerk of Dublin, Ohio.

Dear Mr. Close:
I Enclosed is a copy of the resolution adopted on January 19,
1982, by the Board of County Commissioners setting the time
and place of public hearing for the annexation petition which
you, as agent, filed with this office on Januat';y 19, 1982.
Under the provisions of Section 709.03 of the Ohio Revised
Code, you, as agent are responsible for the following:
{I} Notification of the date of filing of your petition
with the Board of County Commissioners to be delivered
to the Clerk of the municipality to which annexation
is proposed and the clerk of each township which
is included in the annexation. {A map, description
and a copy of the petition should be presented to
each clerk}.
{ 2} Publication of the substance of the petition once
a week for four consecutive weeks in a newspaper
of general circulation in the County. {The enclosed
. resolution will satisfy the statutory requirements
and should be used for the published notice}.
{3} Service upon the municipal and township clerk of
a copy of the published notice.
I {4} Preparation of an affidavit stating the name of
the agent, the number of owners of real estate at
the time of the filing of petition and the number
of owners signing the petition.
A letter from the municipality to which an annexation is proposed
stating the availibility of services such as water, sewerage,
aqq p'o1iceand fire protection, is a1so required.

I Now comes the undersigned, Petitioners in these premises, and being
a majority of the owners of the real estate in the territory hereinafter
described consisting of 1.973 acres, more or less, in Washington Township,
which area is contiguous and adjacent to the Village of Dublin and do hereby
pray that said territory be annexed to the Village of Dublin according to
I the Statutes of the State of Ohio.
I A plat and a full and accurate description of the above-described
territory in Washington Township, Franklin County, Ohio, is attached

Being situated in the State of Ohio, Cormtyof Franklin, Township ,of
Washington, part of Survey #2543, Virginia Military Lands, and being all
of IDt 10 of Dublin Estates Subdivision as recorded in Plat Bcx:>k 27, Page
49-A, Recorder's Office, Franklin County, Ohio, and being rrore particular-
ly described as follows:
Beginning at a point in the existing corporation line of the Village
of Dublin as established by Ordinance #38-74 and shown of record in
Miscellaneous Record voll.lITe 163, Page 404, Recorder's Office, Franklin
County, Ohio, said point being the southeast corner of Lot lO and the
northeast corner of Lot 4 of Lancashire as recorded in Plat Bcx:>k 36, Page
ll2, 113, said point also being in the westerly right-of-way line of
Be11aire Avenue, (50' wide);
Thence, westerly, along the existing Dublin Corporation line and along
the south line of Lot 10, and along the north lines of Lots 4 and 3 and
part of the north line of Lot 2 of said Lancashire, a distance of approxi-
I mately 566 feet to a point, said point being the southwest cOrner of Lot lO
and the southeast corner of the Joseph G. Mann 1. 59 acre tract. (6-3-' 54) ;
Thence, northerly, along the west line of said Lot 10 and along the
east line of the said Mann tract" a distance of approxirna.tely l47 feet to
a point at the northwest corper of said IDt 10 (southwest corner of IDt 9),
and northeast corner of said Mann tract;
Thence, easterly, along the north line of Lot lO and along the south
line of lot 9, a distance of approximately 610 feet to a point at the
northeast' corner of IDt 10, said point being in the westerly right-of-way
line of Bellaire Avenue;
Thence, southerly, along the east li.ne of Lot 10 and along the westerly
line of Bellaire Avenue, along the arc of a curve to the left having a
radius of 1600 feet a chord distance of approximately 150 feet to the place
of beginning.
