FonnNo, 2806-A Ordinance N 0 .___~X=~_?____________ p assed-h----_________________________h_______________~19 _.___'__ AN ORDINANCE TO AMEND CHAPTER 1515 OF THE CODIFIED I ORDINANCES OF DUBLIN, OHIO BY ADOPTING THE BUILDING OFFICIALS AND CODE ADMINISTRATORS (BOCA) BASIC FIRE PREVENTION CODE/1981. WHEREAS, the Council of the Village of Dublin, Ohio desires to adopt regula- tions consistent with nationally recognized standards for safeguarding, to a reasonable degree, of life and property from the hazards of fire and explo- sion arising from the storage, handling and use of hazardous substances, materials and devices; and from conditions hazardous to life or property in the use or occupancy of buildings or premises. NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State of Ohio, 7 of the elected members concurring that: SECTION l. Section 1515.01 of Chapter 1515 of the Codified Ordinances of Dublin, Ohio be amended by repealing the Fire Prevention Code recommended by the American Insurance Association (AlA) and adopting in its place the Build- ing Officials and Code Administrators Basic Fire Prevention Code, Fifth Edi- tion '(1981) (hereinafter referred to as the BOCA Fire Code) in its entirety, except that: a. Article 3, Section F-301.0 (Bonfires and Outdoor Rubbish Fires) I is deleted therefrom because Chapter 1511 of the Codified Ordinances of Dublin, Ohio already covers this subject. b. The first sentence of Article 4, Section F-402.0, subsection F-402.1, shall have the following language inserted immedi- ately a fter the word "equipment" therein: (such devices shall be deemed to include private hydrants, automatic fire alarm systems, automatic sprinkler or water spray systems, standpipe and hose, and other fire control devices) c. Article 27, Section F-2701.0, subsection F-2701.2, is amend- ed to read as follows: The storage of explosives and blasting agents is prohibi- ted within the corporate limits of the Village of Dublin, except for temporary storage as approved by the fire official for use in connection with approved blasting operations, provided, however, this prohibition shall not apply to wholesale or, retail stocks of small arms ammunition, explosive bolts, explosive rivets or cart- ridges for explosive - actuated power tools in quanti- ties involving less than 500 pounds (227 kg.) of ex- plosive material. I d. Article 31, Section F-3100.0, subsection F-3100.2, is amended to read as follows: A permit shall be obtained from the fire official for each installation of liquefied petroleum gas. Prior to making such an installation, an installer shall submit plans to the fire official and if compliance with the requirements of this code, NiFPA 58 and local requirements is shown by said plans, a permit shall be issued. SECTION 2. Section 1515.04 of Chapter 1515 of the Codified Ordinances of Dublin, Ohio is hereby amended to read as follows: There is hereby established a Board of Appeals which shall hear and decide upon appeals registered by any person or organization aggrieved by any decision or interpretation by the fire official made under the provisions of this Chapter or the BOCA Fire Preven- tion Code. This board shall act as delineated in Article 1, Sec- tion F-I04.0 of the BOCA Fire Prevention Code. The Village Manager shall be the chief appointing authority called for in subsection F-I04.1 of said Section F-I04.0. Appointees to the board of appeals need not be residents of the Village of Dublin, but must I be persons who possess knowledge, training, and expertise in fire prevention. The board of appeals is empowered to affirm, modify, revoke or vacate any order, and/or application. Unless such order or application is revoked or vacated by the board of appeals it shall remain in force and be complied with by the appealing party. SECTION 3. Section 1515.08 (a) of Chapter 1515 of the Codified Ordinances of Dublin, Ohio is amended by adding the following to the list of permits and fees: Cryogenic liquids $20.00 Dry cleaning plants 20.00 Airports, heliports and helistops 40.00 SECTION 4. Section 1515.09 (a) of Chapter 1515 of the Codified Ordinances of Dublin, Ohio is amended to read as follows: All liquefied petroleum gas installations shall comply with the applicable provisions of the BOCA Fire Prevention Code/1981, shall meet the minimum requirements set forth in NiFPA 58, and shall comply with local requirements recommended by the Chief of the Washington-Perry Townships Fire Department and adopted by Council. SECTION 5. That this Ordinance shall take effect and be in force from and after the earliest period allowed by law. I IS day of ~~ ' 198 2 . That Section 1515.99 of the Codified Ordinances of Dublin be amended to read as follows: (a) Whoever violates any provi~ion of the Fire Prevention Code and/or I the BOCA Basic Fire Prevention Code as adopted therein or violates any order made thereunder, or builds in violation of any detailed statement of specifi- I c~tions or plans submitted and approved thereunder, and from which no appeal has been taken, or who fails to comply with such an order as affirmed or modified by the Board of App~als or by a Court of competent jurisdiction, within the time fixed herein, shall severally, for each and every such vio- lation and noncompliance respectively. be guilty of a minor misdemeanor. The imposition of one penalty for any violation shall. not excuse the violatio or permit it to continue and all such persons shall 'be required to correct or remedy such violations or defects within a reasonable-time. When not,otherwi E , specified, each ten days that prohibited conditions are maintained shall constitute a separate offense. The application of any, penalty or penalties shall not be held to prevent the enforced removal of prohibited conditions~ I (b) If any person fails to.comply with an order of an officer under any section of the Fire Prevention Codeandlor the BOCA Basic Fire Prevention Code as adopted therein, from which no appeal has been taken or with the ordet as finally affirmed or modified by. the Board of Appeals or by the court in thj event of an appeal, within the time fixed in such order or order of affirm an or modification, then such ,officer may cause such building or. premises to be repa~red, torn' down, demolished. materials removed. and all dangerous conditi : remedied, at the expense of such person. ' If such person within thirty days thereafter, fails, neglects, or refuses to repay'the officer ~he expense thereby incurred by him, such officer shall ,certify such expenses, ~ogether with a twenty-five pe~cent (25%) penalty thereon to the County Auditor. The Auditor shall enter such expense on the tax Auplicates of the County as a J special charge against the re~l estate on which the building is or. was situate and the same shall be collected as other taxes, and when collected, shall together with the penalty thereon be refunded to such officer.
