AN ORDINANCE TO ACCEPT A PETITION FOR ANNEXATION TO
.1 THE VILLAGE OF DUBLIN, OHIO OF 1.664 ACRES WHICH IS
A PORTION OF DUBLIN ROAD (ROADWAY ONLY) SOUTH OF
TUTTLE ROAD AND NORTH OF THORNHILL LANE.
WHEREAS, said annexation has been approved by the Franklin County Com-
missioners and;
WHEREAS, the Village Council is of the opinion that said territory should
be annexed:
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin,
State of Ohio, ~ of the elected members concurring:
SECTION 1. That the petition of John P. Lukeman, et al., for the annex-
ation to the Village of Dublin, Ohio, of the following described terri-
tory (see legal description attached as Exhibit "A") together with an
accurate map and a certified transcript of the proceedings of the
County Commissioners, all on file in the office of the Village Manager
be, and the same hereby is; accepted.
SECTION 2. That this Ordinance shall take effect and be in force from
and after the earliest period allowed by law.

I We, the members of the Board of County Commissioners
of Franklin County, Ohio, do hereby certify that the papers
hereto attached constitute the original papers and a true
transcript of all proceedings had by the Board of County Com-

I IN WASHINGTON TOWNSHIP TO THE VILLAGE
OF DUBLIN, OHIO - GRANTED
The Commissioners of Franklin County, State of Ohio,
proceeding this day to hear and consider the petition of John
P. Lukeman, et al., filed June 19, 1981, and having in open
hearing heard all of the persons desiring to be heard for
or against the granting of said petition, and having considered
all the facts with reference thereto, and being fully advised,
FIND, that said petition contains all of the matters
required by law; that the territory sought to be annexed is
1:1 adjacent and contiguous to the said Village of Dublin, Ohio;
Ii that the petition contains a full and complete description
Ii of said territory sought to be annexed; that the map for said
:i territory is accurate; that the petition for said territory
i is signed by a majority of the owners of real estate wi~hin
I the territory sought to be annexed; that the required legal
notice has been published; that the territory sought to be
I annexed is not unreasonably large; and that the general good
II of the territory sought to be annexed will be served if this
I annexation is granted, all in accordance with the provisions
I of the Ohio Revised Code 709.033; therefore,

Annexation Petition wherein it is prayed that 1.664 Acres more or
less of Dublin Road, in Washington Township be annexed to the City
of Dublin, which petition is set for h.aring b6fore th. Board of
I County Commissioners of Franklin County, Ohio, on Wednesday,
August 19, 1981, at 10:00 .A.M., that at the time of the filing of
said Petition there were 3 'owners of real estate in the area so
prayed to be annexed, of which 3 owners, 2 had signed and affixed
their signatures to said petition that affiant was the circulator
of said petition and that, to the best of affiant's knowledge,

Dear Mr. Gatto:
I Enclosed is a copy of the resolution adopted on June 24, 1981,by
the Board of County Commissioners setting the time and place
of public hearing for the annexation petition Which you, as
agent, filed with this office on June ~9, 1981.
Under the provisions of Section 709.03 of the Ohio Revised
Code, you, as agent are responsible for the following:
(1) Notification of the date of filing of your petition
with the Board of County Commissioners to be delivered
to the Clerk of the municipality to Which annexation
is proposed and the clerk of each township Which
is included in the annexation. (A map, description
and a copy of the petition should be presented to
each clerk).
(2) Publication of the substance of the petition once
a week for four consecutive weeks in a newspaper
of general circulation in the County. (The enclosed
resolution will satisfy the statutory requirements
and should be used for the published notice).
(3) Service upon the municipal and township clerk of
, a copy of the published notice.
(4) Preparation of an affidavit stating the name of
the agent, the number of owners of real estate at
the time of the filing of petition and the number
of owners signing the petition.
A letter from the municipality to Which an annexation is proposed
stating the availibility of services such as water, sewerage,
and police and fire protection, is also required.

The undersigned, petitioners in the premises, and being a MAJORITY
OF OWNERS OF REAL ESTATE in the territory described, consisting Ofl.66~
acres, more or less, in the Township of Was~in~ton, which are is con-
tiguous and adjacent to the City of Dublin , do hereby pray that
said territory be annexed to the City of Dublin , according to
the statutes of the State of Ohio.
A full and accurate description and a plat of said territory so
prayed to be annexed are attached hereto and made part hereof.
In support of said Petition, your petitioners state that there are

SUBJECT: PROPOSED ANNEXATION
This date I received Notice of a Proposed Annexation to tHe Village
of 1.664 acres of ROADWAY (i.e. Dublin Road - SEE ATTACHED MAP).
The hearing on this annexation is scheduled for August 19, 1981 at
10:00 AM before the Franklin County Commissioners. The subject stretch.
of roadway is approximately 1,180 feet in length.
Two (2) owners of record in the Village have signed the petition, but
their properties only consist of approximately 345 feet of the 1,180
feet. I telephoned ,the County Engineer's Office to obtain further
clarification. Evidently that portion of Dublin Road south of this
proposed annexation will be annexed to the City of Columbus. Further,
no signatures were required of property owners to the south of the
petitioners because only these two owned to the center of the right-of-
way. Therefore, one can say that the County is the petitioner for the
property/roadway to the south which makes sense in that they maintain
that stretch now.
, Is it Council's desire to object or make any other comment on this
annexation? It renders the Village responsible for the maintenance
and policing of an additional 1,180 feet of roadway. Do you have
any strong feelings on this matter? Should we send a representative
to this meeting? (I would note that I will be surprised if this item
does not get handled by the County Commissioners in a rather quick
fashion. )
