AN ORDINANCE AMENDING THE ZONING CODE AND SECTION 1121.03 TO PROVIDE A PROCEDURE FOR DETERMINING USES AND CORRESPONDING ZONING CLASSIFICATIONS NOT OTHER~ I WISE SPECIFICALLY AUTHORIZED. -. WHEREAS, occasionally certain uses of property are not specifically enumerated in the various zoning classifications of the Zoning Code but may be contained therein by implication, and WHEREAS, it is desirous of establishing an expeditious procedure for determin- ing whether such uses are included in otherwise enumerated categories of the Zoning Code, NOW THEREFORE BE IT ORDAINED by the Council of the Village, 6 members con- curring: Section 1. That the Dublin Zoning Code and Section 1121.03 (a) thereof be and hereby is amended to add new sub section 1121.03 (a) (4) to read as follows: (4) Determination of Use. In the case of any use of land or structure which cannot readily be determined to be a permitted, conditional or prohibited use within a zoning classification or within any zoning classification, any person may submit to the Village Mana- ger an application for determination whether the use is either a permitted or conditional use in a specific zoning classification or in any zoning classification of the Zoning Regulations of the I Village. A decision shall be made by the Village Manager who in turn will notify Council prior to their following meeting of the action he has taken and Council:will have the right to override that decision. The determination by the Village Manager shall be for the purpose of enabling the applicant to otherwise comply with the zoning regulations of the Village regarding necessary applications or permits to be obtained and the decision shall in no way act as a commitment by the Planning and Zoning Commis- sion or any other agency of the Village as to future zoning, approval of conditional uses or any other zoning matter. Section 2. This Ordinance shall take effect and be in force from and after the earliest period permitted by law. Passed this 21st day of December, 1981.
