AN ORDINANCE VACATING AND REDUCING A PORTION
OF THE RIGHT-OF-WAY ON SOUTH RIVERVIEW
WHEREAS, certain of the residents of the Village have
petitioned for the vacation of a portion of the right-of-way
along either side of South Riverview Street within the Village,
and
I WHEREAS, the Couna1l of the Village has determined that

, the existing right-of-way is more than sufficient to meet the
highway and related needs of the Village,
NOW THEREFORE BE IT ORDAINED by the Council of the Village,
7 members concurring that:
Section 1. That 15 feet of the existing 50-foot right-of-
way along South Riverview be and hereby is vacated subject to a
perpetual easement reserved to the Village for public utility

purposes. I
Section 2. That said fifteen (15) feet which is vacated
by this Ordinance shall be so constructed that the total fifteen
(15) feet shall be comprised of 7~ feet from each side along the
length of the existing fifty (50) foot right-of-way so that at
no point shall the right-of-way remaining after the vacation be
less than thirty-five (35) feet in width.
Section 3. This Ordinance shall take effect and be in
I force from and after the earliest period permitted by law.

I The undersigned petitioner, rlossie M. Luton, says that she is the
l owner of a lot in the Village of Dublin, Ohio; and that said lot is

'~, located at, and is commonly known a8 97 South Riverview ~~reet.
The petitioner further says that said Riverview Street runs in a
northerly and southerly direction and has a right -of-way width of 50 feet;
that there are buildings and other structures erected on several lots
located on said Riverview street which were inadvertantly built so as to
encroach on said right-of-way; that this condition causes and will cause
the owners of these lots serious difficulty in disposing of said lots;
that a narrowing of said street to a right-of-way of ,5 feet by narrowing
it 7* feet on each side would remedy this problem since none of said
encroachments exceed 7i feet; and that a right-of-way of ,5 feet in
width would be sufficient for said Riverview Street.
The pe~~itioner further says that she feels that the above facts show

detrimental to the general interest of the Village; and that sa.id Riverview

~HEREFORE, petitioner, Flossie M. Luton, prays that the Council of

the Village of Dublin, Ohio by ordinance, declare Riverview Street
narrowed to a right-of-way of '5 feet along the entire length thereof
by declaring that the 7* feet strip alaong the extreme easterly side of
said right-of-way and running the entire length thereof, and the 7* foot

strip aJong the extreme westerly side of said right-of-way and running

I the entire length thereof, heretofore a par~ ofaaid right-of-way, shall

no longer be a part of said right-of-way.
