AN ORDINANCE ESTABLISHING FEES AND PROVIDING
OTHER ALTERNATIVES FOR OPEN SPACE REQUIREMENTS
OF THE VILLAGE.AND AMENDING SECTION 450.06 OF
I ORDINANCE NO. 21:.70"THE ZONING CODE" AND SECTION
502 OF ORDINANCE NO. 27-74 "THE SUBDIVISION
REGULA TIONS'!.
WHEREAS, the purpose of requiring open space dedication is to ensure
that the~e is established an equitable system of contribution to the open
space needs of Dublin, and
WHEREAS, there is a need for flexibility in determining how such open
space needs are to be met.
NOW THEREFORE BE IT ORDAINED by the Council of the Village, 7 members
concurring, that:
SECTION 1.
In all new residential subdivisions and planned unit developments within
the Village the applicant or developer shall make one or more of the follow-
in provisions for public open space:
A. LAND DEDICATION
The basic land dedication requirement shall be that 2% of the total gros;
site area plus .03 acre per dwelling unit proposed shall be set aside
as open space except that in no case shall the open space requirement
exceed 25% of total gross site area. Such area shall constitute ground
I suitable for public parks and playground facilities as reviewed and
approved by the Planning and Zoning Commission, upon the recommendation
of the Parks and Recreation Committee and the Forestry Commission.
B. PROVISION OF PRIVATE RECREATION FACILITIES
If the resulting land dedication is determined to be of insufficient
size or inappropriately located, or if public ownership and operation
of such recreational area is not feasible, the Village may request that
an applicant plan for the provision of privately financed and owned
recreational facilities. Such private park areas shall be not less
than 65% of the land area otherwise required under LAND DEDICATION,
provided that such park areas shall be privately developed for rec- -
reational uses. The applicant shall be required to indicate:
(a) The proposed size and location of the park area.
(b) The proposed recreational facilities and site improve-
ments to be made.
(c) A schedule indicating how actual construction of the
proposed park and improvements are to be phased in
relationship to overall project phasing.
(d) How both ownership and maintenance of such park areas
is to be undertaken.
I C. PARK FEE
Should both previous options be deemed inappropriate or infeasible, the
Village may request an applicant to pay a park fee in lieu of LAND
DEDICATION. Such fee shall be determined by using the following form:

SECTION 2.
A public hearing as required per Section 715 of Ordinance No. 21-70
and Section 900 of Ordinance No. 27-74 is hereby established for
Febrl.lOrv /~ , 1981 at 7:30 p.m. at the Dublin Municipal
Building. ,
SECTION 3.
This Ordinance shall take effect and be in force from and after the
earliest period permitted by law.
