AN ORDINANCE ACCEPTING PETITION FOR ANNEXATION OF TERRITORY
TO THE VILLAGE OF DUBLIN, OHIO, A 3 ACRE TRACT IN "DUBLIN
ESTATES - BELLAIRE SUBDIVISION."
I WHEREAS, said annexation has been approved by the Franklin County Commission-
ers and Council is of the opinion that said territory should be annexed.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State
of Ohio, ~ of the elected members concurring:
SECTION 1. That the petition of Roger A. and Diane E. Murphy for the annex,,:
ation to the Village of Dublin, of the following described territory in tKe
County of Franklin and adjacent to the Village of Dublin, to-wit: (See Attach-
ment "A" - the Legal Description) which is hereby made an official part of
this Ordinance. The accurate map of said territory together with its petition
and a certified Transcript of the proceedings of the County Commissioners re-
lating thereto and on file in the office of the Village Manager be, and the
same hereby is, accepted.
SECTION 2. That this Ordinance shall take effect and be in force from and
after the earliest period allowed by law.

THE VILLAGE OF DUBLIN, OHIO
Si mated in the State of Ohio, County of Franklin, Township of Washington,
Virginia Military Survey No. 2543 and being more particularly described as
follows:
Beginning at an angle point in the East right-of-way of Bellaire Ave.
(50 feet in width). The Northwest corner of lot 13 of Dublin Estates
subdivision. Recorded in Plat Book 27, Page 49a, Recorder!ls O~ice, Franklin
County, Ohio.
Thence Easterly along the North line of lot 13 of said subdivision to the
center line of the Scioto River the existing Dublin Corporation line as
established by- Dublin Ordinance 3-74 arid shown of record in Miscellaneous
Volume 161, Page 25 Recorder's Office. A distance of approximately 834 feet.
Thence Southerly along center line of Scioto River and the West Corporation line
of Dublin, Ohio. A distance of approximately ~1G feet.
Thence Westerly along the South line of lot 13 of said subdivision to the East
right-of-way of Bellaire Ave. A distance of approximately 834 feet.
I Thence Northerly along the East right-of-way of Bellaire Ave. totthe point of
beginning a distance of approximatiUy 150 feet and there to terminate.

! The Commissioners of Franklin County, State of Ohio,
proceeding this day to hear and consider the petition of Robinhood
Estates, Inc., filed April 28, 1979, and having in open hearing
eard all of the persons desiring to be heard for or against
the granting of said petition, and having considered all the
facts with reference thereto, and being fully advised,
FIND, that said petition contains all of the matters
required by law; that the territory sought to be annexed is
adjacent and contiguous to the said Village of Dublin, Ohio;
that the petition contains a full and complete description
of said territory sought to be annexed; that the map for said
territory is accurate; that the petition for said territory
is signed by a majority of the owners of real estate within
the territory sought to be annexed; that the required legal
notice has been published; that the territory sought to be
annexed is not unreasonably large; and that the general good
of the territory sought to be annexed will be served if this
annexation is granted, all in accordance with the provisions
of the Ohio Revised Code 709.033; therefore,
IT IS HEREBY ORDERED: On motion of Mr. Dorrian, seconded
by Mr. Foulk, that the prayer of said petition be granted
I and that the territory described in said petition be annexed
to the Village of Dublin, Ohio, in accordance with the law;
that the orders and proceedings of this Board relating to
said petition and map attached thereto, and all papers on
file relating to said matter be deposited at once with the
Clerk of Dublin, Ohio.

Gentlemen:
Data concerning the availability of services to the area proposed
for annexation May 30, 1979 is a8 follows:
SEWER SERVICE .
A major Interceptor Sewer is now being constructed along the Scioto
River, just west of thea,..ea proposed for annexation which is sched-
uled for completion in early 1980. The area is in our Sewer Service
I Contract with the City of Columbus.
WATER SERVICE
The subject area is in our Water Service Contract with the City of
Columbus, therefore, it can be served when planning and financial
obligations will p~rmit.
PO L I CEPROTECT I ON
~Village currently has 24 hour coverage with nine (9) full-time
and twelve (12) Reserve Officers. Communications are handled through
I cOAtreet with P.P~y Township and Dublin do.s have Mutual .Id agree-
ments with other Frank I in County Pol it i cal subd i vi s ions as we II as
Delaware County.
FIRE PROTECT I ON
Fire protection is provided by the Washington-Perry Townships Fire
Department and, they too, have mutual aid Agreements with other Fire
Departments.
MA I NTENANCE AND J MPRQVEMENTS
The Village spends 8 considerable amount of funds to maintain good
services in the area of Street and Road maintenance, Snow removal,
I etc., therefore, this area could be served with the same services
currently provided to Village residents.
It is the feel ing of Dublin Officials that we can and wi II, provide
good services to this area proposed for Annexation.

Dear Mr. Barger:
Enclosed is a copy of the resolution adopted on April 12, .1979,
by the Board of County Commissioners setting t~e time and place
of ~ublic hearing fo,~ the annexation petition Which you, as
I age'nt,filed with th'is office on March 28, 1979.
Under the provisions of Section 709.03 of the Ohio Revised
Code, you, as agent are responsible for the following:
(1) Notification of the date of filling of your petition
with the Board of County Conunissioners to be delivered
to the Clerk of the municipality to which annexation
is proposed and the clerk of each township which
is included in the annexation. (A map, description
,and a copy of the petition should be presented to
each clerk).
(2) Publication of the substance of the petition once
a week for four ,consecutive weeks in a newSpaper
of general circulation in the County. (The enclosed
resolution will satisfy the statutory requirements
and should be used for the published notice).
(3) Service upon the municipal and township clerk of
a copy of the published notice.
(4) Preparation of an affidavit stating the name of
the agent, the number of owners of real estate at
I the time of the filing of petition and the number
of owners signing the petition.
A letter from the municipality to which an.annexation is proposed
stating the availibility of services such as water, sewerage,
and police and fire protection, is also required.

FIXED FOR WEDNESDAY, MAY 30, 1979 AT 10:00 A.M.
I Mr. Dorrian, offered the fOllowing resolution and moved that the
adoption of the same, which was duly seconded by Mr. Foulk:
BE IT RESOLVED, by the Board of County Commissioners of Franklin
County, Ohio, that the petition for annexation of certain territory
to the Village of Dublin, Ohio, by Robinhood Estates, Inc., signed by
Robert M. Blackford Jr., and appointing John V. Barger III, as agent for
said territory being described as follows:
Situated in the State of Ohio, County of Franklin, Township of Washing-
ton, being in the Virginis Military Survey No. 2543, containing 54.3 acres
of land, morel or less, said 54.3 acres being more particularly described as
follows:
Beginning at an angle point in the existing Village of Dublin, Ohio,
corporation line as the same was established by Village of Dublin, Ohio, Or-
dinance No. 13-65 shown of record in Miscellaneous Record Volume 139, Page
282, said angle point being at a northwesterly corner of the John L. McKitrick
et al (3) Trustees 96.36 acre tract ( being the northwesterly corner of a
108.64 acre tract shown of record in Deed Book 2195, Page 334) said angle
point also being the southeasterly corner of the B.B. Starley 0.32 acre tract~
at the northeasterly corner of the B.B. Starkey 9.97 acre tract and at the
southwesterly corner of the B.B. Starkey 0.87 acre ('ZZ"foot wide by 1717f

Thence eastwardly, with the southerly line of said 1.672 acre tract and
with the northerly line of said 0.87 acre tract, a distance of 382 feet, more
or less, to a point located 30.00 feet westerly from, as measured at right
angles, the centerline of said Dublin-Bellepoint Road;
Thence southwardly, parallel with and 30.00 feet westerly from, as measured
at right angles, the centerline of said Dub1in-Be11epoint Road, a distance of
I 23 feet, more or less, to an angle point in said Village of Dublin, Ohio, Cor-
poration Line ( M.R. 139, P. 282), the same being in the southerly line of said
0.87 acre tract and in the northerly line of said 96.36 acre tract ( being
the northerly line of said 108.64 acre tract shown of record in Deed Book 2195,

Thence westwardly, with said existing Village of Dublin, Ohio, corporation
line ( M.R. 139, P. 282), with the southerly line of said 0.87 acre tract and
with the northerly line of said 96.36 acre tract, a distance of 1,686 feet,
more or less, to the point of beginning and containing 54.3 acres of land, more
or less, sought to be annexed to the Village of Dublin, Ohio.
The, Deed Book and the Miscellaneous Records referred to hereinabove are
of record in the Recorder's Office, Franklin County, Ohio.
Together with a map of said territory accompanying said petition filed
with the Board of County Commissioners, Franklin County, Ohio, on March 28,
1979 and presented to the Board at a regular session thereof held this 12th day
of April, 1979 be and hereby filed with the office of the County Auditor; and
BE IT RESOLVED, by the Board of County Corrmissioners of Franklin County,
Ohio, that a hearing upon said petition shall be held at the County Commissione
Hearing Room, 3rd floor, at the Franklin County Administration Building, at 10.
A.M., on May 30, 1979; and
I BE IT RESOLVED, that the County Administrator to the Board of County Comm-
issioners be and hereby is directed to notify the agent of the petitioners of

I The 'undersigned, petitioners in the premises, and being
a MAJORITY OF OWNERS OF REAL ESTATE in the territory hereinafter
described, consisting of 54.3 acres, more or less, in the
Township of Washington, which are contiguous and adjacent
to the Village of Dublin, do hereby pray that said territory~
be annexed to the Village of Dublin, according to the statues
of the State of Ohio.
A full and accurate description and a plat of said territory
so prayed to be annexed are attached hereto and made part hereof.
In support of said Petition, your petitioners state that
there are within the territory so prayed to be annexed one (1)
OrmERS OF REAL ESTATE.

John V. Barger, III, is hereby appointed Agent for the
undersigned Petitioners, as required by Section 709.02 of the
Revised Code of Ohio. Said Agent is hereby authorized to make
any amendment and/or deletion which in his absolute and complete
discretion is necessary or proper under the circumstances then
existing, and in particular to make such amendment in order to
correct any discrepancy or mistake noted by the Franklin County
I Engineer in his examination of the Petition and plat. Said
amendment shall be made by the presentation of an amended plat
and description of the Board of Commissioners on, before,or
after the date set for hearing on this Petition.
