FW No.3 5 Resolution No. 51 -12 Passed 20 A RESOLUTION ACCEPTING THE LOWEST AND BEST BID FOR THE DUBLIN ROAD SOUTH MULTI -USE PATH, TUTTLE ROAD TO HERTFORD LANE PROJECT AND AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT FOR SAID PROJECT WHEREAS, formal advertising and competitive bidding procedures have been conducted, pursuant to Section 8.04 of the Revised Charter and Chapter 37 of the Dublin Code for the Dublin Road South Multi -Use Path, Tuttle Road to Hertford Lane project; and WHEREAS, Council has determined that the bid submitted by Decker Construction Company constitutes the lowest and best bid; and WHEREAS, Council has determined that there may be a legitimate need to declare the relocation of the utilities in connection with the above - referenced project as a "single source" procurement, for reason that the company owning the utilities in question has the exclusive rights to relocate such utilities. NOW THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, of its elected members concurring, that: Section 1. The bid submitted by Decker Construction Company in the total amount of $229,180.25 is hereby accepted. Section 2 . The City Manager is hereby authorized to enter into contracts with Decker Construction Company for performance and completion of the Dublin Road South Multi -Use Path, Tuttle Road to Hertford Lane Project pursuant to the Advertisement, Proposal and Contract Documents for said project on file in the office of the City Engineer. Section 3. This Resolution shall take effect upon passage in accordance with Section 4.04(a) of the Revised Charter. Richardson, P.E., P.S., Engineering Manager - Design Memo Re: Resolution No. 51 -12 - Dublin Road South Multi -Use Path, Tuttle Road To Hertford Lane — Bid Acceptance Summary On August 30, 2012, three (3) bids were received, publicly opened and read for the Dublin Road South Multi -Use Path (Tuttle Road to Hertford Lane) project, which involves the construction of approximately 1,500 feet of an eight -foot wide asphalt multi -use (shared -use) path and concrete ramps along the west side of Dublin Road from Tuttle Road to Hertford Lane. Although located entirely within the existing road right -of -way of Dublin Road, the path extends along the frontage of ten private properties. However, in order to best transition the path into the driveways and front yards of the private properties, temporary right -of -entry (ROE) agreements will be necessary from each of the ten property owners to allow work to occur beyond the existing right -of -way. The Engineer's estimate for this project is $180,000.00. The funds for the construction of this project are from the Capital Improvements Tax Fund. Decker Construction Company submitted the lowest and best bid of $229,180.25. Staff has reviewed all bids and a summary of the bids is listed below. Staff has compared the Engineer's estimate to the three bids received. Notably, the bid prices for asphalt, concrete pipe and excavation were higher than on other recent shared -use path projects. This appears to be due to the number of driveway crossings on this project and the amount of bedrock to be excavated for the storm sewer pipe installations. Another likely factor impacting the bids is the performance of the project in the fall construction season, at a time when many contractors and subcontractors have already committed to other projects. Considering the three bids submitted are all within a few percent of each other, staff believes the Engineer's estimate did not accurately reflect the true cost to construction this path. Over the past few weeks, staff has meet with each of the ten property owners to secure donated ROE agreements in exchange for the work on their driveways and the replacement of up to two trees if trees Resolution 51 -12 - Dublin Road South Multi -Use Path Bid Acceptance September 6, 2012 Page 2 of 2 were being removed from their property as a result of the path construction. To date, five property owners have returned signed ROE agreements. Three property owners have indicated their unwillingness to provide a ROE agreement for various reasons, but generally due to not being in favor of the path installation. In discussions with all the property owners, staff has been clear that the path installation can occur within the right -of -way without a ROE agreement and their driveways and yards can be transitioned at the right -of -way line. Although these transitions at the right -of -way will be functional, they most likely will not be smooth, and in some cases may be abrupt and undesirable in terms of appearance and "ride" when traversing the driveway. Staff anticipates the construction to commence before the end of September. Dublin Road is currently closed to through traffic on Dublin Road between Tuttle Road and Hertford Lane while the Hirth/Wolpert culvert beneath Dublin Road (just south of Hertford Lane) is replaced. The scheduled completion date for this path project is November 9, 2012. Recommendation Staff has thoroughly reviewed the Decker Construction Company bid, and although higher than the Engineer's estimate, finds it to be a true and accurate cost to construct this path project. Previous experience with Decker Construction Company has been favorable, including the Emerald Parkway /Innovation Drive Intersection Improvements project constructed in 2009.
