AN ORDINANCE PROVIDING FOR A CHANGE OF ZONING
OF CERTAIN REAL ESTATE TO THE R-12 "URBAN RES-
I IDENTIAL DISTRICT." A 3.259 ACRE TRACT OF LAND
AT THE REAR OF THE LA SCALA RESTAURANT.
NOW, THEREFORE, BE IT ORDAINED by the Counci I of the Village of
Dublin, State of Ohio, ~ of the elected members concurring:
SECTION I. That the following described real estate (see attach
ed lega,l description marked Exhibit "A") situated in the Vi Ilage
of Dublin, State of Ohio, is hereby rezoned to the R-12 "URBAN
RESIDENTIAL" Zoning district and shall be subject to regulations
and procedures contained in Ordinance No: 21-70, the Village of
Dublin Zoning Code, and amendments thereto.
SECTION 2. The application, Exhibit "B", the list of contiguous
property owners, Exhibit "C", the location plat, Exhibit "0" and
the recommendations of the Planning and Zoning Commission, Ex-
hibit "E" are all incorporated into and made an official part
of this Ordinance and said real estate shall be developed and
used in accordance therewi~h.
SECTION 3. That this Ordinance shall take effect and be in
force from and after the earliest period allowed by law.

PLANNING AND ZONING COMMISSION
I MINUTES
The Plaming and Zoning Commission met on Tuesday, May 6, 1980 at 7:30
p.m. in the Dublin 'Municipal Building with the following members present:
Amorose, Callahan, Caudy, Hutchins, Macklin and Moffitt. Absent from the
meetingwss Mr. Mand. Also present were Mr. Wolfe, Engineer; Mr. Helman,
Plsmer; and Mr. Gunner, Assistant law Director. The minutes of the
April B, 19BO regular meeting and the April 14, 1980 special meeting
were read and approved.
REZONING - EARlINGTON - ZM-4-BO
The rezoning to P.U.D. of 285.9 acres south of Brand Road, to be known
as "Earlington Village" was reviewed and discussed in detail. Mr. Harri-
son Smith represented the applicants, Brand Road Investment Co.
Following a discussion of the request, Mr. Caudy moved recommendation to
Council to approve said retoning, with the following suggestions to Coun-
cil: (1) request Council to negotiate with applicant for funding by
applicant of a portion of the North Fork of Indian Run Sewer, (2) that
Council establish date of construction of the new gravity sewer system.
The motion was seconded by Mr. Hutchins and passed with the vote as
follows: 5-Veas: Callahan, Caudy, Hutchins, Macklin, Moffitt. I-Nay:
I Amorose.
The Chai~an aSked the applicant to (a) define their use of the term
"cluster" housing and (b) add the wording used in Brandon Village's
text regarding the preservation of trees to Earlington's text before
presentation to Council.
Mr. Caudy and Mr. Hutchins requested that the Commission not grant
approval of the final development plan without a gravity sewer system
and a report relative to the fiscal impacts of the project.
REZONING - BRANDON -ZM-3-80
The rezoning request for IIBrandon Village", being 237.9 acres located
north of Brand Road, was next discussed. Commission members expressed
their concerns regarding flood plains, lot grading and ~ocation of
parks and open spaces. Following a lengthy discussion of the rezoning
request to P.U.D., Mr. Moffitt moved to recommend approval. The motion
was seconded by Mr. Macklin and passed with the vote as follows: 5-Yeas:
Callahan, Caudy, Hutchins, Macklin, and Moffitt. I-Nay: Amorose.
Mr. Caudy then moved to amend the motion to read "Recommend approval
with the condition that the Commission will not approve any final
development plan that requires use of forced main sewer system."

REZONING REQUEST - BRANDON (continued)
The amended motion was seconded by Mr. Moffitt and passed with the vote
as follows: 5- Yeas: Callahan, Caudy, Hutchins, Macklin, Moffitt.
I-Nay: Amorose.
The Commission requested the applicant to make the following changes in
I their request to Council:
1) Define "cluster" housing
2) Change of the wording "multi-family" as used on the preliminary
plat plan
3) Indian Run flood plain to be clearly detailed on preliminary
development plan.
Mr. Caudy expressed a strong interest in the fiscal impacts of the pro-
ject being reported to the Commission before approval of the final develop- .
ment plan.
REZONING -ZM-5-80
The request of Richard Corna and Benito Ciotola for 2.685 acres to be
rezoned to R-12, was discussed by the Commission members. In their re-
view of the request, it was determined that approval would be required
on three separate items.
The Commission first discussed the lot split of the L-shaped outlet to
Route 11161. Mr. Moffitt moved approval of said lot split. Mr. Amorose
seconded the motion which was unanimously passed.
The members next reviewed and discussed the rezoning request for the
2.685 acres behind La Scala Restaurant. Mr. Moffitt moved to recommend
I approval. Mr. Macklin seconded the motion which passed with the vote
as follows: 5-Yeas: Amorose, Callahan, Caudy, Macklin, Moffitt. I-Nay:
Hutchins.
They next reviewed the l6l/Sawmill Corridor Development Plan. Following
a discussion, Mr. Moffitt moved, secmnded by Mr. Macklin to approve this
request with the understanding that the following conditions be met:
1) screening be erected on south of property to screen the single-family
residents' property from this multi-family development, 2) provision for
sidewalks to be worked out with the Village Engineer which are to be
constructe,d along the roadway leading to the entrance at Route 11161. This
motion was unanimously passed.
Mr. Caudy again expressed a strong interest in the fiscal impact of the
project being reported to the Commission before approval of the final
development plan. Mr. Helman suggested that the entrance corner would
have to be softened before further approval also.

HEMINGWAY VILLAGE WEST - SECTION II
The final development plan was reviewed for Section II of Hemingway
Village West. Mr. Caudy made a motion to approve, seconded by Mr.
Moffitt and unanimously passed.
I ~IGN REQUEST - GRABILL REALTY
The Commission reviewed the request of Grabill Realty for three signs
to be placed one each at the entrances to Hemingway and Shannon and a
directional sign at the corner of Post and Coffman Roads. following
a review of the sign request, the applicant withdrew the application
for the potential directional sign at Post and Coffman. Mr. Caudy
moved to approve the entrance signs at Hemingway Village and Shannon
Park as applied for. The motion was seconded by Mr. Moffitt and
unanimously passed.
SIGN REQUEST - WATERfORD VILLAGE
The request for a constructed sign to be placed at the entrance to
St. Andrew's Court was discussed next. Mr. Caudy moved to approve
the sign request, subject to the Village Engineer's approval of the
exact sign location. . The motion was seconded by Mr. Moffitt and
unanimously passed.

INfORMAL DISCUSSION - LLEWELLYN fARMS
I Mr. Pete Ed~ar~s, representing the Edwards Land Co., presented for
informal discussion the rezoning of land proposed for annexation in-
to the Village of Dublin. The Commission members discussed types of
rezoning appropriate for the property, parks and open spaces, ingressl
egress onto Dublin Road and other questions regarding the proposed
rezoning request. .
