76-08 ResolutionRECORD OF RESOLUTIONS Dayton Legal Blank, Inc., Farm No 30045 76-08 Resolution No. Pas.recl , 20 A RESOLUTION DESIGNATING THE CITY MANAGER AS THE CITY'S OFFICIAL REPRESENTATIVE AND AUTHORIZING THE CITY TO FILE A GRANT APPLICATION WITH THE OHIO PUBLIC WORKS COMMISSION CLEAN OHIO CONSERVATION FUND. WHEREAS, the State of Ohio, through the Ohio Public Works Commission, administers financial assistance for open space and riparian corridors, through the State of Ohio Clean Ohio Conservation Fund, and WHEREAS, the City of Dublin desires financial assistance under the Clean Ohio Conservation Fund to reimburse a portion of the cost of acquisition of land located along Bright Road and the Billingsley Creek. NOW, THEREFORE BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, ~of the elected members concurring that: Section 1 The City of Dublin approves filing a grant application, to receive financial assistance from the Clean Ohio Conservation Fund. Section 2. The City Manager is hereby authorized and directed to execute and file an application with the Ohio Public Works Commission and to provide all information and documentation required to become eligible for possible funding assistance. Section 3. The City of Dublin does agree to obligate the funds required to satisfactorily complete the proposed project and become eligible for reimbursement under the terms and conditions of the Clean Ohio Conservation Fund. Section 4. This Resolution shall be effective upon passage in accordance with Section 4.04(a) of the Revised Charter. Grigsby, Interim City ManageL~.r~~ ~~~ Date: October 2, 2008 (`~ Initiated By: Melody Kennedy, Financial Analyst Jamie Adkins, Planner II Laura Karagory, Landscape Architect Re: Resolution 76-08 -Clean Ohio Conservation Fund (Round 4C) Hopewell Earthworks and Billingsley Creek Preservation Memo Summary The Clean Ohio Fund, as approved by Ohio voters, is a $400 million bond program to be spent over four years. Round 4C is the final round for this bond program. A bond renewal has been approved by the House and Senate, signed by the Governor and will be placed on the November 4 ballot. Franklin County, District 3, has $4.1 million in available conservation funding for Round 4C. As usual, funding is very competitive. With $4.lmillion to award, there are project requests over $9.9 million in District 3. At the end of August, the City submitted its preliminary documents to District 3 for funding consideration for the acquisition of 4729 Bright Road, owned by the Josephine Holder Trust. The City's application for the Clean Ohio Fund includes the 12+/- acres designated as future park land and encompasses the Hopewell Earthworks and the Billingsley Creek corridor. In September, the District 3 Grant Committee approved a motion allowing the City to go forward with the grant process. As required, the next step in the process is completing a Resolution authorizing the City Manager to file a grant application with the Ohio Public Works Commission for Clean Ohio Conservation funding, and certifying that local funds are available for the City's matching share. You may recall that in 2005, the City submitted a Clean Ohio grant for funding to assist with the acquisition of the Holder Properly, and was awarded a grant in the amount of approximately $125,000. Although the Holder Family was participatory in the grant process, ultimately the Holder Family decided they were not ready to sell their family homestead at the time. The project eligibility requirements for the Clean Ohio Conservation Fund are very specific. If acquiring land, the grant requires the land to be purchased and retained in perpetuity, and used for passive nature- awareness types of activities. Prior to the application submission date of October 31, 2008, a Purchase Contract for the property must be in place. The Holder Family has been very receptive to staff, and we are hopeful that a Purchase Contract can be negotiated by the grant submittal deadline. Officials from Washington Township have offered to write a letter of support for the City's Clean Ohio Grant submittal. Ciry staff is also discussing the possibility of obtaining funding assistance from Washington Township for the project. Recommendation Staff is recommending approval of Resolution 76-08, authorizing the City to submit a grant application to the Clean Ohio Conservation Fund.
