64-08 ResolutionRECORD OF RESOLUTIONS 30045 Resolution No. 64-08 Pcrs,red . ~0 A RESOLUTION AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION TO THE DISTRICT 3 INTEGRATED COMMITTEE OF THE OHIO PUBLIC WORKS COMMISSION AND TO ENTER INTO AN AGREEMENT WITH THE OHIO PUBLIC WORKS COMMISSION FOR THE PURPOSE OF ACQUIRING GRANT FUNDS THROUGH THE STATE CAPITAL IMPROVEMENT PROGRAM/ LOCAL TRANSPORTATION IMPROVEMENT PROGRAM FOR THE EMERALD PARKWAY PHASE 8- RIVERSIDE DRIVE TO BILLINGSLEY CREEK PROJECT WHEREAS, pursuant to Article VIII, Section 2k of the Ohio Constitution, the State of Ohio is authorized to issue bonds and other obligation of the state for the purpose of financing public infrastructure capital improvements of political subdivisions as designated by law; and WHEREAS, pursuant to Section 164.06 of the Ohio Revised Code, the District Three Public Works Integrating Committee has been created to accept, evaluate, and recommend applications for state funding of capital infrastructure improvements projects of political subdivisions in Franklin County; and WHEREAS, pursuant to Section 164.05 of the Ohio Revised Code, the Ohio Public Works Commission has been created to accept and approve application for state financial assistance for capital infrastructure improvement projects of political subdivisions in Franklin County; and WHEREAS, the City of Dublin has conducted a capital inventory and needs assessment and has determined that it is necessary to submit applications for financial assistance for capital infrastructure improvement projects; and WHEREAS, the City of Dublin desires to apply to the District 3 Integrating Committee of the Ohio Public Works Commission for Round 23 State Capital Improvements Program (SCIl') and/or Local Transportation Improvement Program (LTIP) Grant Funds for the Emerald Parkway Phase 8- Riverside Drive to Billingsley Creek Project. NOW, THERFORE, BE IT RESOLVED, by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring that: Section 1: The City Manager is hereby authorized and directed to apply to the District Three Public Works Integrating Committee and the Ohio Public Works Commission for financial assistance for the following capital infrastructure improvement project: Emerald Parkway Phase 8- Riverside Drive to Billingsley Creek Project Section 2: The City Manager is further authorized and directed to enter into any agreements as may be necessary and appropriate for obtaining this financial assistance in conjunction with the recommendation of the City Engineer, and approved as to form by the City Law Director, in accordance with all authority granted to and limitation upon by the City Director of Finance. Wolter, P.E., Civil Engineer RE: Resolution No. 64-08 Emerald Parkway Phase 8-Riverside Drive to Billingsley Creek Project Ohio Public Works Commission Round 23 Grant Application Summary The District Three Public Works Integrating Committee of the Ohio Public Works Commission has available grants and/or loans for infrastructure improvements through the State Capital Improvement Program (SLIP) and/or the Local Transportation Improvement Program (LTIP). Staff is presently preparing the necessary documentation to complete the required application for Emerald Parkway Phase 8, Riverside Drive to Billingsley Creek Project, Project No. 07-008-CIP. The application is due to the Mid-Ohio Regional Planning Commission (MORPC) on September 8, 2008. The two funding sources available through this grant application are LTIP and SCIP. LTIP funds are available through the federal government via the per gallon federal gas tax. This money becomes available July l , 2009 and is distributed through grants only. SCIP funds are supported by the sale of state bonds. This money is also available July 1, 2009 and is distributed in the form of grants and loans. No local match is required with the LTIP application, whereas a 50°Io local match is required with the SCIP application. The total estimated project cost is approximately $13,621,900 which includes final design, bidding, construction, inspection services, right-of-way acquisition and contingences. To secure the best possible scoring, staff is requesting approximately $667,473 in grant money under the LTIP funding process and $2,000,000 as loan money under the SCIP process. The loan is a 0°Io interest loan for 20-years. Funds received from either source will provide assistance with upfront cash flow associated with this project. This project will be funded by the TIF districts (McKitrick, Kroger Centre and Lifetime Fitness) that have designated Emerald Parkway as a public infrastructure improvement benefiting the property within the districts. Recommendation Staff recommends Council approval of Resolution 64-08 authorizing and directing the City Manager to apply to District Three Public Works Integrating Committee and the Ohio Public Works Commission for financial assistance for the Emerald Parkway Phase 8, Riverside Drive to Billingsley Creek Project. Further, Resolution 64-08 will authorize and direct the City Manager to enter into any agreements as may be necessary and appropriate for obtaining this financial assistance should the grant receive favorable consideration.
