A RESOLUTION ACCEPTING THE LOWEST AND
BEST BID FOR THE 2008 SIDEWALK MAINTENANCE
PROGRAM IN THE CITY OF DUBLIN, OHIO
WHEREAS, formal advertising and competitive bidding procedures have been
conducted, pursuant to Section 8.04 of the Dublin Charter and Chapter 37 of the
Dublin Code, for the 2008 Sidewalk Maintenance Program; and
WHEREAS, Council has determined that the bid submitted by Shelly and Sands, Inc.
constitutes the lowest and best bid received; and
WHEREAS, Council has determined that there may be a legitimate need to declare
the relocation of the utilities in connection with the above-referenced project as a
"single source" procurement, for reason that the company owning the utilities in
question has the exclusive rights to relocate such utilities.
NOW, THEREFARE, BE IT RESOLVED by the Council of the City of Dublin,
State of Ohio, ~ of the elected members concurring:
Section 1. That the bid submitted by Shelly and Sands, Inc. in the total amount of
$133,802.30 is hereby accepted.
Section 2. That the City Manager is hereby authorized to enter into contracts with
Shelly and Sands, Inc. for performance and completion of the 2008 Sidewalk
Maintenance Program pursuant to the Advertisement, Proposal and Contract
Documents for said project on file in the office of the City Engineer.
Section 3. This Resolution shall take effect and be in force upon passage in
accordance with Section 4.04(a) of the Revised Charter.

RE: Resolution 49-08 -Bid for 2008 Sidewalk Maintenance Program
Background
Memo
On June 25, 2008 three (3) bids were received, publicly opened and read for the 2008 Sidewalk
Maintenance Program. Staff has reviewed all bids. The Engineer's estimate was $125,000. The 2008
budgeted funds for construction of this project are $125,000.00. Shelly and Sands, Inc. submitted the
lowest and best bid of $133,802.30. A summary of the bids is listed below.

All bids received were higher than the Engineer's estimate. We believe this is due to the substantial rise
in gas, diesel, and concrete prices.
The low bid received was from Shelly and Sands, Inc. in the amount of $133,802.30. Staff has
thoroughly reviewed the Shelly and Sands bid. Previous experience with this company has been
favorable, including the following projects: 1996 Street Maintenance Program; Frantz Road/S.R.
161/Post Road Intersection; and S.R. 161 Improvements -Dale Drive to Sawmill Road.
For Council reference and review, a reduced set of project construction drawings has been placed in the
Council Planning Room.
The 2008 Sidewalk Maintenance Program will focus on commercial and residential areas where repairs
are necessary but will not require removal of street trees.
Recommendation
Staff recommends approval of Resolution 49-08 accepting the bid of Shelly and Sands, Inc. and
authorizing the City Manager to enter into a contract for this project.
