45-08 ResolutionRECORD OF RESOLUTIONS Resulu~lru, No. 45-08 Pnsscd , 20 A RESOLUTION ACKNOWLEDGING THE "VETERANS OF FOREIGN WARS ("VFW") AND VFW LADIES AUXILIARY WEEK" IN THE CITY OF DUBLIN, OHIO, WELCOMING MEMBERS OF BOTH GROUPS TO THE 88TH VFW STATE CONVENTION BEING HELD IN THE CITY OF DUBLIN, OHIO, AND WAIVING THE REQUIREMENTS OF SECTION 132.03 OF DUBLIN CODIFIED ORDINANCES. WHEREAS, the VFW and the VFW Ladies Auxiliary includes 2.3 million members in approximately 8,400 posts worldwide with a mission to "honor the dead by helping the living" through veterans' service, community service, national security, and a strong national defense; and WHEREAS, the VFW has been and continues to be a leading veterans' organization by contributing over 13 million volunteer hours annually, providing more than $2.5 million annually in college scholarships, being instrumental in establishing and improving services and memorials for veterans including, but not limited to, the Veterans Administration, the 20`h century GI Bill, national cemeteries, compensation for Vietnam veterans exposed to Agent Orange and Gulf War veterans diagnosed with Gulf War Syndrome, and improving medical services for women veterans; and WHEREAS, City Council will proclaim June 25, 2008, through July 2, 2008, as "VFW and VFW Ladies Auxiliary Week" in the City of Dublin, Ohio, and will welcome members of both groups to the 88~'' VFW State Convention being held in the City of Dublin, Ohio; and WHEREAS, City Council acknowledges that the VFW and the VFW Ladies Auxiliary will render atwenty-one gun salute as part of the 88`'' VFW State Convention; and WHEREAS, Section 132.03 of the Dublin Codified Ordinances prohibits the making of unreasonable noises which by their nature tend to invite breach of the peace and prohibits the creation or causing of noise so as to disturb or disrupt the peace and quiet of persons of normal sensitivity, thereby prohibiting atwenty-one gun salute. NOW, T EREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. The provisions in Section 132.03 of the Dublin Codified Ordinances are hereby waived for the sole purpose of allowing the rendering of a twenty-one gun salute by the VFW and the VFW Ladies Auxiliary at 10:30 p.m. on Saturday, June 28, 2008. . Section 2. City Council directs staff to ensure that all Dublin Codified Ordinances and Ohio laws, including those enacted for the health, safety, and welfare ofDublin residents are enforced with regard to the twenty-one gun salute and to provide notice to the surrounding residential area. Section 3. This resolution does not waive enforcement of any other provision of the Dublin Codified Ordinances or Ohio law. Section 4. This Resolution shall take effect and be in force upon passage in accordance with Section 4.04(a) of the Revised Charter. Brautigam, City Manager~~s~ DATE: June 12, 2008 INITIATED BY: Charlotte Worstall, Management Assistant RE: Resolution 45-08 -Waiving Requirements of Section 132.03 of the Dublin Codified Ordinances for VFW State Convention, June 28, 2008 Summary Resolution 45-08 provides for the provisions in Section 132.03 of the Dublin Codified Ordinances to be waived in order to allow the rendering of a twenty-one gun salute by the VFW and the VFW Ladies Auxiliary on Saturday, June 28, 2008, at 10:30 p.m. This memorial ceremony will be held in the west parking lot of the Embassy Suites Hotel, located at 5100 Upper Metro Place (see attached aerial photograph). City staff have confirmed that permission to hold the memorial service has been granted by the Embassy Suites pending Council approval of Resolution 45-08. The twenty-one gun salute will consist of three volleys of seven blanks, which will ensure the safety of neighboring businesses and residential areas. However, the salute will create some amount of noise. Pending approval of Resolution 45-08, Community Relations is prepared to notify neighboring residents and business owners of the memorial ceremony activities and their potential impact. The memorial ceremony will be held at the close of the 88`'' VFW and VFW Ladies Auxiliary State Convention. The purpose of the memorial ceremony is to honor all of the veterans who have never been recovered and to provide closure to their families and loved ones. The performance of the twenty-one gun salute is the highest respect a deceased veteran can receive. Recommendation Staff recommends passage of Resolution 45-08 at the June 16, 2008 Council meeting.
