AN ORDINANCE TO PROVIDE FOR THE REGULATION OF ALARM SYSTEMS
I IN THE VILLAGE OF DUBLIN AND AMENDING THE CODIFIED ORDINANCES
BE IT ORDAINED by the Council of the Village of Dublin, Franklin County,
State of Ohio, t, members concurring, that:
SECTION 1. That a new Amendment to the Codi fied Ordinance "Alarm Systems," be
and hereby is enacted to read as follows:

.01. Definitions.
a) "Alarm system" means any assembly of equipment and devices which
signals so as to be seen or heard outside the protected building
or space the presence of fire, smoke, robbery, burglary, vandal-
I ism, or unautnorized intrusion and includes an interconnected
alarm system as hereinafter defined.
b) "Interconnected alarm system" means an alarm system which di-
rectly or indirectly, automatically or manually, uses a tele-
phone line or cable line to transmit an alarm or message upon
activation of the alarm system.
c) "Local alarm system" means an alarm system that when activated
only sounds a horn, bell, buzzer, or other type of audible or
visible alarm that is designed to be audible or visible beyond
the premises being served, but which does not result in the
transmission of a signal to any other location.
d) "Appropriate authority" means the Manager of the Village of
Dubli n .
e) "Automatic dialing device" means a device which is intercon-
nected to a telphone line and is programed to select a pre-
determined telephone number and transmit by voice, message,
or code signal an emergency message indicating a need for
emergency response.
f) "False alarm" means an alarm signal or message initiated and
transmi tted either automatically or manually through an alarm

or the Dispatcher at Perry Township eliciting response by
police or fire when fire, smoke, robbery, burglary, vandal-
ism, or unauthorized intrusion does not, in fact, exist, but
does not include an alarm signal caused by hurricanes, torna-
does, thunderstorms, or other oatastrophic acts of God not
reasonably subject to control by the alarm manufacturer,
installer or owner.

I g) "Chargeable False Alarm" means an alarm message or signal inten-
tionally, negligently or recklessly initiated and transmitted
either automatically or manually through an alarm system, to
the Village of Dublin Concord Township Dispatcher or to the
Perry Township Dispatcher elid ting response by police or fire
when fire, smoke, robbery, burglary, vandalism, or unauthoriz-
ed intrusion does not, in fact, exist. This does not include
an alarm signal caused by hurricanes, tornadoes, thunderstorms,
or other catastrophic acts of God, not reasonably subject to
control by the alarm manufacturer, installer, or owner.

I .03. Equipment Maintenance and Inspection of Alarm Systems.
a) All equipment used in installations shall meet the applicable
standards of the Underwriters Laboratories of the United
States, Factory Mutual, or the National Fire Protection
Association, or other recognized industry standard~ The
owner or installer may be required to submit evidence of the
reliabili ty and suitability of the equipment to be installed.
b) The appropriate authority or a designated representative
shall have the authority, at reasonable times and upon oral
notice, to enter upon any premises within the Village, to
inspect only the installation and operation of an intercon-
nected alarm system, the purpose of which is to report an
emergency to the police or fire division. In the event
the premises to be inspected is a private dwelling, such
inspection shall only be done between the hours of 8:00 a.m.
and 8:00 p.m., and only if the notice is in written form
addressed to the owner and presented to a responsible adult.
Under this ordinance such residences are only subject to
the above inspection after three false alarms have origin-
ated from them. The written notice shall cite the specific
false alarm history. Failure to allow reasonable inspection
of such alarm system may be grounds for disconnection from
I an interconnected alarm system.
c) The appropriate authority may require that repairs or adjust-
ments be made whenever he has determined""that such are,neces-
sary to assure proper operation. Failure to make such re-
pairs or adjustments may be grounds for disconnection of the
alarm system.
AMENDMENT d) All alarm systems shall be installed and maintained with an
automatic cut-off and re-set of the alarm within fifteen (15)

I .04. Liability of Village.
a) The installation of interconnected alarm systems in conjunction
with this Chapter shall not constitute acceptance by the Village
of any liability to maintain any equipment , to answer alarms,
or for anything in connection therewith.

a) The provisions of this Chapter are not applicable to home smoke
detectors not intended to be heard outside the dwelling unit,
nor to local alarm systems or audible alarms affixed to struc-
tures, automobiles, boats, boat trailers, house trailers, and
recreation vehicles, or other motor vehicles.
.06. Certification of Charges.
If any of the charges for false police or fire runs ifllJosed herein
are not paid upon receipt of the invoice for same, or within thirty
(30) days thereafter, such charges shall be certified by the Mana-
ger to the Auditor of either Franklin, Union, or Delaware Counties,
wherein the 'property the subject of the false alarm is located, to

collected in the manner provided by law.

Ordinance a) No person shall allow more than three chargeable false alarms
<;?-(25 to be transmitted during the immediately preceding one-year
period. An alarm will be classi Hed as false if the respond-
"(,ll\,~3 ing police or fire personnel see no evidence of fire, smoke,
robbery, burglary, vandalism, unauthorized intrusion, or
medical emergency. If the person proves that the alarm was
caused by an event not reasonably foreseeable, or which
could not have been prevented by the proper adjustment or
presetting of the sensor threshold, the alarm will be desig-
nated a non-chargeable false alarm.

b) Following three chargeable false alarms, the person owning
such system shall, for each chargeable false alarm thereafter,

by any person to create a false alarm as defined in Section
I .01. Violation of this section shall be a misdemeanor of
the first degree.

PER AMENDMENTS APPROVED BY THE COUNCIL AT THE APRIL 18, 1983 MEETING,
THE FOLLOWING ADDITIONS ARE MADE PART OF THIS ORDINANCE:
1. " .07 Appeals
a) Any person affected thereby may appeal the classification of an
alarm as a "false alarm" herein to the Chief of the respective
Police or Fire Division involved for each such determination
that the alarm is false within five (5) days of the initial
determination.
b) For each determination that an alarm is a "false alarm", after
the second such determination, each person affected thereby may
further appeal to the Village Manager from the decision of the
Chief of the respective department involved provided that such
appeal is made within five (5) days of the date of such initial
determination.
c) Any person who desires further appeal from the decision of the
Manager under (b) above may appeal to Council within five (5)
days. The decision of Council shall be final. "
I 2. Under Section .99 Penalties, Item (b), the following sentence is added:
" The Village Manager shall determine such response cost in
cooperation with submissions by the Chiefs of the respective
