AN ORDINANCE CONTROLLING ESTABLISHMENT AND OPERATION
OF HELIPORTS AND HELISTOPS IN THE VILLAGE OF DUBLIN, OHIO
Recognizing the rapid development of and need for helicopter service in
I the Village of Dublin, it has been deemed appropriate to adopt a special
Ordinance to promote the continued growth of such service in a safe and
orderly manner.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin,
II State of Ohio, 1 of the elected members concurring:
SECTION 1. Helicopter Landing Site I
I Defined herein as a heliport, helistop or helipad and any other suface I
! used or usable for helicopter operations. Hereinafter referred to as "Site".
SECTI ON 2. Permit Required
I
It shall be unlawful to takeoff or land a helicopter: anywhere within
the Village of Dublin except at a Site for which a permit, issued by the
I Village of Dublin, as hereinafter provided, is in force unless such landing
, !I or takeoff is done:
I a. When necessary for law enforcement or other public safety purposes,
I b. When necessary for aircraft or medical emergencies,
, c. For a single or one-time landing at a Site not regularly used for
I
.. landings when prior approval is obtained from the Village Manager.
Such aj3proval shaH-hot be unreasonably withheld when the Ohio I
State Transportation Departmellt has issued a temporary heliport
certificate for suchan activity.

SECTI ON 3. Issuance of Permits
Permits for establishing and maintaining Sites shall be issued to the
owner or lessee of the Site by the Village Manager after approval by the
Planning and Zoning Commission and, after the applicant has submitted a
I written application therefor and paid the application fee of $ s: 00 and,
provided written proof that:
a. When located in zoning districts, other than residential, the Site I
complies with the Zoning Code requirements and: I
1. has been inspected and, if applicable, approved and registered
or licensed by either the Division of Aviation of the Ohio
Department of Transportation (ODOT) or the Federal Aviation
Administration for compliance with the criteria set forth in

I in the Transportation Laws of Ohio Annotated with Rules and
Regulations, Chapters TRa-l, TRa-2, and TRa-5, and Amend-
ments thereto and applicable federal regulations; and
2. has received such approval and clearance from the Federal
Aviation Administration (FAA) as may be required by the
Federal Aviation Regulations (FAR's).
b. When located in residential zoning districts, the Site complies with
the Zoning Code requirements and:
l. complies with the above requirements for Sites in zoning
districts other than residential; and
2. the use of the Site is limited to helicopters of twelve I
thousand (12,000) pounds gross weight or less (executive-type
helicopters) for the purpose of internal cargo or personnel
I transportation only.
3. The site, if in a residential zoning district, shall not be
less than one acre, and when in use shall be marked in such a
way as to be clearly visible; and
4. The Site shall not be closer than 500 feet from the nearest
occupied structure, expressway, principal arterial, minor
arterial, or collector street within the Village.
Permits may be approved by the Planning and Zoning Commission if the Site is in
conformance with Zoning Code requirements and, the Zoning Code shall be amended
to provide for such Sites subject to the above considerations.
All permits issued shall be renewed annually and only to the original property
owner or original lessee. If the ownership or tenancy has changed, a new appli- I
I cation shall be required. If any application for a permit is denied, an appeal

may be made to the Village Council.
SECTION 4. Revocation of Permit
The permit shall be deemed automatically revoked if:
a. ODOT Division of Aviation revokes its license for the Site or
refuses to re-license the Site upon periodic inspection (such
inspections are made not less frequently than bi-annually); or

b. The Federal Aviation Administration withdraws or revokes its
approval or clearance of the Site; or
c. Thirty (30) days after the Village ~dministrator has notified
I the permit holder at its last known address in writing that the
Site is no longer in compliance with the requirements herein set
forth by the Village of Dublin for the initial acquisition
of the permit, provided the defect or non-compliance has not been
corrected within the said thirty (30) days.
SECTION 5. Procedure After Revocation"
When the Site permit has been revoked for any of the above reasons, the
owner or lessee shall forthwith cause the Site to be closed to all helicopter
operations by publishing such notices and warnings and employing such marking
as are customary and required by State and Federal authorities to accomplish
such purpos e.
I SECTION 6. Penalties
Anyone who operates a helicopter, or allows operation of a lelicopter,
in violation of the provisions of this Ordinance shall, upon conviction, pay I
a fine of not more than Five Hundred ($500.00) Dollars for each violation.
SECTION 7. Applicabili ty
This Ordinance shall apply to all Sites established within the Village.
Sites previously established shall comply with the requirements of this ~
Ordinance within One Hundred Twenty (120) Days of date of enactment.
SECTION 8. Inconsistent Ordinances
All ordinances or parts of ordinances inconsistent with this Ordinance
are hereby repealed.

This Ordinance shall take effect and be in force from and after the
