HomeMy WebLinkAbout24-75 Resolution ~ca RESOLUTION NO. ~ DECLARING THE NECESSITY OF CONSTRUCTING A WATERLINE IN S.R. 161 FROM SAWMILL ROAD TO POST ROAD, IN POST ROAD FROM S .R. 161 TO COFFMAN ROAD, AND IN COFFMAN ROAD FROM POST ROAD NORTH TO THE HIGH SCHOOL AND IN MONTEREY DRIVE FROM S.R. 161 SOUTH TO THE DEAD END AND . DECLARING AN EMERGENCY ! BE IT RESOLVED by the Council of the Village of Dublin, County of Franklin, State of Ohio: Sec tion 1. That it is necessary to construct a waterline in S.R. 161 from Sawmill Road to Post Road, in Post Road from S.R. 161 to Coffman Road, in Coffman Roaafrom Post Road north to. the' High School and in Monterey Drive from S.R. 161 south to the dead end, and appurtenances as shown on the plans hereinafter referred to, prepared by Burgess & Niple Limited, Consulting Engineers. Section 2. That the grade of said water line improvements shall be the grade as shown by the engineer's plans and profiles which are made a part hereof. Section 3. That the plans, specifications, estimates and profiles of the proposed improvement, heretofore prepared by the engineer and now on file in the office of the clerk of this council, are hereby approved. Sec tion 4. That a portion of the cost of said improvement in the amount of $262,000 shall be assessed by the foot front of the property bounding and abutting upon the improvement upon all lots and lands bounding and abutting upon the proposed improvement between the termini aforesaid, which said lots and lands are hereby determined to be specially benefited by said improvement; I and the Village of Dublin shall pay the balance of the cost of said im- provement which shall include the cost of oversizing waterlines over 8" in diameter where necessary in order to serve area within the Village not to be assessed hereunder for said improvement and which cost shall in no event be less than one fiftieth of the whole cost together with the cost of intersec- tions plus said cost of oversizing waterlines. The cost of said improvement shall include the cost of preliminary and other surveys, plans, specifications, profiles and estimates and of printing, serving and publishing notices, reso- lutions and ordinances, the amount of damages resulting from the improvement assessed in favor of any owner of land affected by the improvement and the interest thereon, of the special assessments, the cost of purchasing, appropri- ating less 50%, and otherwise acquiring therefor any required real estate or interests therein, expenses of legal services including obtaining an approving legal opinion, cost of labor and material and interest on bonds and notes is- sued in anticipation of the levy and collection of the special assessments together with all other necessary expenditures. Section 5. That the consulting engineer be and it is hereby author- ized and directed to prepare and file in the office of the clerk the estimated assessments of the cost of the improvement described in this resolution. Such estimated assessments shall be based upon the estimate of cost of said improve- ment now on file in the office of the clerk and shall be prepared pursuant to the provision of this resolution. When such estimated assessments have been so filed, said clerk shall cause notice of the adoption of this resolution and the filing of said estimated assessments to be served on the owners of all lots , and lands to be assessed as provided in RC 5727.13. Section 6. That the assessments to be levied shall be paid in 20 annual installments, with interest on deferred payments at the same rate as shall be borne by the bonds to be issued in anticipation of the collection thereof; provided, that the owner of any property assessed may, at his option, pay such assessment in cash within thirty days after passage of the assessing ordinance. That bonds of the village shall be issued in anticipation of the collection of assessments by installments and in an amount equal thereto and notes of said village shall be issued in~nticipation of the issuance of such bonds and the levy of such assessments. Section 8. This resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety of said village, and for the further reason that the immediate construction of said improvement is necessary to provide adequate fire pro- tection to the schools, wherefore, this resolution shall be in full force , I and effect from and immediately after its passage. fflLk RI ~ _.
