WHEREAS, COl.D1cil by Resolution 03-75 declared its intent to participate in the Storm Drainage Project and St~. NOW, TIffiREFORE, be it, and it is hereby, RESOLVED, by the COl.D1cil of the Village of Dublin, Ohio (0 of the members concurring, that: SECTIOO 1. The Village Administrator is hereby authorized to enter into a contract, a copy of which is attached hereto, marked Exhibit "A" and made II a part hereof, with the Mid-Ohio Regional Plarming Conunission. SECTION 2. This Resolution be, and it is hereby, declared an emergency measure necessary for the inunediate preservation of the health, safety and welfare of the Village of Dublin, and that it be in force and effect inunediately upon its passage. CONTRACT Between THE Vi Ilage OF Dublin , OHIO n. and MID-OHIO REGIONAL 'PLANNING COMMISSION AGREEMENT This Agreement is entered into this day of , 19 , by and between the Village of Dub Ii n , OHIO, (" VILLAGE"), acting through its ( , pursuant to and under the authority of Res o;I.,ut ion 03-75 passed January 20, 1975 by the ~No. Counci I of the Village of Dub Ii n and approved March , 1975 by the Administrator of the Vi Ilaae , , andMID-OHIQ REGIONAL PLANNING COMMISSION, with offices at 514 () South High Street, Columbus, Ohio, 43215, ("MORPC ") . For the purposes of this document, reference to II VILLAGE.. shall mean the Village Administrator wherever administrative and engineering functions are indicated. 1. THE STORM DRAINAGE PROJECT AND STUDY MORPC, for the consideration hereinafter named, agrees to perform a storm drainage policy planning project and study -1- .... . .. ~ . for Franklin Gounty, Ohio, with the cooperation of the Vi liege , the Board of Commissioners of Franklin County, and the other cities and villages located in Franklin County, Ohio. 2. SCOPE OF SERVICES C For each of, the fOllowing issues, MORPC, with the help of Consultants, will: identify and define the issue or problem area; develope and evaluate alternative solutions or courses of conduct to resolve the issue or problem; and recommend and select the best solution or courses of conduct to resolve the issue or problem. . A. Public versus private controversies and res- ponsibilities. Classification of issues and responsibilities and policy alternatives re- lating thereto. B. Data needs for continuing planning. Specifi- . cation of type of data to acquire, store and U be available for deve}opment and improvement of drainage facilities and systems. C. Uniform design criteria. Develop manual of basic design policies and criteria for imple- mentation agencies including available qptions. D. Funding options for implementation, including existing available funding methods and addi- -2- ." --..-.---- , .. . . tional new methods. Evaluation of suitability, feasibility and acceptability in terms of yield, equity, public acceptance and adminis- . trative efficiency. e, E. Legal constraints and opportunities in imple- mentation of storm drainage projects. Current law and recommended changes in state and local law to facilitate implementation and mainten- ance. F. Outline of storm drainage planning, implemen- t tation and coordination process for the region. Includes public education component. Evalua- tion of alternative systems of planning, imple- mentation, and coordination and multijurisdic- tional actions. 3. PERFORMANCE OF SERVICES U MORPG will provide the technical services necessary in the scope of services but may subcontract for engineering, legal and financial services where.required. Progress of the work will be reviewed and advice given thereon by special technical and policy advisory committees. 4. SERVICES REQUIRED OF THE Vi lIage At no cost to MORPC, the Vi Ilage agrees to furnish all -3- . ... .. . . . existing reports, data, maps, ordinances and other pertinent items applicable to the project. S. TIME OF PERFORMANCE C The scope of services will be performed over a two- year period and will be completed by December 31, 1976. 6. FEES AND P AYI-1ENT For the first year of services performed under this contract by MORPC, the Village shall pay to MORPC, in advance, the Vi Ilage 's share of the total first year project cost, which share is estimated to be Fifty One - Dollars ($ 51.00 ) . Quarterly reports shall be submitted by MORPC and shall be supported by documentation showing man-days worked, expenses incurred and percentage of task completed. . 7. CONDITIONS OF CONTRACT This contract is conditioned upon all of the following: {) A. Execution of an agreement to perform the project with the Board of Commissioners of Franklin County. B. Execution of a contract similar to this contract with the City of Columbus, Ohio. C. Execution of similar contracts with at least eight (B) of the other ten (10) cities in Franklin County, Ohio, and . -4- .... .. . . . . D. Appropriations of funds for the project by the governmental units mentioned in A, Band C for the first year cost of the project. C 8. CONTINGENCIES REGARDING COMPLETION Completion of the project and study is contingent upon the execution of contracts and appropriation of funds for the second year of the project by the Board of Commissioners of Franklin County, Ohio, the City of Columbus, and at least eight (8) of the other ten (10) cities in Franklin County, Ohio. . 9.' NONDISCRIMINATION -In connection with the performance of work under this contract, MORPC agrees not to discriminate against any employee or applicant for employment because of race, religion, color . or national origin. The aforesaid provision shall include but not be limited to the following employment: upgrading, demo- U ' tion or transfer, recruitment or recruitment advertising; lay- off or termination; rates of payor other forms of compensation; and selection for training including apprenticeship. MORPC agrees to post hereafter in conspicuous places, available for employees or applicants for employment, notices to be provided by the con- tracting officer setting forth the provisions of this nondiscrim- ination clause. MORPC further agrees to insert the foregoing provisions in all contracts hereunder, including contracts or agreements with labor unions and/or workers' representatives, -5- ..... ~'- , . . .- except subcontracts for standard commercial supplies or raw materials.
