A RESOLUTION DIRECfING nrn VILLAGE SOLICITOR
10 PROCEED WIlli 1HE CCMPLAINf FOR AN INJUNCTION
AGAINST cn.tPLETE GENERAL CONSTRUctION COMPANY
I WHEREAS, the Cotulcil of the Village of Dublin, at its regularly scheduled
June,3, 1974 meeting, resolved to deny Complete General Construction Company
the use of Sununi t View Road in said Village as a haul road because the said
use~~.trimental to the health, safety and welfare of the Citizens and
residents of the Village of Dublin, would constitute a nuisance, and the pro-
posed use by Complete General Construction Company's of its ISO! acre tract of
land adjacent to and north of said Summit View Road asa ''borrow pit" would
violate said Village's zoning ordinances; and
WHEREAS, said Complete General Construction Company disregarded and ignorec
said resolution -and began using, and continues to use said Summit View Road as
aforesaid; and
WHEREAS, the Village SOlicitor, in order to protect and preserve the healtl ,
I safety, and welfare of the citizens of the Vill~; in order to stop an existing
and threatened nuisance; and, in order to enforce'::the zoning ordinances of the
Village, on the 12th day of Jtule, 1974 filed a Complaint with the Court of
Conmon Pleas of Franklin County, Ohio demanding a temporary restraining order,
a temporary injtulction and a pennanent injtulction against said Complete General
Construction Company;
~W TIffiREFORE, be it resolved by the Cotulcil of the Village of Dublin,
Ohio ~ of the members elected thereto concurring:
SECTION 1.

That Donald A. Richardson, the Village Solicitor, be, and he is hereby

authorized and directed to proceed with said Complaint and suit against Complet
General Construction Company and, further that any and all officers, employees,
I and consultants of the Village be, and they are hereby authorized to aid the
Solicitor in his preparation for said suit and to testify as witnesses in said
..- smt.
SECTION Z.
That this resolution be, and the same hereby is, declared to be an emer-
gency measure necessary for the innnediate preservation of the public , peace,

health, welfare and safety for the reason that a hearing on said CODqJlaint has
been set, by the Court, for Jtm.e 21, 1974, and the actions of eo~lete General I
Construction Co~any is detrimental to the peace, health, welfa.t:e and safety
of the residents of the Village of Dublin, and that this Resolution shall take
effect and be in force inunediately upon its passage.
