OHNI t ........ ~ 's fee ~,,'. ~ecotdet , , KNOW ALL MEN BY THESE PRESENTS, That Planned Commun1t1es, Inc. of the City of Columbus, County of Franklin, and State of ~ Ohio, in consideration of the sum of One Dollar ($1000).; the ~ right, upon approval by the City of Columbus, to tap the sewer to be constructed within the right of way granted herein, provided, however, that Grantor hereby agrees to pay all of the cost of oversizing such sewer so that it may service Grantor's property, 4It it being understood that as presently planned such sewer has no excess capacity to service Grantor's property; and other valuable consideration to them paid by the Village of Dublin, 4t the receipt of which is hereby acknowledged, does grant and release to the Village of Dublin, its successors and assigns forever, a right of way over and through the f9llqwing real estate in said City, and described as follows: 'Situated in the City of Columbus, Franklin County, Ohio, a part of Quarter Township 3, Township 2, Range 19, U. S. t Military Lands, also being a 1.55.202 acre tract as conveyed to Planned Communities, Inc. by Deed Book 3233, Page 320, Franklin County, Ohio, Recorder's Office, and said permanent easement, 10 feet in width and temporary easement 40 feet in width, being more particularly bounded and described on the attached Exhibit "A". for the purpose of constructing, using and maintaining a sanitary 4t force main, tributary connections and appurtenant works in any part of said strip, including the right to clean, repair and care for said main, together with the right of aCcess to said strip for 4It said purpose. TO HAVE AND TO HOLD said premises to said grantee, its successors and assigns forever, for the uses and purposes hereinbefore mentioned, provided, however, that if construction of said sewer has not been ,. co.m pleted through.grantor,s above-described premises by the time of completion of the east branch of the Scioto subtrunk sewer from Case Road to Martin Road or five years from the date hereof, whichever is sooner, then such easement shall be forfeited and revert to the grantor, its successors and assigns, which shall again have repossess e and enjoy said property as if this grant had not been made and thereupon this grant shall be void.
