AN ORDINANCE AUTHORIZING THE CITY MANAGER TO
EXECUTE NECESSARY CONVEYANCE DOCUMENTATION TO
ACCEPT THE DEDICATION OF A 0.035 ACRES, MORE OR LESS,
MULTI -USE PATH, DRAINAGE AND GRADING EASEMENT,
AND A 0.040 ACRES, MORE OR LESS, TEMPORARY
CONSTRUCTION AND GRADING EASEMENT FROM LEX
INVESTMENTS, AND DECLARING AN EMERGENCY.
WHEREAS, the City of Dublin ( "City') is preparing to construct a bike path along
Martin Road from Martin Commons Park to the existing bike path located on
Stoneridge Lane ( "Project'); and
WHEREAS, said project requires that the City obtain certain property interests in
Franklin County Parcel No. 273 - 009149, owned by Lex Investments; and
WHEREAS, Lex Investments is willing to dedicate the property interests in Franklin
County Parcel No. 273- 009149 to the City as set forth in the legal descriptions
attached hereto, and the City is willing to accept said dedication.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, —7— of the elected members concurring that:
Section 1. The City Manager is hereby authorized to execute all documentation
necessary to accept the dedication of an approximate 0.035 acres, more or less,
permanent multi -use path, drainage and grading easement, and a 0.040 acres, more or
less, temporary construction and grading easement from Lex Investments, as set forth
in the legal descriptions attached herewith.
Section 2 . This ordinance is hereby declared to be an emergency necessary for the
immediate preservation of the public health, safety and welfare. The acquisition of the
property interests described herein is necessary to conduct multi -use path construction to
help alleviate traffic congestion and improve pedestrian and vehicular safety.

Bike Path Connection— 2011 Street Maintenance Program, Phase 2
PROJECT BACKGROUND:
The City of Dublin ( "City ") is preparing to construct a bike path from Martin Commons Park to
the existing bike path located on Stoneridge Lane ( "Project'). The City must acquire certain
property interests from the adjacent landowners, Lex Investments in order to construct this
project. After engaging in amicable negotiations, Lex Investments has agreed to dedicate the
necessary property interests to the City.
DONATION INTRODUCTION:
Lex Investments is dedicating to Dublin the following property interests located within Franklin
County Parcel No. 273 - 009149, as visually depicted in the attached map:

ACTION TO BE AUTHORIZED BY ORDINANCE:
Ordinance No. 41 -12 would allow the City Manager to execute all necessary conveyance
documentation to formally accept the dedication of the aforementioned property interests.
RECOMMENDATION:
Staff recommends Council dispense with the public hearing and approve Ordinance No. 41 -12
by emergency at the June 4, 2012 Council meeting, as obtaining the property interests described
herein is necessary for the furtherance of the construction of the bike path connection between
Stoneridge Lane and Martin Commons Park.

PERMANENT EASEMENT FOR MULTI -USE PATH, DRAINAGE AND GRADING
0.035 ACRE
Situate in the State of Ohio, County of Franklin, City of Dublin, lying in Quarter Township 3,
Township 2, Range 19, United States Military Lands, being on, over and across Reserve A of that
subdivision entitled "Jail Investments Properties ", of record in Plat Book 80, Pages 1 and 2, as conveyed
to Lex Investments by deed of record in Instrument Number 200211150291585, (all references refer to
the records of the Recorder's Office, Franklin County, Ohio) being more particularly described as
follows:
BEGINNING in the southerly right -of -way line of Stoneridge Lane, at the terminus of the
southerly right -of -way line of Stoneridge Lane, of record in Plat Book 80, Pages 1 and 2, and at the
southerly corner of that tract conveyed to Village of Dublin, Ohio by deed of record in Official Record
12956D02, being the common corner of said Reserve A and that tract conveyed to Stoneridge Medical
Office Center LLC by deed of record in Instrument Number 200705250091460;
Thence with the southerly right -of -way line of said Stoneridge Lane, of record in Plat Book 80,
Pages 1 and 2, the following courses and distances:
South 39° 58' 55" East, a distance of 44.69 feet to a point of curvature; and
With said curve to the left, having a central angle of 47° 48' 24 ", a radius of 255.00 feet, an are
length of 212.77 feet and a chord bearing and distance of South 63 53' 06" East, 206.65 feet to a point in
the northerly line of Lot 3 of that subdivision entitled "Martin Commons Public Easement and Right of
Way Dedication and Vacation Plat for Sanitary Sewer, Bikeway and Sidewalk ", of record in Plat Book
87, Pages 27 and 28, as conveyed to Italia Homes, Inc. by deed of record in Official Record 33328E15;
Thence North 87° 47' 17" West, with the line common to said Reserve A and said Lot 3, a
distance of 60.17 feet to a point on the arc of a curve;
Thence across said Reserve A, with said curve to the right, having a central angle of 34° 31' 47 ",
