A RESOLUTION APPROVING THE REPORT OF THE
ASSESSMENT EQUALIZATION BOARD ON OBJEC-
0 TIONS CONCERNING THE ESTIMATED ASSESSMENTS
FOR "WATER TRANSMISSION MAIN IMPROVEMENTS"
"RESIDENTIAL SERVICES IN OLD DUBLIN".
WHEREAS, the Assessment Equalization Board heretofore appointed
by Resolution No: 12-78 passes May I, 1978, to hear and determine
all objections concerning the estimated Assessments for construc-
tions in the Village of Dublin, of the aforesaid "Water Trans-
mission Improvements? as fully described in Resolution No:02-78
passed February 20, 1978 declaring the necessity of constructing
said Water Transmission Improvements, has filed its report
(attached) with this Council as to its determination of such ob-
ject i ons: and
WHEREAS, Council deems such report proper in all respects, NOW,
THEREFORE, BE IT RESOLVED, by the Council of the Village of Dubli ,
State of Ohio~ of the elected members concurring:
SECTION I. The report of the Assessment Equalization Board here-
inbefore recited be, and the same is hereby approved, and the
[J assessments as equalized by said Board, and reported byit be, and
the )' hereby are, directed to be filed in the office of the Vill-
age Clerk of the Council.
SECTION 2. That this Resolution shall take effect and be in forc

We net at 7:30 p.m., Thursday, May II, 1978 to hear the objections of
the 17 landowners who had registered their objection by letter to the
r"J village.
~ We were instJ::ucted by village solicitor Richardson that we were errpcwered
to rec:x:mrend that assessments be increased, left nnchanged, or decreased.
We were also instructed by village engineer William Myers and his assoc-
iate Bruce Dresbach as to the basis for arriving at the anonnts of the
assessrrents.
It is our recamendation to the conncil that none of the assessments we
reviewed be changed. We also recannend that conncil address itself to
certain matters which cane to light during the hearings which we have de-
scribed belOW'.
Eight of the objecting property owners held land located on Iavid Road.
These residents shared two UllllUIl carplaints:
I) The $l they were paid for the easement to constJ::uct the
water line across their prqperty was not fair, <::XI"Cpared. to
the $300 payment made for the easerrent to recently canstJ::uct
the sewer lines across the properties on the other side of
David Road.
2) A drainage ditch along one side of Iavid Road was pranised
as part of either the sewer construction project or serre
other recent project. That ditch has not been carpleted
0 to the north end of David Road and is not available to al-
leviate flooding conditions in the yards toward the north
end of Iavid Road.
Other objections were raised by the landowners which the board duly con-
sidered. Specifically, they were:
I) Extension of the water main into land which has no antici-
pated use for service.
2) No need for public water service, well service is adequate.
3) The cost is disproportionate to the land use because of the
land I s topography.
4) The dollar anonnt of the assessment is disproportionate to
the value of the use of the land, because of its quan:y or
religious status.
5) The land owner is unable to pay the assessrrent.

The village engineer was helpful to US, explaining these aspects as they
are to be considered in arriving at the arrount of the assessment, in accord-
ance with provisions of the Ohio Revised Code. HOW'ever, the Board was un-
able to agree that any change in the assessment should be recxmrended.
We appreciate the cooperation of the several residents who appeared before
the Board and conducted themselves in a business like fashion. We are
happy to have had this opportunity to serve them and the village in this
" matter and stand ready to discuss our recamendations, at their convenience.
