RESOLUTION NO.
DECLARING THE NECESSITY OF IMPROVING CERTAIN
STREETS IN THE VILLAGE OF DUBLIN BY THE
CONSTRUCTION OF WATER LINES AND APPURTENANCES
AND DECLARING AN EMERGENCY
U BE IT RESOLVED by the Council of the Village of Dublin, Counties of
Franklin and Delaware, State of Ohio, three-fourths of all members elected
thereto concurring:
Section l. That it is necessary to construct water lines, services,
fire hydrants, and appurtenances in certain streets in the Village of Dublin
as follows:
Construct a 16 inch water line on High Street from the intersection
of Grandview Drive, north to a point approximately 225 feet north
of the intersection of High Street and North Street;
Construct an 8 inch water line on Grandview Drive from the intersection
of High Street, west approximately 1,410 feet to the end of Grandview
Drive;
Construct an 8 inch water line on Longview Drive from the intersection
of High Street, west approximately 1,500 feet to the end of Longview
Drive;
Construct an 8 inch water line on Marion Street from the intersection
of High Street, west approximately 1,625 feet to the end of Marion Street;
Construct an 8 inch water line on Franklin Street from the intersection
of Marion Street, north approximately 470 feet to the end of Franklin
C' Street;
Construct an 8 inch water line on Franklin Street from the intersection
of Bridge Street, south approximately 1,400 feet to the end of Franklin
Street;
Construct an 8 inch water line on Short Street from the intersection
of High Street, east approximately 400 feet to the intersection of
Riverview Street;
Construct an 8 inch water line on Riverview Street from the intersection
of Short Street, north approximately 2,250 feet to the intersection of
North Street;
Construct an 8 inch water line on NO,rth Street from the intersection of
Riverview Street, west approximately 530 feet to the west end of North
Street;

Construct an 8 inch water line on David Road from the intersection of
State Route 161, north approximately 1,125 feet to the end of David
Road;
Construct an 8 inch water line on Martin Road from the intersection
of State Route 33, east approximately 4,600 feet to the intersection
of Sawmill Road;
Construct a 6 inch water line on Martin Place from the intersection of
(1 Martin Road, north approximately 340 feet, thence continuing north with
a 3 inch water line approximately 110 feet to the end of Martin Place;
Construct an 8 inch water line on Braxmar Place from the intersection of
Martin Road, north approximately 360 feet to the intersection of
Lilly-Mar Court;
Construct an 8 inch water line on Lilly-Mar Court from the intersection
of Braxmar Place, west approximately 175 feet to a point, thence continu-
ing west with a 6 inch water line approximately 295 feet to a point, thence
continuing west with a 3 inch water line approximately 210 feet to the
end of Lilly-Mar Court;
Construct an 8 inch water line on Lilly-Mar Court from the intersection
of Braxmar Place, east approximately 175 feet to a point, thence continu-
ing east with a 6 inch water line approximately 310 feet to a point, thence
continuing east with a 3 inch water line approximately 235 feet to the
end of Lilly-Mar Court;
as shown on the plans hereinafter referred to, prepared by Burgess & Niple,
Limited, Consulting Engineers. It is hereby determined by this Council that
the aforesaid streets to be improved as herein provided are so situated in
relation to each other that in order to complete the improvement thereof in
the most practical and economical manner, they should be improved at the same
time, with the same kind of materials and in the same manner.
D Section 2. That the grade of said water improvements shall be the grade
as shown by the engineer's plans and profiles which are made a part hereof.
Section 3. That the plans, specifications, estimates, and profiles of the
proposed improvements, heretofore prepared by the engineer, and now on file in
the office of the clerk are hereby approved.
Section 4. That the entire cost of said improvement less one-fiftieth of
said entire cost, the cost of intersections, plus the cost of oversizing water
lines over 8 inch in diameter which shall be paid by the Village of Du\tin,
shall be assessed in proportion to the benefits upon all lots and lands bounding
and abutting upon the proposed improvement between and including the termini of
said improvement. The cost of said improvement shall include the cost of pre-
liminary and other surveys, plans, specifications, profiles, and estimates, and
of printing, serving and publishing notices, resolutions and ordinances, the
amount of damages resulting from the improvement assessed in favor of any owner
of land affected by the improvement and the interest thereon, the costs incurred

in connection with the preparation, levy, and collection of the special
assessments, the cost of purchasing, appropriating less 50 percent, and
otherwise acquiring therefor any required real estate or interests therein,
expenses of legal services including obtaining an approving legal opinion,
cost of labor, and material, and interest on bonds and notes issued in anti-
cipation of the levy and collection of the special assessments together with
all other necessary expenditures.
Section 5. That the consulting engineer be and it is hereby authorized
and directed to prepare and file in the office of the clerk the estimated
U assessments of the cost of the improvement described in this resolution. Such
estimated assessments shall be based upon the estimate of cost of said improve-
ment now on file in the office of the clerk and shall be prepared pursuant to
the provision of this resoltuion. When such estimated assessments have been
so filed, said clerk shall cause notice of the adoption of this resolution
and the filing of said estimated assessments to be served on the owners of all
lots and lands to be assessed as provided in RC ~727.13.
Section 6. That the assessments to be levied shall be paid in 20 annual
installments, with interest on deferred payments at the same rate as shall be
borne by the bonds to be issued in anticipation of the collection thereof;
provided that the owner of any property assessed may, at his option, pay such
assessment in cash within thirty days after passage of the assessing ordinance.
Section 7. That bonds of the Village shall be issued in anticipation of
the collection of assessments by installments and in an amount equal thereto
and notes of said Village shall be issued in anticipation of the issuance of
such bonds and the levy of such assessments.
Section 8. This resolution is hereby declared to be an emergency measure
necessary for the immediate preservation of the public peace, health, and safety
of said Village, and for the further reason that the immediate construction of
said improvement is necessary to provide an adequate and potable water supply
in areas to be assessed and eliminate health hazards; wherefore, this resolution
shall be in full force and effect from and immediately after its passage.
