RESOLUTION NO.
Declaring the Necessity of Constructing Phase II
Municipal Sewage Collection System And
Declaring An Emergency
Be It Resolved by the Council of the Village of Dublin, County of
0 Franklin, State of Ohio:
Section 1. That it is necessary to construct a Municipal Sewage
Collection System Phase II by the construction of trunk sewers, sub trunk
sewers, local sewers and appurtenances in the public streets and rights-of-
way and easements as fully described on the attached "Exhibit A" which is
made a part hereof the same as if fully rewritten herein, as shown on the
plans hereinafter referred to, prepared by Burgess & Niple Limited, Con-
sulting Engineers.
Section 2. That the grade of said sewer line improvements shall
be the grade as shown by the Engineer's plans and profiles which are made
a part hereof.
Section 3. That the plans, specifications, estimates and profiles
of the proposed improvement, heretofore prepared by the Engineer and now on
file in the office of the clerk of this council, are hereby approved.
Section 4. That a portion of the cost of said improvement in the
amount of $3,000,000 shall be assessed in proportion to the benefits upon the
following described lots and lands to wit:
All lots and lands bounding and abuting upon the proposed improve-
ment between and including the termini of said improvement, and in addition
C thereto those lots and lands inside the village corporation line bounded by
SR 745 on the west, the Scioto River on the east, the Franklin County line on
the north, and North Street on the south, and including the River Forest Sub-
division.
The Village of Dublin shall pay the balance of the cost of said
improvement which shall include the cost of oversizing sewer lines where
necessary in order to serve areas within the Village not to be assessed here-
under for said improvement and which cost shall in no event be less than one
fiftieth of the whole cost together with the cost of intersections plus said
cost of oversizing sewer lines. The cost of said improvement shall include
the cost of preliminary and other surveys, plans, specifications, profiles
and estimates and of printing, serving and publishing notices, resolutions
and ordinances, the amount of damages resulting from the improvement assessed
in favor of any owner of land affected by the improvement and the interest
thereon, the cost incurred in connection with the preparation, levy and collec-
tion of the special assessments, the cost of purchasing, appropriating less

50% and otherwise acquiring therefor any required real estate or interests
therein, expenses of legal services including obtaining an approving legal
opinion, cost of labor and material and interest on bonds and notes issued
in anticipation of the levy and collection of the special assessments to-
gether with all other necessary expenditures.
Section 5. That the Consulting Engineer be and it is hereby author-
ized and directed to prepare and file in the office of the clerk the estimated
0 assessments of the cost of the improvement described in this resolution. Such
estimated assessments shall be based upon the estimate of cost of said improve-
ment now on file in the office of the clerk and shall be prepared pursuant to
the provision of this resolution. When such estimated assessments have been
so filed, said clerk shall cause notice of the adoption of this resolution and
the filing of said estimated assessments to be served on the owners of all lots
and lands to be assessed as provided in RC ~ 727.13.
Section 6. That the assessments to be levied shall be paid in 30
annual installments, with interest on deferred payments at the same rate as
shall be borne by the bonds to be issued in anticipation of the collection
thereof; provided, that the owner of any property assessed may, at his option,
pay such assessment in cash within thirty days after passage of the assessing
ordinance.
Section 7. That bonds of the Village shall be issued in anticipation
of the collection of assessments by installments and in an amount equal thereto
and notes of said Village shall be issued in anticipation of the issuance of
such bonds and the levy of such assessments.
Section 8. This resolution is hereby declared to be an emergency
measure necessary for the immediate preservation of the public peace, health
and safety of said Village, and for the further reason that the immediate con-
struction of said improvement is necessary to provide adequate sanitary sewerage
0 in areas to be asse~sed and eliminate health hazards; wherefore, this resolution
shall be in full force and effect from and immediately after its passage.
