That he design, construction, operation, maintenance, eventual dedication and all other matters arising as a result of the design and construction of said water line shall be carried out in full accordance with the provisions of Resolution 21-74, which section is by reference, hereby made a part of this agreement to the same extent as if rewritten herein in its entirety. -- ..... _ . <0' , .... ;.... , ,. Section 4. That the permission herein granted the Evergreen Company includes the right to construct such portion of the said water line as may extend under the paved part of any public street, alley or other public plac e or eas ement pursuant to the approved plans and specifications. ~ Section 5. That upon completion and approval of said waterline and upon final approval and acceptance of the same by The Village of Dublin, J Ohio, said waterline shall be dedicated to The Village of Dublin, Ohio, the Village shall be responsible for its perpetual maintenance, replace- ment and repair. Section 6. The right to tap said waterline and to withdraw water supplies from the same shall be in accordance with the rules, regulations, and ordinances of the Village of Dublin, Ohio governing such activity as may be in effect at the time application is made to connect to said waterline. Section 7. That Evergreen Company provide at its expense detailed "as ! built" drawings of the waterline for Village records. , , l il Section 8. That the Evergreen Company shall save the Village free and 1 I harmles. from any and all damages or claims for damages which may , i arise or grow out of the construction of said water line and shall defend at his own cost and expens e any and all suits for the recovery of damages arising or growing out of the construction of the water line I and which may be brought or prosecuted against the Village. Section 9. That this Resolution shall take effect and be in force from and t after the earliest period allowed by law.
