A RESOLUTION AUlliORIZING AND DIRECTING
1HE VILLAGE ADHINISTRATOR TO ENTER INTO
A CONTRACT WIlli THE TRAILS END WATER
() LINE ASSOCIATION.
BE IT RESOLVED by the Cotmcil of the Village of Dublin, Ohio "
of the elected members concurring, that:
SECTION 1. The Village Administrator be, and he is, hereby, authorized
and directed to execute and deliver, on behalf of the Village, a certain
contract with the Trails End Water Line Association, a copy of which is
attached hereto, marked "Exhibit A" and made a part hereto.
SECTION 2. This Resolution take effect and be in force at the earliest
period allowed by law.

WATER LINE AGREEME.NT
TIllS AGREEMENT made and entered into this 7-"" day of /)1 AA.C.., , 1977, by
and between the Village of Dublin, Ohio, acting by and through its Village Administrator,
Party of the First Part, hereinafter referred to as the Village, and Trails End Water
() Line Association, Party of the Second Part, hereinafter referred to as the Applicant,
WITNESSETH:
l~REAS, the Applicant has made application to the Village for permission to con-
struct a water line, hereinafter described as his own cost and expense, and
WHEREAS, Resolution No. 21-74 of the Village authorized this agreement and estab-
lishes the conditions tmder which water line may be constructed; now, therefore,
Permission is hereby granted to the Applicant to construct, at his own cost and
expense:

specifications and standards of construction for the construction of water lines cur-
e rently in force and in accordance with plans approved by the Village, dated 7)EC4!'M~~
J~ , 197' in consideration of which it is tmderstood and agreed:
a. That the design, construction, operation, maintenance, eventual
dedication and all other matters arising as a result of the
design and construction of said water line shall be carried out
in full accordance with the provisions of Resolution No. 21-74,
which section is by reference, hereby made a part of this agree-
ment to the same extent as if rewritten herein in its entirety.
b. That the permission herein granted the Applicant includes the
right to construct such portion of the said water line as may
extend tmder the paved part of any public street, alley or other
public place or easement pursuant to the approved plans and
specifications.
c. That the Applicant shall save the Village free and harmless from
any and all damages or claims for damages which may arise or
grow out of the construction of said water line and shall defend
at his own cost and expense any and all suits for the recovery
of damages arising or growing out of the construction of the water
line and which may be brought or prosecuted against the Village.
Provided however, applicant shall not be liable for damages arising
lJ solely as a result of following ,the Village's Standard Construction
Regulation
d. That the owner agrees to pay inspection costs for the proj ect as
set forth in the Dublin Subdivision Regulation.
e. That the owner/contractor provide the Village with a one year main-
tenance bond at the completion of the project.
f. That the owner agrees to pay all cost of chlorination and any other
cost associated with the project.

g. In the event that property owners or residents who are not presently
members of Trails End Water Line Association or successors in title
to present members of Trails End Water Line Association desire to tap
into the water line herein described; The Village of Dublin agrees to
charge them in addition to nonnal tap in fees a fee based on the
''benefi t of use fOI1TlUla" based on the cost of constructing a water
C line at the time the application is made.
The Village of Dublin agrees to pay the monies collected to Trails
End Water Line Association or their successors in title.
Present members of the Trails End Water Line Association or their suc-
cessors in title shall not be charged additional fees for any of the
initial cost of construction of the water line system. A list of the
present members of Trails End Water Line Association is attached here-
to and marked Exhibit "A".
IN WITNESS WHEREOF, the said parties have hereunto set their hands and have exe-
cuted this agreement) in duplicate, on the date and year first above written.

SUBJECT: RESOLUTION #21-74 TRAILS END DRIVE WATERLINE AGREEMENT
Resolution 21-74, Section "g", Paragraph 3 which refers to Exhibit
"A", I would like to have amended to include my name as a member
of the Trails End Dr. Waterline Assoc., as not only was my signa-
ture on the agreement between Owner and Contractor (p 8), but by
reason of my marriage I had an equal interest in this waterline.
Now that I am divorced, I would like to avoid any problems in the
[ collection of my rebate and as I may in the future sell the adjacent
lot, I would like my name to appear on record so it is clear that the
assessment on this lot is paid.
