Box 564 # I Dublin, Ohio 43017 . , DEED OF EASFMENT 1177 .~ ! ~ ~i , ,:"', KNOW ALL MEN BY llillSE PRESENTS, that Paul Varga and Sons, Incorporated, hereinafter called "Grantor," for and in consideration of One Dollar ($1. 00) , and other valuable considerations paid by the Village of Dublin, Ohio, a municipal corporation, the Grantee herein, receipt of which is hereby acknowl- edged, hereby grants with general warranty covenants to Grantee, its suc- D cessors and assigns forever, a pennanent easement in, through, over, and lInder the following described real estate for the purpose of constructing, operating, installing, maintaining, removing or replacing water lines and 'tributary cormections and appurtenant work in any part of said easement. '[he total width of the described easement may fall only. in part on the Grantor's property. The intended easement is that portion falling within the Grantor's property and all sidelines are extended to intersect the pro- perty 1 ines . . Said real estate IS situated in the State of Ohio, County of Franklin, Village of Dublin, beIng also part of the Virginia Military Lands' Survey No. 2544, and being a part'of a 1.035 acre tract and a 119.305 acre tract conveyed to Paul Varga and Sons, Incorporated by deed of record in Deed Book 1658, page 97, and Deed Book 1658, page 99 respectively, Recorder's Office, Franklin County, Ohio and being more particularly described as follows: Being a pennanent easement 10 feet in width and lying on the easterly side of the following described line: Begirming at a point on the easterly right-of-way line of the Dublin- Bellepoint Road (State Route 745), said point of begirming being 300 feet southerly of the point of intersection of the extended centerline of River Forest Road with said easterly right-of-way line; C thence northerly along the aforesaid easterly right-of-way line, a distance of 676 feet to the point of tennination, said point of tennination being the southerly end of an existing 12 inch water main, this easement containing 0.0367 acres, more or less, and being more particularly described as shown on attached plat marked "Exhibit A." Construction Easement Also, a construction easement for and ,during the period of construction only, 15 feet in width, abutting on the easterly side of the above pennanent easement and the easterly right-of-way line, and extending southerly from the southerly end of said pennanent easement 540 feet. " Excepting from this strip, an area encompassing the existing residence and 10 feet beyond the sides of said residence. Grantor, his heirs and assigns hereby release the Village of Dublin from any further claims for compensation or claims for damages, resulting from this grant or the construction of said proje~!. The rights granted herein shall not be construed to interfere with - or restrict the use of the premises with respect to the construction and maintenance of property improvements along and over the premises herein described so long as the same are so constructed as not to impair the strength or interfere with the use and maintenance of said utility, or ingress and egress to or over the easement area. This easement, however, shall not be construed as giving to Grantee any right of ingress and egress to or over the t'emainder of said premises owned by Grantor.
