It is, hereby, RESOLVED, by the Council of the Village of Dublin,
Ohio ~ of the elected members concurring, that:
i SECTION 1, The Village Administrator be, and he is hereby, authorized

, and directed to execute, on behalf of the Village of Dublin, Ohio, a

certain agreement (a copy of which is attached hereto and marked

r "Exhiblt A") conditionally accepting dedication of a portion of Frantz

Road within the eaid Village, the terms and conditions of said agreement
being more fully descWlrbed in said IIExhibit All; and
SECTION 2, This Resolution be, and it hereby is, declared to be an
, C....... emergency measure necessary for the preservation of the publ ic health,

i. safety and welfare of the said Village of Dubl in for the reason that
the grantor of the dedication must have the deed conveying the same
recorded prior to February 27, 1976, and, therefore, this Resolution
will take effect and be in force immediately upon its passage,

. . AGREEMENT TO DEDICATE REAL ESTATE

Village of Dublin, Ohio
RE: Dedication of 1.1309 acres to the Village
of Dublin by Midvo, Inc.
Gentlemen:
0 As you know, Midvo,. Inc. has been in negotiation with the Village
of Dublin concerning the dedication of the extension of Franz Road.
We have been in contact with your engineering consultants, Burgess &
Niple, and we are in agreement that the dedication will take place
as follows:
1. Midvo, Inc. hereby delivers to the Village of Dublin
a deed for that acreage to be dedicated. The acreage
and the plan for the street are described ona plat
which is attached to this letter. The deed delivered
herewi th is to be recorded by the Village'. of Dublin
immediately and not later than February 27, 1976, or
. the deed shall be returned to Midvo, Inc. on February
27, 1976. The recording of the deed shall not con-
stitute acceptance of dedication, but dedication shall
be accepted by the Village only when the improvements
. have been constructed and are accepted by the Village.
Throughout the period from the delivery of the said
deed, the area described in the deed shall be a public
thoroughfare and shall not be blocked or encumbered by
the Village.
2. The street is to be constructed by Midvo, Inc. as.soon
as possible after the delivery ofbhis document, but
U not later than one (1) year after the date hereof.
.3. Midvo, Inc. hereby delivers to the Village of Dublin
a developer's bond in the amount of $p-vp-nt-r
Thousand Dollars ($ 70 000.00 in order
to secure completion of the improvement. Midvo, Inc.
estimates the cost of the improvement to be no more
than Thirty-five Thousand Dollars
($ 35,000.00 ~~ therefore~ this bond should'provide
adequate secur~ty to the V1llage.
4. Midvo, Inc. agrees to submit to your Village engineer
on' or before April 30th, working drawings for the
construction of a 32 foot wide road within the area .
being conveyed to the Village. The specifications for
such working drawings shall be according to your sub-
division regulations and the specifications and working
drawings shall be subject to the final reasonable
approval of your engineer. The designation of the
street classification shall be "local". There shall be
no on-street parking within the roadway to be constructed
by Midvo, Inc.

If the Village of Dublin is in agreement with the intentions of
D Midvo, Inc. as set forth in this Agreement, the Village should execute
a copy of this Agreement so that Midvo, Inc. and the Village of Dublin
shall have a clear understanding of the procedure and their mutual
promises.

Dear Mr. Smith:
As you requested, we have prepared a preliminary cost
(for budget purposes only) to improve approximately 750 lineal
feet of your entrance drive to present Village street standards.
This improvement will consist of constructing curbs and gutters,
pavement widening and resurfacing, storm sewers and extending
the Indian Run culvert crossing, if necessary.
The work must be performed in accordance with Village
regulations and specifications and as will be shown on an
approved set of construction drawings yet to be designed.
A budget figure for this work is approximately $35,000.
It should be noted that this is a budget figure and is subject
to revision. A more accurate and detailed cost estimate is not
U possible until completion of the construction drawings. If you
