HomeMy WebLinkAbout58-08 OrdinanceRECORD OF ORDINANCES Orclirurrrce No. sg-os Pcr.rsect ~0 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT TO PURCHASE A .033 ACRES, MORE OR LESS, FEE SIMPLE INTEREST, AND A .061 ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION EASEMENT FROM ROBERT G. AND JANE M. EICKHOLT, SAID ACREAGE LOCATED ON SAWMILL ROAD, JUST SOUTH OF THE INTERSECTION OF SAWMILL AND HARD ROADS, AND DECLARING AN EMERGENCY. WHEREAS, the City of Dublin is preparing to improve the intersection of Sawmill and Hard Roads; and WHEREAS, said improvement will require the City of Dublin to obtain a fee simple interest and temporary construction easement in and to the premises described in the attached Exhibit "A", Exhibit "B", and Exhibit "C" located in the City of Columbus, Franklin County, State of Ohio; and WHEREAS, the City desires to enter into a real estate purchase contract for the 0.033 acres, more or less, fee simple interest, and an easement agreement for the 0.061 acres, more or less, temporary construction easement in and to the premises located in the City of Columbus, County of Franklin, State of Ohio for the Sawmill and Hard Road intersection improvement project for thirty thousand two hundred and forty dollars ($30,240.00). NOW, THERE ORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute a real estate purchase contract and any necessary closing documents related to the acquisition of the 0.033 acres, more or less, fee simple interest, and a .061 acres, more or less, temporary construction easement and paying any related costs. Section 2. This ordinance is hereby declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare. The reason for such necessity is that the prompt improvement of the intersection of Sawmill Road and Hard Road is necessary to improve traffic circulation and relieve traffic congestion for the citizens of Dublin. Therefore, this ordinance shall go into immediate effect. Passed this ~ day of , 2008. Hartmann, Assistant Law Director DATE: August 14, 2008 RE: Ordinance 58-08 Land Purchase -Eickholt Property Sawmill/Hard Road Improvements PROJECT BACKGROUND: The City of Dublin ("Dublin") has been planning on making improvements to the intersection of Sawmill Road and Hard Road. The City is planning on adding new lanes, and all four corners of the intersection will be reconstructed to provide for these new lanes. ACQUISITION INTRODUCTION: This memorandum discusses the Eickholt property acquisition. The Eickholt property consists of a .033 Acres, more or less, fee simple interest, and a .061 acres, more or less, combined temporary construction easement from Robert G. and Jane M. Eickholt, said acreage located on Sawmill Road, just south of the intersection of Sawmill and Hard Roads. ACTION TAKEN IN THIS CASE: In December, 2007, notices of intent to appropriate were sent to those landowners that would be affected by this project. Appraisals were performed on these parcels by Ohio Real Estate Consultants, Inc., and ME Companies (Mr. James Howard) was engaged to negotiate the purchase of the subject properties. The project, however, was placed on hold by the City and as a result, negotiations between City and landowners did not truly progress. However, one landowner, the Eickholts (Robert G. and Jane M.), determined that they would agree to sell their land to City for the appraised amount of thirty thousand two hundred forty dollars ($30,240.00). City desires to purchase the Eickholt's land for this appraised value. Resolution 61-08 would allow the City Manager to execute a real estate purchase contract for City's purchase of the Eickholt property.
