D BE IT RESOLVED by the Council of the Village of Dublin, State of Ohio, 1 of the elected members concurring: SECTION 1. That the certain easements for Waterlines from Victor D. Irelan, Robert M. Dodge and Ralph A_ Hewitt, Trustees, said easement deporiptions and plats marked Exhibit "A" and Exhibit "B" being hereto attached as a part of this Resolution, are hereby approved and accepted_ SECTION 2. EASEr~ENT FOR VALUABLE CONSIDERATION, the receipt of which is hereby acknow- ledged, the GRANTORS, VICTOR D, IRELAN, ROBERT M, DODGE and RALPH A. HEWITT, TRUSTEES, hereby grant unto THE VILLAGE OF DUBLIN, GRANTEE, all of the Grantors' rights, title and interest in and to certain easements for the (:: construction, recondition, repair, replacement, removal, operation and main- , tenance of a water line over, under and through the real property described be 10\'1, as said Easements were gi ven to Grantors by Easements from The Pruden- tial Insurance Company of America, recorded in Deed Book 3750, Pages 553 through 558, inclusive, Franklin County Recorder's Office, copies of which are attached hereto and incorporated herein, marked Exhibits I (1-6); Said real property being situated in the State of Ohio, County of Franklin and Village of Dublin as described in said Easements, The Grantors' reserve the rights granted to them in the aforesaid Easements and this Grant of Easement is intended to convey the same rights to the Village of Dublin; provided however, that as to any construction or other work done by Grantors' herein, said Grantors', Victor D. Irelan, ~. Robert M. Dodge and Ralph A, Hewitt, Trustees shall restore the surface of \..f the land to the same condition as it existed prior to the commencement of such work, including the re-grading and re-landscaping as may be required; and said Trustees-Grantors shall remain liable to pay The Prudential Insurance ! Company of America for any loss to its property resulting from the exercise I of the rights granted in such Easement other than the loss of the use of the 'I strip of land; and provided further, that the Village of Dublin by acceptance of this Easement agrees that it shall be liable to The Prudential Insurance I Company of America to the same extent as the Trustees-Grantors herei n, for the acts of the Village of Dublin, its agents, successors and assigns, IN WITNESS WHEREOF, Victor D.
