Form No. 3004+ Ordiizance No. 34-08 Passed 20 AN ORDINANCE AUTHORIZING THE PURCHASE OF A 0.249 ACRES, MORE OR LESS, FEE SIMPLE INTEREST, WITH THE PRESENT ROAD OCCUPYING 0.198 ACRES, MORE OR LESS, A 0.096 ACRES, MORE OR LESS, STANDARD HIGHWAY EASEMENT, AND A 0.043 ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION EASEMENT FROM JOHN L. VICKERS, LOCATED WEST OF INDUSTRIAL PARKWAY AND NORTH OF STATE ROUTE 161, TOWNSHIP OF JEROME, COUNTY OF UNION, STATE OF OHIO, AND DECLARING AN EMERGENCY. WHEREAS, the City of Dublin is preparing to improve the U.S. Highway 33 and State Route 161 Interchange in Franklin and Union Counties; and WHEREAS, said improvement will require the City of Dublin to obtain a fee simple interest, standard highway easement, and temporary construction easement in and to the premises described in the attached Exhibit "A", Exhibit "B", and Exhibit "C" located in the Township of Jerome, Union County, Ohio. WHEREAS, the City desires to enter into a real estate purchase agreement for the 0.249 acres, more or less, fee simple interest, an easement agreement for the 0.096 acres, more or less, standard highway easement, and an easement agreement for the 0.043 acres, more or less, temporary construction easement in and to the premises located in Union County, Jerome Township, Ohio for the U.S. Highway 33 and State Route 161 Road Improvement for Eighty Five Thousand Three Hundred Sixty Nine Dollars and No Cents ($85,369.00). NOW, THEREFORE, BE IT ORDAINED by the Council, of the City of Dublin, State of Ohio, ~ of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute a Real Estate Purchase Contract and any necessary closing documents related to the acquisition of the 0.249 acres, more or less, fee simple interest, the 0.096 acres, more or less, standard highway easement and the 0.043 acres, more or less, temporary construction easement and paying any related costs. Section 2. This ordinance is hereby declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare. The reason for such necessity is that the prompt improvement of U.S. Highway 33 and State Route 161 Interchange in Franklin and Union Counties is necessary to improve traffic circulation and relieve traffic congestion for the citizens of Dublin. Therefore, this ordinance shall go into immediate effect. Vickers Property U.S. Highway 33 and State Route 161 Interchange Improvement Project PROJECT BACKGROUND: The City of Dublin and the Ohio Department of Transportation (ODOT) are working together to make improvements to the US 33/SR 161/Post Road interchange. The current "tight diamond" configuration will be changed to a "Pardo A" configuration. This means that loop ramps are introduced to eliminate the need for left turns from the arterial road (ie SR 161/Post Road) onto the freeway (US 33). This project requires the acquisition of either a "partial take" (the purchase of a portion of the parcel for right-of--way) or a "total take" (the purchase of the entire parcel) from multiple property owners along this interchange. ACQUISITION INTRODUCTION: This memorandum discusses the John L. Vickers acquisition - a 0.249 acres, more or less, fee simple interest with the present road occupying 0.198 acres, more or less, a 0.096 acres, more or less, standard highway easement, and a 0.043 acres, more or less, temporary construction easement in and to the premises located in the Jerome Township, Union County, west of Industrial Parkway and North of State Route 161. "Present road occupied" basically means that this property only contains an area in which the property owner (John L. Vickers) holds the underlying fee, but the land is currently encumbered by an existing highway easement. ACTION TAKEN IN THIS CASE: Since the year 2006, the Law Department has been in contact with the landowner to inform him of the upcoming construction and effect of the interchange improvement to his property. A title search was conducted and the appraisal for this property is complete. The appraiser has determined the fair market value of the take to be $85,369.00. Additionally, the Law Department engaged M/E Company (Mr. James Howard) to negotiate the acquisition with the landowner. Mr. Howard has presented the offer of compensation to Mr. Vickers. Mr. Vickers has accepted this offer. The Law Department has prepared this ordinance authorizing the City Manager to enter into a Real Estate Purchase Contract with the landowner. Therefore, litigation will not commence in regards to this property. RECOMMENDATION: The Law Department recommends a motion to dispense with the public hearing and approve this as emergency legislation on June 2, 2008.
