Form No.300~3 21-08 Ordinance No. Passed 20 AUTHORIZING THE GRANTING OF A 0.105 ACRES, MORE OR LESS, NON-EXCLUSIVE EASEMENT TO COLUMBIA GAS OF OHIO, INC. FOR RELOCATION OF REGULATOR STATION TO THE WEST SIDE OF LIGGETT ROAD, CITY OF DUBLIN, COUNTY OF UNION, STATE OF OHIO. WHEREAS, the City of Dublin ("City") is preparing to improve the U.S. Highway 33 and State Route 161 Interchange in Franklin and Union Counties; and WHEREAS, due to said improvement, Columbia Gas of Ohio, Inc. ("Columbia") will need to relocate a regulator substation currently located at the northeast corners of Post and Hyland-Croy Roads to City-owned property located on the west side of Liggett Road as described in Exhibit "A" attached; and WHEREAS, the City intends to transfer the portion of City owned property by deed of an easement to Columbia as detailed in the attached Exhibit "A"; and WHEREAS, Council finds it is in best interest of the City to grant the easement to Columbia for the relocation of the regulator substation. NOW, THEREFORE, BE IT ORDAINED by the Council, of the City of Dublin, State of Ohio, ~ of the elected members concurring that: Section 1. Council authorizes the City Manager to execute the deed of easement as detailed in the attached as "Exhibit A". Section 2. This Ordinance shall take effect and be in force from and after the earliest date permitted by law. Bell DATE: April 17, 2008 RE: Ordinance 21-08 -Columbia Gas Easement for Relocation of a Regulator Station PROJECT BACKGROUND The City of Dublin ("City") is preparing to improve the U.S. Highway 33 and State Route 161 Interchange in Franklin and Union Counties. Due to said improvement, Columbia Gas of Ohio, Inc. ("Columbia") will need to relocate a regulator substation currently located at the northeast corners of Post and Hyland-Croy Roads to City-owned property located on the west side of Liggett Road (Parcel Number 39-0001009.00). The City desires to grant an easement to Columbia in order for Columbia to relocate the regulator station. Columbia has been contacted and they are prepared to commence with the relocation upon execution of the easement. PROPOSED LEGISLATION: The City intends to transfer an easement in 0.105 acres, more or less, of City-owned property to Columbia. Columbia will be installing pipelines, regulating, measuring, heating and other equipment of similar nature within the easement area that Columbia may use in connection with transporting and distributing gas and/or any other similar substance. A drawing of the proposed easement and the proposed deed of easement are attached hereto for your reference. The City has been in contact with Cohrmbia to discuss the necessary deed of easement. In order to proceed with the granting of the easement, the Law Department has prepared Ordinance 21-08 providing the authorization for the execution of the easement and will facilitate the execution and recordation of the deed of easement.
