~ A RESOLUTION TO ACCEPT EASEMENTS AND APPROVE THE
TERMS OF AGREEMENT OF SAME FOR CONSTRUCTION OF A
SANITARY SEWER.
WHEREAS, the Village of Dublin, per Resolution No. 29-81 has entered into an
agreement with Adria Laboratories, Inc., for the construction of a Sanitary
Sewer line, and;
WHEREAS, the Village has agreed to obtain the necessary Easements per said
Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Dublin, State
of Ohio, 7 of the elected members concurring:
SECTION 1. That the attached Agreements for granting of Easements, Exhibits
"A", "B", and "C", and the conditions thereof, for construction of a Sanitary
Sewerline are hereby approved and accepted.
SECTION 2. That this Resolution shall take effect and be in force immediately
upon its passage.

AGREEMENT IN CONSIDERATION
OF GRANTING AN EASEMENT
BETWEEN SOPHIA E. LIGGETT AND
C THE VILLAGE OF DUBLIN, OHIO

The parties hereto agree that in consideration of the granting of an
easement by Grantor to the Village of Dublin, the Village of Dublin will;
l. Repair and restore to as near the same condition as possible all
existing drain tile broken or damaged during construction.
2. Insure and/or guarantee and/or indemnify the owner against damage
to the existing well or water supply system caused by and during construc-
tion, and to repair or replace the same if necessary.
3. Preserve the topsoil removed during construction and to spread
the same over the area disturbed by construction to a minimum depth of
U eight (8") inches.
4. Restore the fences along the north and east property lines to
their original or better condition as existed before construction.
5. Reimburse owner for the fair market value of any crops destroyed
during construction. \
6. Pay as additional consideration to owner the sum of three tHou-
sand ($3,000.00) Dollars.
7. Waive the sewer capacity charge for one six (6") inch service
tap for the existing residence.

DEED OF EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that SOPHIA E. LIGGETT
hereinafter called "Grantor," for and in consideration of One Dollar ($1.00),
and other valuable considerations paid by the Village of Dublin, Ohio, a muni-
C cipal corporation, the Grantee herein, receipt of which is hereby acknowledged,
hereby grants with general warranty covenants to Grantee, its successors and
assigns forever, a permanent easement in, through, over, and under the follow-
ing described real estate for the purpose of constructing, operating, install-
ing, maintaining, removing or replacing sanitary sewer lines and tributary
connections and appurtenant work in any part of said easement.
The total width of the described easement may fall only in part
on the Grantor's property. The intended easement is that portion falling
within the Grantor's property and all sidelines are extended to intersect
the property lines.
Said real estate is situated in the State of Ohio, County of
Franklin, Township of Washington, and being more particularly described as
follows:
Said easements being a twenty foot (20') wide permanent easement,
and a One-hundred foot (100') wide temporary construction easement, bounded
and described as follows:

Grantor, his heirs and assigns, release the Village of Dublin
from any further claims for compensation or claims for damages resulting
U from this grant or the construction of said project, except that contrac-
tors for the Village of Dublin shall not be released from liability for
damage caused by their negligence.
The Village of Dublin, as soon as practicable after construction
of said utility and all subsequent alterations and repairs thereto, shall
cause all affected property of Grantor to be restored to the proper level.
The rights granted herein shall not be construed to interfere
with or restrict the use of the premises with respect to the construction
and maintenance of property improvements along and over the premises herein
described so long as the same are so constructed as not to impair the
strength or interfere with the use and maintenance of said utility, or
ingress and egress to or over the easement area. This easement, however,
shall not be construed as giving to Grantee any right of ingress and
egress to or over the remainder of said premises owned by Grantor.

hereby release their respective rights of dower have hereunto set their

The parties hereto agree that in consideration of the granting of an
easement by Grantor to the Village of Dublin, the Village of Dublin will:
1. Repair and restore to as near the same condition as possible all
existing drain tile which is broken or damaged during construction.
2. Guarantee against damage to the existing well and water supply
system and to repair or replace same, if necessary, if caused by and during
construction.
3. Preserve topsoil removed during construction and respread the same
over the area disturbed by construction to a minimum depth of four (4~')
inches.
0 4. Restore all fencing to its original or better condition as existed
before construction.
5. Pay owner the sum of Two Thousand ($2,000.00) Dollars as compensa-
tion for the fair market value of loss of crops during construction and re-
sulting hazards to farming operations created by manhole covers.
6. To pay as additional consideration to owner the sum of Six Thou-
sand ($6,000.00) Dollars.
7. To waive the sewer capacity charge of the Village of Dublin for
one six (6") inch service tap for the existing residence.
8. Provide a second farm entrance off Post Road, complete with drain-
age culvert and gravel drive to the property line. Said drive shall be
sixteen (16') feet wide, located east of the existing driveway.
