A RESOLUTION TO APPROVE AND ACCEPT DEEDS OF EASEMENTS FOR
t(] WATERLINE AND SANITARY SEWER CONSTRUCTION.
WHEREAS, the attached easements were required for the construction of a
Waterline and a Sanitary Sewer along Post Road, and;
WHEREAS, said Waterline and Sanitary Sewer have been accepted by the Vil-
lage.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Dublin,
State of Ohio, 7 of the elected members concurring.
SECTION 1. That the attached Deeds of Easements marked Exhibits "A, B"
and "C" for the construction of a Waterline and Sanitary Sewer along Post
Road be and hereby are, approved and accepted.
SECTION 2. That this Resolution shall take effect and be in force immedi-

DEED OF EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that OLDE POSTE
PROPERTIES (formerly Wellington Investment Co.), an Ohio general
partnership (hereinafter called "Grantor"), in consideration of

municipal corporation classified as a Village (hereinafter called
"nub1in"), the receipt and sufficiency of which are hereby
acknowledged, and pursuant to the terms and conditions of a
certain Sewer Line Agreement made and entered into the 10th day
of November, 1980, by and among Grantor, Dublin and other persons
(hereinafter called the "Sewer Line Agreement"), does hereby
GRANT, BARGAIN, SELL AND CONVEY unto Dublin, its successors and
assigns forever, a perpetual easement over, unde r , upon and .
through the hereinafter-described strip of real property, for the
purpose of constructihg, repairing, replacing, maintaining,
if: cleaning and using a sanitary sewer and appurtenant works and
connections, together with the right of access to such strip of
'-u land for said purposes, said strip of land being situated in the
State of Ohio, the County of Franklin and in the Village of
Dublin, and more particularly bounded and described as follows:
Partially in Virginia Military Survey No. 2542 and
partially in Virginia Military Survey No. 2999: being a strip of
land twenty (20) feet in width across a 25.000 acre tract of land
conveyed to Olde Post Properties by deed of record in Official
Record 274, Page B 11, Recorder's Office, Franklin County, Ohio,
the centerline of said strip being described as follows:
Beginning, for reference, at a point in the centerline
of Post Road (60 feet wide), at the northeast corner of said

46.09 acre tract of land conveyed as Parcel Two to Roland E. and
Martha E. Johnston by deed of record in Deed Book 1993, Page 69,

condition and agreement that Dublin shall, to the extent
possible, after any construction, alteration, repair, replace-
ment, maintenance, cleaning or use of such sanitary sewer and
appurtenant works and connections is completed, restore all

property, including, without limitation, all property belonging
to Grantor, its successors and assigns, to the condition such
property was in prior to such construction, alteration, repair,
replacement, maintenance, cleaning or use, and shall reasonably
W compensate Grantor, its successors and assigns, for any property
damaged or destroyed which cannot be restored to its original
condition prior to any such construction, alteration, repair,
replacement, maintenance, cleaning or use.
This Deed of Easement is executed and delivered and the
easement hereinbefore described is granted subject to the terms
and conditions of the Sewer Line Agreement (which terms and
conditions are hereby made a part hereof), and upon the following
additional conditions, to wit:
1. Grantor shall have the right to continue to use
and enjoy fully the easement area hereinabove described, subject
to the right of Dublin to utilize the same for the purposes
herein specified.
lfi 2. No special assessment to pay the direct cost, or

any portion thereof, of constructing said sanitary sewer and

appurtenant works and connections shall be made against Grantor,
its successors or assigns, and no cost of any kind in connection
with said sanitary sewer and appurtenant works and connections
shall accrue to or be chargeable against Grantor, its successors
and ass igns , until and unless application is made to use the
same, at which time only such normal and regular fees and charges
for tapping and sewer service as are charged by Dublin shall be
due and payable.
3. Subject to the payment of such normal and regular
fees and charges therefor as are charged by Dublin, Grantor, its
c[ successors and assigns, shall have the right to receive from
Dublin water and sewer service to serve adequatelY,~he tract of

TO HAVE AND TO HOLD the above granted easement unto
Dublin, its successors and assigns forever, for the uses and
purposes hereinbefore mentioned.

DEED OF EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that JOHN W. KESSLER,
TRUSTEE, an individual residing in Ohio (hereinafter called
"Grantor"), in consideration of the sum of One Dollar ($1.00) and

and shall reasonably compensate Grantor, his successors and
assigns, for any property damaged or destroyed which cannot be

appurtenant works and connections is completed, restore all
property, including, without limitation, all property belonging
