RESOLUTION NO. ~ 'f- if DECLARING THE NECESSITY OF IMPROVING TRAILS END DRIVE IN THE VILLAGE OF DUBLIN BY CONSTRUCTING A WATERLINE WITH NECESSARY BRANCHES AND APPURTENANCES, FROM THE TERMINUS OF THE PRESENT WATERLINE IN ~ TRAILS END DRIVE NORTH TO THE END OF SUCH STREET C BE IT ORDAINED by the Council of the Village of Dublin, Franklin and Delaware Counties, State of Ohio, that: Section 1. It is hereby declared to be necessary to improve Trails End Drive in the Village of Dublin by constructing a waterline with necessary branches and appurtenances, from the terminus of the .present waterline in the Trails End Drive north to the end of such street, as shown on the plans hereinafter referred to and prepared by Consulting Engineers to the Village. Section 2. The grade of said street after said improve- ments have been completed shall be as shown on said plans and profiles, which are made a part hereof. Section 3. The plans, specifications, estimates and profiles of the proposed improvements, heretofore prepared by the Engineers and now on file in the office of the Clerk, are hereby approved. . Section 4. The whole cost of said improvements, shall D be assessed in proportion to the benefits which may result from the improvement upon the following described lots and lands, to-wit: all lots and lands bounding and abutting upon the proposed improvements between the termini aforesaid, which said lots and lands are hereby determined to be specially benefited by said improvements. The cost of said improvement shall include the cost of preliminary and other surveys, plans, specifications, profiles and estimates and of printing, serving and publishing notices, resolutions and ordinances, the amount of damages resulting from the improve- ment assessed in favor of any owner of land affected by the improvement and the interest thereon, the costs incurred in connection with the preparation, levy and collection of the special assessments, the cost of purchasing, and other- wise acquiring therefor any required real estate or interests therein, 50% of the cost of appropriating any such real estate, expenses of legal services including obtaining an approving legal opinion, cost of labor and materials and interest on bonds and notes issued in anticipation of the levy and collection of the special assessments together with all other necessary expenditures. Section 5. The Engineers of this Village be and they are hereby authorized and directed to prepare and file in the office of the Clerk of this Council the estimated assessments D. of the cost of the improvements described in this resolution. Such estimated assessments shall be based upon the estimate of cost of said improvements now on file in the office of the Clerk of this Council and shall be prepared pursuant to the provisions of this resolution. When such estimated assessments have been so filed, said Clerk shall cause notice of the adoption of this resolution and the filing of said estimated assessments to be served on the owners of all lots and lands to be assessed as provided in Revised Code Section 727.13. - . . ,. .' , . , Section 6. The assessments to be levied shall be paid in twenty annual installments, with interest on deferred payments at the same rate as shall be borne by the bonds to be issued in anticipation of the cqllection thereof; provided, that the owner of any property assessed may, at his option, pay such assessment in cash within thirty days after passage of the ~ assessing ordinance. ~ Section 7. Bonds of the Village shall be issued in \Ii anticipation of the collection of assessments by installments and in an amount equal thereto and notes of said Village shall be issued in anticipation of the issuance of such bonds and the levy of such assessments. And the undersigned, and each of them consent and request that the said assessments be levied and collected without lifuita- ti9n'as to the value of the property assessed hereunder and wai,!e any and all righ~~, benefits, and privileges fixed by Revised Code SS727.03 and 727.06 or by any other section thereof restricting said assessments to ~hifty-three and one-third percent (33 1/3%) of the actual improved value of said lots and lands as enhanced by the improvement to be made, and waive all benefits of Revised Code S727.04 or of any other section thereof limiting assessments for re-improvements where an assessment has been levied and paid previously. The undersigned, and each of them further waive any damages or claims for damages of whatsoever C..... kind, character or description growing out of or resulting from . said improvement or the making thereof, including, but not by 1 way of limitation, all rights, benefits, and privileges which are fixed by Revised Code SS727.l8 to 727.22, inclusive, and 727.43.
