Resolution 72-11RECORD OF RESOLUTIONS Bunk, Inc., Form No, 30045 Resolution No. V,l -* T A RESOLUTION WAIVING COMPETITIVE BIDDING FOR THE INSTALLATION OF CURED IN PLACE PIPE IN THE SANITARY SEWER SYSTEM ON THE MUIRFIELD VILLAGE GOLF COURSE AND AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH REYNOLDS INLINER, LLC FOR THE PURPOSE OF COMPLETING THE PROJECT WHEREAS, Section 8.04(c) of the Revised Charter authorizes City Council, by a vote of no less than five (5) members, to waive competitive bidding requirements if Council determines that an item is available and can be acquired only from a single source or when it is in the best interest of the City to do so; and WHEREAS, it is in the best interest of the City to maintain and repair sanitary sewer systems where necessary; and WHEREAS, the City was issued Director's Orders from the Ohio Environmental Protection Agency to reduce inflow and infiltration into the sanitary sewer system; and WHEREAS, this section of sanitary sewer pipe has been determined to have high rates of inflow and infiltration; and WHEREAS, the complexity of completing this work on the Muirfield Village golf course is not conducive to a competitive bidding process; and WHEREAS, Council has determined that it is in the best interest of the City to waive competitive bidding for the installation of cured in place pipe ("CIPP Project') in the City's sanitary sewer system located on the Muirfleld Village golf course. NOJN, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, V of its elected members concurring, that: Section 1. Competitive bidding requirements are hereby waived for the installation of cured in place pipe in the City's sanitary sewer system located on the Muirfield Village golf course. Section 2. The City Manager is hereby authorized to contract with Reynolds Inliner, LLC for the purpose of completing the CIPP Project, such contract amount not to exceed $500,000 without further authorization of Council. Such contract shall be substantially in the form attached to this resolution. Section 3. This Resolution shall be effective upon passage in accordance with Section 4.04(a) of the Revised Charter. Burns, Director of Streets and Utilities Re: Resolution 72 -11— Waiving Competitive Bidding for the Installation of Cured in Place Pipe in the Sanitary Sewer System on the Muirfield Golf Course Summary During the past six years, the City of Dublin has been aggressive in maintaining, repairing and upgrading its sanitary sewer system. Staff has done this by cleaning and inspecting the sewer pipe, flow monitoring, and installing cured in place pipe (CIPP) where necessary. In 2008, the Ohio Environmental Protection Agency (OEPA) issued Director's Orders to most of the central Ohio communities. In general, these orders focus on four items: • The orders direct communities to complete a comprehensive inspection and evaluation of their existing sanitary sewer system. Communities must provide the OEPA a plan and budget to repair deficiencies in their sanitary sewer system. • Communities must integrate a flow monitoring system to detect inflow and infiltration (I&I) into their sanitary sewer system. • Communities must reduce I&I. The CIPP lining proposed for 2012 will be completed in two areas staff believes has high rates of I&I. One of these areas is located on the Muirfield championship golf course and the other area is located just southwest of the golf course. The sanitary sewer system in these areas consists of both 15 and 18 -inch pipe. During periods of lengthy precipitation, I&I cause the flow in these pipes to reach maximum capacity. On a few occasions, this has resulted in minor sanitary sewer overflows. Although these flows have not caused personal property damage, it is imperative the City address these problem areas and eliminate any potential for future overflows. The most efficient method of reducing I&I in these pipes is to install CIPP. Staff plans to divide the 2012 sanitary sewer lining work into two phases. The first phase is to install CIPP in the sanitary sewer pipes located on the golf course. This work must be completed by March 15, 2012 in order that the golf course can be ready for the Memorial Tournament. The work consists of installing CIPP in 9,339 linear feet of pipe at an estimated cost of approximately $425,000. The second phase will consist of installing CIPP in 24,977 linear feet of pipe not located on the golf course. This work is estimated to cost approximately $874,000. This work will be completed during the summer of 2012. The work to be completed on the golf course is complex. This work is different from the typical sewer lining work because there is limited time to complete the work, limited access points to the work areas, and there is high potential for damage to the golf course and its infrastructure, given the time of year the work must be accomplished. It is likely there will be some disruption to the Memo re. Resolution 72 -11 December 8, 2011 Page 2 of 2 course and any and all repairs must be completed prior to the Tournament. Staff believes it is in the best interest of the City, as well as the success of the project to work directly with a contractor who has a history of successful CIPP installation in the City of Dublin. In light of the limited course access, need to minimize and repair damage before the tournament, short project timeframe, and potential for adverse winter construction conditions, advanced planning of the work in partnership with golf course staff is imperative. This level of planning and collaboration with the contractor is not conducive to the typical bid process. Section 8.04(c) of the Revised Charter allows Council to waive competitive bidding if Council determines that a waiver of the competitive bidding requirement is in the best interest of the City. In this case, a waiver of competitive bidding will ameliorate the issues identified above and allow for better pricing by eliminating the unknown risks inherent in bidding a project of this complexity. For these reasons, staff recommends Council waive competitive bidding for the sewer lining work to be done on the golf course. The remainder of 2012 sewer lining work will be competitively bid according to the City's approved processes. Recommendation Staff recommends approval of Resolution 72 -11, waiving competitive bidding for sewer lining work on the Muirfield Village championship golf course and authorizing the City Manager to execute a contract with the appropriate contractor for the purpose of completing the CIPP Project. Such contract amount shall not exceed $425,000.00 without further authorization of Council.
