RESOLUTION NO. I/~S~
DECLARING THE NECESSITY OF CONSTRUCTING A TWELVE
(12) INCH WATER LINE AND APPURTENANCES THERETO ON
,.... SHIER-RINGS ROAD FROM THE INTERSECTION OF DUBLIN
INDUSTRIAL LANE TO WILCOX ROAD THENCE NORTHERLY
ALONG THE EAST SIDE OF WILCOX ROAD APPROXIMATELY
....... SIX HUNDRED (600) FEET IN THE VILLAGE OF DUBLIN,
OHIO, AND DECLARING AN EMERGENCY.
BE IT RESOLVED, By the Council of the Village of Dublin,
Franklin, Union and Delaware Counties, Ohio, that:
Section 1. It is hereby declared to be necessary to
construct a twelve (12) inch water line and appurtenances thereto
on Shier-Rings Road from the intersection of Dublin Industrial
Lane to Wilcox Road thence northerly along the east side of
Wilcox Road approximately six hundred (600) feet in the Village
of Dublin, Ohio (the "Village"), as shown on the plans herein-
after referred to and prepared by C. F. Bird and R. J. Bull,
r Ltd. (the "Village Engineer").
'--' Section 2. It is hereby determined and declared that
said improvement is conducive to the public health, convenience
and welfare of the Village and the inhabitants thereof.
Council further finds and determines that said improvement
has been petitioned for by the owners of sixty percent (60%)
of the front footage of the property abutting upon said improve-
ment.
Section 3. The grades of said streets and improvements
shall be the grades as shown by the Village Engineer's plans
and profiles which are made a part hereof.
Section 4. The plans, specifications, estimates and
r profiles of the proposed improvement, heretofore prepared
f by the Village Engineer and now on file in the office of the

Clerk of this Council, are hereby approved.

Section 5. The whole cost of said improvement, less

those components to be paid by the Village, shall be assessed
by the front foot of the property bounding and abutting
upon the improvement, which lots and lands are hereby determined
to be specifically benefitted thereby. The Village shall pay
,... the cost of intersections. The cost of said improvement shall

"-' include the cost of preliminary and other surveys, plans,
specifications, profiles and estimates and printing, serving
and publishing notices, resolutions and ordinances, the amount
of damages resulting from the improvement assessed in favor
of any owner of land affected by the improvement and the
interest thereon, the costs incurred in connection with the
preparation, levy and collection of the special assessments,
the cost of purchasing, and otherwise acquiring therefor
any required real estate or interests therein, expenses of
legal services including obtaining an approving legal opinion,
cost of labor and materials and interest on bonds and notes
r issued in anticipation of the levy and collection of the
, special assessments together with all other necessary

expenditures.
Section 6. The Village Engineer of this Village be and
he is hereby authorized and directed to prepare and file in
the office of the Clerk of this Council the estimated assess-
ments of the cost of the improvement described in this Resolution.
Such estimated assessments shall be based upon the estimate
of cost of said improvement now on file in the office of
the Clerk of this Council and shall be prepared pursuant to
the provisions of this Resolution. When such estimated
assessments have been so filed, said Clerk shall cause notice
r- of the adoption of this Resolution and the filing of said
I estimated assessments to be served on the owners of all lots
..... and lands to be assessed as provided in Revised Code
Section 727.13.

Section 7. The assessments to be levied shall be paid

in twenty (20) annual installments, with interest on deferred
payments at the same rate as shall be borne by the bonds to
be issued in anticipation of the collection thereof; provided,
that the owner of any property assessed may, at his option,
"..... pay such assessment in cash within thirty (30) days after
"'- passage of the assessing ordinance.
Section 8. Bonds of the Village shall be issued in
anticipation of the collection of assessments by installments
and in an amount equa~ thereto and notes of said Village
shall be issued in anticipation of the issuance of such bonds
and the levy of such assessments; the Village portion of
such cost shall be paid from the appropriate funds now on
hand.
Section 9. It is found and determined that all formal
action of this Council concerning and relating to the adoption
of this Resolution were adopted in an open meeting of this
r Council, and that all deliberations of this Council and of
! any of its committees that resulted in compliance with all

legal requirements including Revised Code ~121.22.
Section 10. This Resolution is hereby declared to be
an emergency measure necessary for the immediate preservation
of the public peace, health, safety or general welfare of
said Village, and for the further reason that preliminary
assessment proceedings should be completed at the earliest
possible date so that the construction of said improvement
can be commenced during favorable weather conditions, and
this Resolution, therefore, shall go into full force and
effect immediately upon its passage and publication as provided
in the Charter of the Village of Dublin, Ohio.
