A RESOLUTION AUTHORIZING SETTLEMENT IN THE CITY OF
DUBLIN V. 3OHN L. WIRCHANSKI LITIGATION, CASE NO. 2008
CV 0535 IN THE UNION COUNTY COURT OF COMMON PLEAS
WHEREAS, the City of Dublin ( "Dublin "), on October 28, 2008, appropriated property
from John L. Wirchanski ( "Wirchanski ") through the Union County Courtof Common Pleas
in order to construct an interchange at U.S. Highway 33 and State Route 161 (the
"Project"); and
WHEREAS, Dublin appropriated three separate fee simple interests of 4.651 acres, more
or less, 13.407 acres, more or less, and 1.745 acres, more or less (the "Appropriated
Property") as set forth in the legal descriptions attached to this Resolution and labeled as
Exhibits "A ", "B" and "C; and
WHEREAS, Dublin initially appraised the Appropriated Property at a value of Six Million
Eight Hundred Eighty -One Thousand One Hundred Twenty -Eight Dollars ($6,881,128);
and
WHEREAS, Dublin and Wirchanski have agreed to a settlement in Case No. 2008 CV
0535, whereby Dublin will compensate Wirchanski an additional One Million Three
Hundred Sixty-Eight Thousand Eight Hundred Seventy -Two Dollars ($1,368,872) for the
Appropriated Property, as well as One Hundred Thirty-One Thousand Dollars ($131,000)
to be paid to Wirchanski for legal fees incurred by Wirchanski during the abandonment
proceedings in this litigation.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of
Ohio, . ,a of the elected members concurring that:
Section 1. The City Manager and Law Director are hereby authorized to settle the
Dublin v. Wirchanski litigation, Case No. 2008 CV 0535 in the Union County Court of
Common Pleas.
Section 2. Dublin shall acquire the Appropriated Property for an additional One Million
Three Hundred Sixty -Eight Thousand Eight Hundred Seventy -Two Dollars ($1,368,872)
over and above the Six Million Eight Hundred Eighty -One Thousand One Hundred Twenty -
Eight Dollars ($6,881,128) already paid to Wirchanski for the Appropriated Property, and
shall further compensate Wirchanski in the amount of One Hundred Thirty -One Thousand
Dollars ($131,000) for legal fees incurred by Wirchanski during the abandonment
proceedings in this litigation.
Section 3. Dublin shall be bound by all other terms of a negotiated and agreed upon
Settlement Entry between Dublin and Wirchanski.
Section 4. This Resolution shall be effective upon passage in accordance with Section
4.04(a) of the Revised Charter.

Re: Resolution 69 -11— Authorizing the Settlement of the Eminent Domain Lawsuit
between the City of Dublin and John L. Wirchanski
Summary
Resolution 69 -11 authorizes the settlement of the eminent domain lawsuit between the City of
Dublin (the City) and John L. Wirchanski ( Wirchanski).
The City commenced an eminent domain lawsuit against Wirchanski on October 28, 2008. The
City pursued three separate takes in furtherance of the construction of the interchange at US
Route 33 /State Route 161 /Post Road ("33 /161 /Post Project'. The three separate takes, the
acreages involved, and the funds deposited, based on the City's appraisals, are:
Parcel 71 -WD: 4.651 acres $1,630,002
Parcel 91 -WL: 13.407 acres $4,982,599
Parcel 92 -WL: 1.745 acres $ 268,527
The 33/161 /Post Project was to have been implemented in three phases. Phases 1 and 2, the
relocation of Liggett Road and the relocation of Industrial Parkway and improvements to State
Route 161, respectively, have been completed. Phase 3, the construction of the interchange has
been indefinitely deferred.
In early 2010, with knowledge that Phase 3 would not be moving forward, the City received
Wirchanski's appraisal reports, valuing the takes approximately $5 million higher than the City's
appraisals. Faced with the prospect of paying compensation far in excess of the funds deposited
for property the City did not immediately need, the City invoked its statutory right to abandon
Parcel 91 -WL and Parcel 92 -WL pursuant to Ohio Revised Code §163.21. Parcel 71 could not be
abandoned as the City had demolished a structure located on that Parcel and utilized the Parcel for
the relocation of Industrial Parkway. On April 21, 2010, the City filed in the Union County Court of
Common Pleas its notice of partial abandonment, which was opposed by Wirchanski. A two -day
evidentiary hearing was held, and on August 19, 2010, the court issued its findings that, while the
City could abandon Parcel 92 -WL, it could not abandon Parcel 91 -WL based upon its conclusion
that the City, in performing preliminary site work, had taken possession of that Parcel. The case
was appealed to the Third District Court of Appeals, which affirmed the trial court's decision. The
Appellate Court remanded the case to the trial court, which set a trial date of December 5, 2011 to
determine "just compensation" due Wirchanski for Parcels 71 -WD and 91 -WL.
Prior to commencing extensive pre -trial discovery, the parties agreed to conduct a mediation
hearing on September 20, 2011. The mediation hearing was not successful in reaching an

agreement on compensation for the Parcels. Union County Common Pleas Court Judge Fraser
convened two subsequent conferences on October 12 and November 1, 2011. At the November
conference, the parties agreed in principal to the following settlement terms:
1. The City would pay to Wirchanski as compensation for Parcels 71 -WD, 91 -WL and 92-
WL the total sum of $8,250,000, resulting in an additional deposit of $1,368,872 in
incremental dollars over and above the 2008 deposit of $6,881,128.
2. The City would pay to Wirchanski $131,000 for legal fees associated with the
abandonment proceedings.
3. The City would agree to ultimately transfer title to all three parcels to the Ohio
Department of Transportation or Union County as appropriate.
4. The City would agree to stake the boundaries of Parcel 91 -WL.
5. The City would agree to mow or otherwise remove weeds on the acquired portion of
Parcel 91 -WL, which might impair Wirchanski's farming operation on the remainder of
Parcel 91 -WL.
The interchange project is not included in the City's current 2012 -2016 Capital Improvements
Program; however, at some point in the future, the interchange will need to be improved.
Settlement of the case will result in the acquisition of the necessary right -of -way needed for the
future project and eliminate the uncertainty of a trial.
Recommendation
Staff recommends approval of Resolution 69 -11 at the December 12, 2011 City Council meeting.
