A RESOLUTION TO AUTHORIZE AN AGREE-
MENT TO FORM THE FRANKLIN COUNTY
REGIONAL SOLID WASTE MANAGEMENT
AUTHORITY
WHEREAS, Ohio Amended House Bill 592 requires all counties in the State
to form Solid Waste Management Districts; and,
WHEREAS, by Resolution No. 1462-88, the Board of County Commissioners,
Franklin County, Ohio, established the Franklin County Solid Waste
Management District; and,
WHEREAS, pursuant to Section 343.011 of the Ohio Revised Code, the Board
of County Commissioners, Franklin County, Ohio, by Resolution 393-89,
declared the adoption of the Franklin County Solid Waste Authority; and,
WHEREAS, it is in the best interest of the citizens of Dublin and Franklin
County to participate in a county-wide waste management district;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State
of Ohio, 6 of the elected members concurring:
Section 1. That the City of Dublin endorses the Agreement to Form the
Franklin County Regional Solid Waste Management Authority authorized by
Resolution 394-89; said Agreement is attached to and made a part of this
Resolution.
Section 2. That this Resolution shall take effect and be in force from and
after the earliest period allowed by law.

Dear Municipal Mayors and Township Trustees:
Amended H.B. 592, Ohio's new solid waste law, became effective
June 24, 1988. The law requires that all counties In the State ,
,
are to form Solid Waste Management districts. In compliance
with the law, the Board of County Commissioners, by Resolution
No. 1462-88, dated November 29, 1988, established the Franklin
County Solid Waste Management District.
H. B. 592 allows the formation of Regional Solid Waste Management
Authorities. Solid Waste Management Districts can establish
a Regional Solid Waste Management Authority when a proposal
to form the authority is approved by municipalities and townships
representing at least Sixty (60%) percent of the total population
of the district. Activities accomplished to date towards
establishment of the Franklin County Regional Solid Waste
Management Authority are listed below:
December 12, 1988
Columbus City Council, by Resolution No. 276X-88, requested
"that the Franklin County Board of Commissioners propose
the formation of a Franklin County Regional Solid Waste
Authority.
December 13, 1988
Franklin County Board of Commissioners, by Resolution No.
1520-88, proposed the formation of the Franklin County
Regional Solid Waste Authori"ty and "transmitted a copy of
the resolution "to each municipal corporation. Each entity
was requested 1:0 vote on the proposal to form the Franklin
County Regional Solid Waste Authority.
April 18, 1989
Franklin County Board of Commissioners, by Resolution No.
393-89, declared the proposal for the formation of the
Franklin County Regional Solid Waste Management Authority
adopted.

Enclosed is a copy of Resolution No. 394-89, adopted April 18,
1989 by the Board of County Commissioners, which is 1:he proposed

The Board of County Commissioners shall declare 1:he proposed

:1 WHEREAS, the Board of County Commissioners, Franklin
:1 County, Ohio, by Resolution Number 1462-88, adopted

WHEREAS, the law permits the legislative authority
of any municipal corporation within such district to request
the Board of County Commissioners of a district to adopt
a resolution proposing the formation of a Regional Solid
I Waste Management Authority; and
I WHEREAS, the City Council of Columbus, Ohio, by
I Resolution Number 276X-88, adopted December 12, 1988,
requested the Board of County Commissioners, Franklin County,
! Ohio to propose the formation of a Regional Solid Waste
Management Authority, pursuant to Section 343.011, Ohio
Revised Code; and
WHEREAS, the Board of County Commissioners, Franklin
County, Ohio by Resolution Number 1520-88, adopted
December 13, 1988, proposed the formation of a Regional
Solid Waste Management Authority, pursuant to Section
343.011, Ohio Revised Code; and
I WHEREAS, a copy of Resolution Number 1520-88 was
transmitted to each municipal corporation and township
located in the district requesting that each legislative
authority vote on the proposal for the formation of the
Franklin County Regional Solid Waste Hanagement Authority;
; and
! WHEREAS, the Board of County Commissioners, Franklin
County, Ohio, has determined that the legislative authorities
, of a combination of municipal corporations and townships
: (list attached) with a combined population within the
I boundaries of the District. comprising at least sixty percent
of the total population of the District has approved the

I WHEREAS, the Board of County Commissioners, Franklin

I WHEREAS, the City Council of Columbus, Ohio, by
Resolution Number 276X-88, adopted December 12, 1988,
requested the Board of County Commissioners, Franklin County,
Ohio, to propose the formation of a Regional Solid Waste

I WHEREAS, the Board of County Commissioners, Franklin
County, Ohio by Resolution Number 1520-88, adopted

WHEREAS, the Board of County Commissioners, Franklin
County, Ohio, by Resolution Number 393-89, dated April 18,

Franklin County Regional Solid Waste Authority had been
adopted; and
II WHEREAS, in order for the Franklin County Regional
So li d Waste Management Authority to be created, an Agreement
must be entered into by Franklin County and a combination
I of municipal corporatiQns and townships with a combined
I population within the boundaries of the District comprising
at least sixty percent of the total population of the
District including the municipal corporation having the

BE IT RESOLVED BY THE BOARD OF COHNISSrONERS, FRANKLIN
COUNTY, OHIO:
l. That the Franklin County Regional Solid Waste Management
Authority shall consist of all the incorporated and
unincorporated territory of Franklin County, Ohio.
2. That the Franklin County Regional Solid Waste Management
I Authority Board of Trustees shall have all the powers
I and duties enumerated in Chapter 343 of the Ohio Revised
I
I Code, and shall consist of the following members:
I
i A. The President of the Franklin County Board of
I
Commissioners or his designee;
I
I B. The Mayor of the City of Columbus or his designeej
I
I
i C. One member to be chosen by a majority of the Boards
of Township Trustees within Franklin County, for
I an initial term of one year, and for a term of
tlNO years thereafterj
D. The Health Commissioners of the Health District
having the largest terri torial jurisdiction within
Franklin County or his designee;

E. One meC1ber appointed by the Mayor of the City
I of Columbus, for a term of two years;

SUBSTITUTE RESOLUTION NO. 1 -89
BY:
A Resolution to authorize an agreement to form the Franklin
County Regional Solid Waste Management Authority.

WHEREAS, Ohio Amended House Bill 592 requires all counties
in the State to form Solid Waste Management Districts; and,
WHEREAS, by Resolution No. 1462-88, the Board of County
Commissioners, Franklin County, Ohio, established the Franklin
County Solid Waste Management District; and,
WHEREAS, pursuant to Section 343.011 of the Ohio Revised
Code, the Board of County Commissioners, Franklin County, Ohio,
by Resolution 393-89, declared the adoption of the Franklin County
Solid Waste Authority; and,
WHEREAS, it is in the best interest of the citizens of Bexley
and Franklin County to participate in a county-wide waste management
district; NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BEXLEY, OHIO:
Section 1. That the City of Bexley endorses the Agreement
to Form the Franklin County Regional Solid Waste Management Authority
authorized by Resolution 394-89; said Agreement is attached to
and made a part of this Resolution.
Section 2. That it is strongly recommended that the Franklin
County Regional Solid Waste Management Authority Board of Trustee
authorized by Section 2.G. of the Agreement be permanently dedicated
to political subdivisions other than Franklin County, the City
of Columbus and Townships.

SUBJECT: Franklin County Regional Solid Waste Management Au-
thority
Please find attached information on the Franklin County
Solid Waste Management District. Mark Masser, Service Committee
Chairman, requested that it be sent to you for your review prior
to the June 27, 1989 Council meeting. Jeff Cabot, Franklin County
Administrator, will be at Council that evening to give background
information on the district and answer any questions Council
may have. A proposed Substitute Resolution authorizing an
agreement to form the Franklin County Regional Solid Waste
Management Authority is also enclosed for your consideration.
