HomeMy WebLinkAboutOrdinance 63-11RECORD OF ORDINANCES 63 -11 Ordinance No. Parsed Fam No. 30033 20 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE NECESSARY CONVEYANCE DOCUMENTATION FOR THE ACQUISITION OF A 0.291 ACRES (WITH 0.162 ACRES AS PRESENT ROAD OCCUPIED), MORE OR LESS, FEE SIMPLE INTEREST, A 0.249 ACRES (WITH 0.138 ACRES AS PRESENT ROAD OCCUPIED), MORE OR LESS, FEE SIMPLE INTEREST, A 0.162 ACRES, MORE OR LESS, PERMANENT UTILITY AND DRAINAGE EASEMENT, A 0.224 ACRES, MORE OR LESS, PERMANENT UTILITY AND DRAINAGE EASEMENT, AND A 0.162 ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION EASEMENT FROM SUZANNE B. FEASEL, TRUSTEE. WHEREAS, the City of Dublin (the "City ") is preparing to construct a roundabout at the intersection of Hyland -Croy Road and Brand Road; and WHEREAS, said roadway project requires that the City obtain certain property interests in Union County parcel no. 17- 0029001.001, owned by Suzanne B. Feasel, Trustee ( "Feasel "), said property interests set forth in the legal descriptions attached hereto as Exhibits "A" and "B "; and WHEREAS, the City and Feasel participated in discussions for the acquisition of this property, and have come to mutually agreeable terms for the acquisition; and WHEREAS, the City desires to execute necessary conveyance documentation to complete the transaction between the City and Feasel. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, _�T_ of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute all necessary conveyance documentation to acquire an approximate 0.291 acres fee simple interest (with 0.162 acres as Present Road Occupied), an approximate 0.249 acres fee simple interest (with 0.138 acres as Present Road Occupied), an approximate 0.162 acres permanent utility and drainage easement, an approximate 0.224 acres permanent utility and drainage easement, and an approximate 0.162 acres temporary construction and grading easement within Union County parcel no. 17- 0029001.001, as set forth in the legal descriptions attached, from Suzanne B. Feasel, Trustee. Section 2. This ordinance shall go into effect as of the earliest date permitted by law. Haque DATE: November 10, 2011 RE: Ordinance No. 63 -11 Hyland -Croy /Brand Road Roundabout Project Suzanne B. Teasel, Trustee PROJECT BACKGROUND: The City of Dublin ( "City ") is preparing to construct a roundabout at the intersection of Hyland - Croy and Brand Roads (the 'Project "). The City must obtain property interests from various landowners located within the City in order to construct this project. The City presented good faith offers to each of these landowners in accordance withthe Ohio Revised Code. One of the landowners that the City must obtain property from for the construction of the Project is Suzanne B. Teasel, Trustee ( "Teasel "). After engaging in amicable negotiations, the City has come to an agreement with Teasel to acquire the necessary property interests pursuant to the terms outlined in this memorandum. ACQUISITION INTRODUCTION: The City will be acquiring from Teasel only those property interests needed for the roundabout project. These property interests are generally depicted in the map that is attached to this memorandum. The City initially offered $67,430.00 for the property interests needed from Parcel 5 owned by Suzanne B. Teasel, Trustee in accordance with the City's appraisal. This amount combined with the $50,330.00 offered for the property interests needed from Parcel 9 owned by Suzanne B. Teasel in her individual capacity totaled a combined $117,760.00. After negotiations, the parties settled on a combined $139,760.00 for both the property needed from Teasel, Trustee (Parcel 5) as well as Suzanne B. Teasel in her individual capacity (Parcel 9). This agreed -upon amount represents the total compensation for the acquisition of the property interests indicated below along with additional property interests that are to be acquired from Suzanne B.
