AN ORDINANCE AUTHORIZING THE CITY MANAGER TO
EXECUTE NECESSARY CONVEYANCE DOCUMENTATION
FOR THE ACQUISITION OF A 0.183 ACRES (WITH 0.143
ACRES AS PRESENT ROAD OCCUPIED), MORE OR LESS,
FEE SIMPLE INTEREST, AND A 0.027 ACRES, MORE OR
LESS, TEMPORARY CONSTRUCTION EASEMENT FROM
DAVID H. THRONDSEN AND LORI M. THRONDSEN.
WHEREAS, the City of Dublin (the "City ") is preparing to construct a roundabout at the
intersection of Hyland -Croy Road and Brand Road; and
WHEREAS, said roadway project requires that the City obtain certain property interests
in Union County parcel no. 17- 0028015.000, owned by David H. Throndsen and Lori M.
Throndsen (the "Throndsens "), said property interests set forth in the legal descriptions
attached hereto as Exhibits "A" and "B "; and
WHEREAS, the City and the Throndsens participated in discussions for the acquisition of
this property, and have come to mutually agreeable terms for the acquisition; and
WHEREAS, the City desires to execute necessary conveyance documentation to
complete the transaction between the City and the Throndsens.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, of the elected members concurring that:
Section 1. The City Manager is hereby authorized to execute all necessary conveyance
documentation to acquire an approximate 0.183 acres fee simple interest (with 0.143
acres as Present Road Occupied), and an approximate 0.027 acres temporary
construction and grading easement within Union County parcel no. 17- 0028015.000, as
set forth in the legal descriptions attached, from David H. Throndsen and Lori M.
Throndsen.
Section 2. This ordinance shall go into effect as of the earliest date permitted by law.

Hyland-Croy/Brand Road Roundabout Project

PROJECT BACKGROUND:
The City of Dublin ('City") is preparing to construct a roundabout at the intersection of Hyland -
Croy and Brand Roads (the 'Project"). The City must obtain property interests from various
landowners located within the City in order to construct this project. The City presented good
faith offers to each of these landowners in accordance withthe Ohio Revised Code.
One of the landowners that the City must obtain property from for the construction of the Project
is David H. Throndsen and Lori M. Throndsen (the "Throndsens "). After engaging in amicable
negotiations, the City has come to an agreement with the Throndsens to acquire the necessary
property interests pursuant to the terms outlined in this memorandum.
ACQUISITION INTRODUCTION:
The City will be acquiring from the Throndsens only those property interests needed for the
roundabout project. These property interests are generally depicted in the map that is attached to
this memorandum. The City initially offered $3,725.00 for the property interests needed in
accordance with the City's appraisal. After negotiations, the parties settled on $5,000.00 for the
property.

ACTION TO BE AUTHORIZED BY ORDINANCE:
Ordinance 61 -11 would authorize the City Manager to execute all necessary conveyance
documentation to formally acquire the aforementioned property interests.
RECOMMENDATION:
Staff recommends approval of Ordinance No. 61 -11 as obtaining the property interests described
herein is necessary for the furtherance of the Hyland -Croy /Brand Road roundabout construction
proj ect.

Number 6595 of the Virginia Military District, being a part of the 2.273 acre tract conveyed to
David H. Throndsen and Lori M. Throndsen of record in Official Record 749, Page 108, and
described as follows:
Beginning, at an magnetic nail set at the southeast corner of said 2.273 acre tract, the
northeast corner of the 135.762 acre tract conveyed to the Board of Commissioners Columbus
and Franklin County Metropolitan Park District of record in Official Record 253, Page 341, in
the centerline of Hyland -Croy Road, and at the common corner of said Survey Number 6595 and
Survey Number 6596 of the Virginia Military District in the west line of Survey Number 3452 of
the Virginia Military District;
thence South 84° 18' 18" West, a distance of 25.00 feet, with the line common to said
2.273 and 135.762 acre tracts, to an iron pin set;
thence North 05° 17' 14" West, a distance of 134.27 feet, across said 2.273 acre tract
with the existing west right -of -way line of Hyland -Croy Road, to an iron pin set;
thence across said 2.273 acre tract with the proposed west right -of -way line for Hyland -
Croy Road, the following courses:
South 84° 42' 46" West, a distance of 15.00 feet, to an iron pin set;
North 05° 17' 14" West, a distance of 115.62 feet, to an iron pin set in the north line
