X045 Resolution No 61 -11 Passed 20 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE NECESSARY CONVEYANCE DOCUMENTATION TO ACQUIRE A 0.042 ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION EASEMENT FROM KENNETH E. AND LINDA M. PORTER WHEREAS, the City of Dublin (the "City") is preparing to construct a roundabout at the intersection of Cosgray Road and Shier -Rings Road; and WHEREAS, said roadway project requires that the City obtain a temporary construction easement within Franklin County Parcel No. 274 - 001297 owned by Kenneth E. and Linda M. Porter (the "Porters "), said easement more fully described and depicted in Exhibits "A" and "B ", attached hereto; and WHEREAS, the City and the Porters participated in good faith discussions and have come to mutually agreeable terms for the acquisition of this easement; and WHEREAS, the City desires to execute necessary conveyance documentation to complete the transaction between the City and the Porters. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, - 9 — of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute all necessary conveyance documentation to acquire an approximate 0.042 acres temporary construction easement from Kenneth E. and Linda M. Porter, said easement located within Franklin County Parcel No. 274 - 001297, and as more fully described and depicted in the attached Exhibits "A" and "B ". Section 2. This Resolution shall take effect upon passage in accordance with Section 4.04(a) of the Revised Charter. Haque DATE: November 23, 2011 RE: Resolution 61 -11 Cosgray -Shier -Rings Road Roundabout Project Kenneth E. Porter and Linda M. Porter PROJECT BACKGROUND: The City of Dublin ( "City ") is preparing to construct a roundabout at the intersection of Cosgray and Shier -Rings Roads (the "Project"). The City must obtain property interests from various landowners located within the City in order to construct this project. The City presented good faith offers to each of these landowners in accordance with the Ohio Revised Code. One of the landowners that the City must obtain a temporary construction easement from for the construction of the Project is Kenneth E. and Linda M. Porter (the 'Porters "). After engaging in amicable negotiations, the City has come to an agreement with the Porters to acquire this easement pursuant to the terms outlined in this memorandum. ACQUISITION INTRODUCTION: The City will be acquiring from the Porters only the temporary construction easement as depicted in the map attached to this memorandum. The City will be acquiring this easement for its appraised value of the easement. The acquisition is detailed below: Property Interest Acquiring ACRES APPRAISED COST Temporary Construction Easement 0.042 $ 705.00 ACTION TO BE AUTHORIZED BY RESOLUTION: Resolution 61 -11 would authorize the City Manages to execute all necessary conveyance documentation to formally acquire the temporary construction easement described above. RECOMMENDATION: Staff recommends approval of Resolution 61 -11 as obtaining the easement is necessary for the furtherance of the Cosgray /Shies -Rings Road roundabout construction project EXHIBIT " A " PARCEL 8 -T TEMPORARY EASEMENT FOR CONSTRUCTION AND GRADING Situated in the State of Ohio, County of Franklin, Township of Washington, being located in Virginia Military Survey Number 6953, and being a part of that Lot 606 of Ballantrae Section 8, Part 1, of record in Plat Book 109, page 46, as described in a deed to Kenneth E. Porter and Linda M. Porter, of record in Instrument Number 2007.05100082449, all records referenced herein are on file at the Office of the Recorder for Franklin County, being a parcel of land lying on the right side of the centerline of construction for Cosgray Road, as shown on the centerline plat for Cosgray Road and Shier -Rings Road, of record in Plat Book 114, Pages 16 -17, and being further bounded and described as follows: BEGINNING at the northwest corner of said Lot 606, being on the south line of that 8 acre tract described in a deed to Stephen M. Kelly, Grantor and Trustee, or any Successor Trustee, of the Steven M. The bearings described herein are based on the bearing of North 84 degrees 26 minutes 31 seconds East for the existing centerline of survey for Shier -Rings Road, which is referenced to the Ohio State Plane Coordinate System, South Zone and the North American Datum of 1983 (1986 Adjustment), as established utilizing a GPS survey and a traditional field traverse originating from Franklin County Monument "FCGS 5536 ". The above description of a temporary easement was prepared and reviewed on February 25, 2011 by Brian P. Bingham, registered professional surveyor number 8438, is based on an actual field survey of the premises performed by American Structurepoint, Inc. in July 2009, and is true and correct to the best of my knowledge.
