A RESOLUTION OF INTENT TO APPROPRIATE
PERMANENT CONSTRUCTION AND TEMPORARY
CONSTRUCTION EASEMENTS IN A 26.257
ACRE TRCT OWNED BY MILLCO PROPERTIES,
AND LOCATED ON THE SOUTH SIDE OF
TULLER ROAD IN THE CITY OF DUBLIN,
TOWNSHIP OF PERRY, STATE OF OHIO,
AND DECLARING AN EMERGENCY
WHEREAS, the City of Dublin is preparing to improve Tuller Road; and,
WHEREAS, said improvement will require the City obtain permanent construction
and temporary construction easements in and to the premises as described
in attached Exhibit "A", located in the City of Dublin, Township of Perry,
Franklin County, Ohio.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin,
State of Ohio, ~of the elected members concurring that:
Section 1. Council considers it necessary and declares its intention to
appropriate for the purpose of improving Tuller Road, permanent construction
and temporary construction easements in and to the premises located in the
City of Dublin, Township of Perry, Franklin County, Ohio and more fully
described in the legal description attached here to as Exhibit "A".
Section 2. The City Manager is hereby authorized to cause written notice
of the passage of this Resolution to be served upon the owners and
persons in possession or having an interest of record in the above-
described property. This notice shall be served according to law.
Section 3. The reason for such necessity is that the prompt inprovement
of Tuller Road is necessary due to the condition of an increased traffic
flow on Tuller Road. Therefore, this Ordinance shall go into immediate
effect.

ROADWAY PERMANENT EASEMENT AND A 0.293
ACRE ROADWAY TEMPORARY CONSTRUCTION EASEMENT
LOCATED ON THE SOUTHERLY SIDE OF
TULLER ROAD AND EAST OF RIVERSIDE DRIVE,
IN THE CITY OF DUBLIN, COUNTY OF FRANKLIN,
STATE OF OHIO
PERMANENT EASEMENT
Situated in the State of Ohio, County of Franklin, City of
Dublin, being in Quarter Township 2, Township 2 North, Range 19
West, United States Military Lands, being a strip of land, ten
feet in width (0.293 acre of land, more or less), part of said
0.293 acre area of land being in that 17.719 acre tract of land
designated as TRACT ONE and part of said 0.293 acre area of land I
being in that 8.538 acre tract of land designated as TRACT TWO,
as said TRACT ONE and TRACT TWO are described in the deeds to
Millco Properties, of record in Official Record 12116G04 and in I
Official Record 12116Gll, said TRACT ONE and TRACT TWO being
part of Lot 3 as the same is numbered and delineated upon the
recorded plat of the Lands of Chauncey McGurer, of record in
Plat Book 12, Page 27, all being of record in the Recorder's
Office, Franklin County, Ohio, said 0.293 acre area of land
being more particularly described as follows:
Beginning, for reference, at the centerline intersection of I
Tuller Road and Riverside Drive; thence S-86'33'15"E, with the I
centerline of said Tuller Road, with a northerly line of said I
Lot 3 and with the northerly line of that 0.331 acre tract of I

Ohio, a distance of 400.79 feet to the northwesterly corner of
said TRACT TWO, the same being the northeasterly corner of said I
0.331 acre tract and the northwesterly corner of that 1.172 acre I
tract of land described in the deed to The City of Dublin, of
record in Official Record 121l6H02, Recorder's Office, Franklin I
County, Ohio; thence S-3"26'45"W, with the westerly line of
said TRACT TWO, with the easterly line of said 9.331 acre tract I
and with the westerly line of said 1.172 acre tract, a distance I
of 40.00 feet to the true point of beginning at the I

Thence N-3.26'45"E, with the westerly line of said TRACT
TWO, a distance of 10.00 feet to the true point of beginning and
being a 0.293 acre area of land, more or less.
PURPOSE
For the purpose of constructing, using and maintaining
various utilities and a paved walkway in any part of the
hereinabove described 0.293 acre permanent easement, including
the right to clean, repair and care for said utilities and paved
walkway, together with the right of access to said 0.293 acre
permanent easement.
TEMPORARY CONSTRUCTION EASEMENT
Beginning, for reference, at the true point of beginning of
the hereinabove described 0.293 acre permanent easement; thence
S-3.26'45"W, with the westerly line of said TRACT TWO and with
the westerly line of said 0.293 acre permanent easement, a
distance of 10.00 feet to the true point of beginning at the
southwesterly corner of said 0.293 acre permanent easement;
Thence, from the true point of beginning of said temporary
construction easement, with the southerly line of said 0.293 I
acre permanent easement, the same being parallel with and 50.00
feet southerly from, as, measured at right angles, the centerline
of said Tuller Road, a distance of 1,276.55 feet to the
southeasterly corner of said 0.293 acre permanent easement in
the easterly line of said TRACT ONE, the same being in the I
westerly line of said 18.219 acre tract; I
Thence S-3.25'38"W, with the easterly line of said TRACT
ONE and with the westerly line of said 18.219 acre tract, a I
