A RESOLUTION OF INTENT TO
APPROPRIATE FEE SIMPLE
INTEREST, A PERMANENT
UTILITY/WALKWAY EASEMENT
AND A TEMPORARY CONSTRUCTION
EASEMENT IN A 18.219 ACRE
TRACT OWNED BY NORMAN E.
THOMAS, LOCATED ON THE
SOUTH SIDE OF TULLER
ROAD IN THE CITY OF DUBLIN,
TOWNSHIP OF PERRY, STATE OF
OHIO, AND DECLARING AN
EMERGENCY
WHEREAS, the City of Dublin is preparing to improve Tuller Road; and,
WHEREAS, said improvement will require the City obtaining fee simple
interest, a permanent utility/walkway easement and a temporary construction
easement in and to the premises as described in attached Exhibits "A"
and "B", located in the City of Dublin, Township of Perry, Franklin County,
Ohio.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State
of Ohio, ~of the elected members concurring that:
Section 1. Council considers it necessary and declares its intention to

DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO
situated in the State of Ohio, County of Franklin, City of
DUblin, being in Quarter Township 2, Township 2 North, Range 19 I
West, United States Military Lands, being a 0.808 acre area of I
land, more or less, said 0.808 acre being out of that 18.219
acre tract of land described in the deed to the David At Thomas,
of record in Official Record 06787B01, said 18.219 acre tract
being a part of Lot 3 as the same is numbered and delineated
upon the recorded plat of the Lands of Chauncey McGurer, of
record in Plat Book 12, Page 27, both being of record in the
Recorder's Office, Franklin County, Ohio, said 0.808 acre area
of land being more particularly described as follows:
Beginning, for reference, at the centerline intersection of
Tuller Road and Riverside Drive; thence S-86033'lS"E, with the
centerline of said Tuller Road, a distance of 1677.33 feet to
the true point of beginning at the northwesterly corner of said
18.219 acre tract, the same being the northeasterly corner of
that 1.172 acre tract of land described in the deed to The City

Thence, from said true point of beginning, eastwardly, with 1
the centerline of said Tuller Road and with the northerly
boundary of said 18.219 acre tract of land, the following three

1.) S-86039'4S"E, a distance of 729.33 feet to an angle

2. ) N-80'09'lS"E, a distance of 120.74 feet to an angle

PURPOSE
For the purpose of constructing, using and maintaining
various utilities and a paved walkway in any part of the
hereinabove described 0.202 acre permanent easement, including
the right to clean, repair and care tor said utilities and paved
walkway, together with the right of access to said 0.202 acre
permanent easement for said purpose.
TEMPORARY CONSTRUCTION EASEMENT I
Beginning, for reference, at the true point of beginning of
the hereinabove described 0.202 acre permanent easement; thence
S-3.2S'38"W, with the westerly line of said 18.219 acre tract,
with the easterly line of said TRACT ONE and with the westerly
line of said 0.202 acre permanent easement, a distance of 10.00
feet to the true point of beginning of said temporary
construction easement;
Thence, from the true point ot beginning of said temporary
construction easement, eastwardly, with the southerly boundary
of said 0.202 acre permanent easement, the same being parallel
with and 50.00 feet southerly from, as measured at right angles,
the centerline of said Tuller Road, the following three (3)
