AN EMERGENCY. .. . WHEREAS, Section 5713.30 of the Ohio Revised Code provides for "land devoted exclusively to agricultural use" to be eligible for tax savings as a result of the land being assessed in accordance with it agricultural use value instead of in accordance with Section 2, Article XII of the Ohio Constitution, and WHEREAS, Section 5713.34 of the Ohio Revised Code currently requires that upon conversion of all or any portion of land devoted exclusively to agricultural use a portion of the tax savings previously realized on the converted land shall be recouped by levying a charge equal to the amount of the tax savings during the previous four years, and WHEREAS, the City of Dublin (the City) in recent years has purchased in excess of 100 acres of land classified as "land devoted exclusively to agricultural use" for the purpose of creating public parks, and WHEREAS, the City has been assessed recoupment charges of over $94,000 as a result of this land no longer qualifying as "land devoted exclusively to agricultural use", and ." WHEREAS, the City believes that the proposed amendment to Section 5713,34 maintains the original intent of the current agricultural use valuation program to .. preserve agricultural and open space land and will result in reduced costs to the taxpayers when purchasing public parks, recreational areas, greenways or similar public open space uses, NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, 7 of the elected members concurring. Section 1, That the City of Dublin hereby supports House Bill 516, amending Section 5713,34 of the Ohio Revised Code to exempt from the agricultural use value conversion charge the conversion of land acquired by a public entity from a willing seller and there after used exclusively as a public park, recreational area, greenway or similar public open space use, Section 2, That this Resolution is hereby declared to be an emergency measures necessary for the preservation of the public peace, health, safety, and welfare, and therefore shall take effect and be in force immediately upon its passage, Passed this /!-fA dayof ~ , 1995, ...
