i A RESOLUTION OF INTENT TO APPROPRIATE A FEE SIMPLE

,I INTEREST AND A TEMPORARY CONSTRUCTION EASEMENT IN A
If 18.202 ACRE TRACT OWNED BY COLLEGE PROPERTIES OF
NORTHERN OHIO, INC. LOCATED ON THE EAST SIDE OF
II STATE ROUTE 257, IN THE CITY OF DUBLIN, STATE OF
i! OHIO, AND DECLARING AN EMERGENCY

:1 WHEREAS, the City of Dublin is preparing to improve state
'j Route 257 in order to accommodate the intersection with the
II Hard Road extension currently under construction; and,
Ii WHEREAS, said improvement will require the City of Dublin to
'I obtain a fee simple interest and a temporary construction
il easement in and to the premises described in the attached
I Exhibits "A" and "B", located in the City of DUblin, Franklin
Ii County, Ohio.

II NOW, THEREFORE, BE IT RESOLVE& by the Councl.l, of the Cl.ty of
i Dublin, state of Ohio, of the elected members
I' concurring that:
II Section 1. Council considers it necessary and declares its
II intention to appropriate for the purpose of improving state
I Route 257, a fee simple interest and a temporary construction
!I easement in and to the premises located in the City of Dublin,
" Franklin County, Ohio, and more fully described in the legal
i' descriptions attached hereto as Exhibits "A" and "B".
: Section 2. The City Manager is hereby authorized to cause
,
I written notice of the passage of this resolution to be served
i upon the owners and persons in possession or having an
II int7rest of record in the al?ove-described property. This
:1 notl.ce shall be served accordl.ng to law.
II Section 3. This resolution is hereby declared to be an
11 emergency necessary for the immediate preservation of the
II public health, safety and welfare. The prompt improvement of
II state Route 257 is necessary in order to accommodate the
II intersection with the Hard Road extension currently under
II construction. Therefore, this resolution shall go into
'I immediate effect.

Situate in the State of Ohio, County ofFranldin, Township ofPeny and in the City of Dublin,
being part of Lois 10 and 18 in Quarter Township 2, Township 2, Range 19, United States Military
Lands, being part of the 1.098, 14.112, 1.718, 1.274 acre tracts conveyed to College Properties of .-
Northern Ohio, Inc. by deed of record in O.R. 25815 D 18, Franklin County Recorder's Office; lying
on the right side of the centerline of Construction for S.R. 257 made in 1994 for the City of Dublin
for the improvement of the Hard Road intersection and being more particularly descn"bed as follows:
Beginning for reference at a railroad spike set at the southwest comer of a 14.93 acre tract of
record in O.R. 6572 CIS Franklin County Recorder's Office and being at a point of tangent centerline
intersection of the centerline survey, dated 1939, of State Route 257 at Centerline Station 70+03.5
as delineated upon the State of Ohio Right-of-Way Plans S.H. 558, Section A., said point being
further located as being 1.38 feet left of said centerline construction (1994) station 70+03.87;
Thence N 110 31' 37. W a distance of 638.04 feet (passing a point of tangency of said
centerline survey (1939), at a distance ofI41.88 feet) along the tangent line of said centerline survey
(1939) of S.R. 257 to a point at the northwest comer of a 15.43 acre tract conveyed to Carol L.
Schlotterer of record in O.R. 05351 H18 Franklin County Recorder's Office; said point being further
located as being 8.99 feet left of said centerline construction (1994) station 76+42.34;
'Thence S 880 16' 17. E, a distance of9.24 feet along the northerly line of said 15.43 acre tract
and the westerly extension of Grantor's southerly line, to a point in said Centerline of Construction
(1994) at St..tion 76+40.22, at the southwesterly corner of Grantor's property and being the TRUE
PLACE OF BEGINNING;
Thence N 11032' 10" W a distance of375.22 feet along the westerly line of the Grantor and
the Centerline of Construction S.R. 257 to a point at the northwest comer of the Grantor, being the
southwest corner ofa 0.581 acre tract as conveyed to Harold E. Bickel of record in O.R. 23973 Hl1
Franklin County Recorder's Office;
Thence S 880 16' 17. E a distance of 61.64 feet along the north line of the Grantor and the
south line ofBicke! passing through the existing easterly line of S.R. 257 at 42.19 feet to a point;
Thence along the line for this parcel the following three (3) courses:
1. S ISO 26' 46" E a distance of 146.64 feet to a point;
2. S 030 00' 27" E a distance of80.89 feet to a point;
3. SII032' 10" E a distance of 148.45 feet to a point in the south line of the Grantor and
the north line of the aforementioned Sch1otterer, said point being further located as being
58.00 feet right of said Centerline Construction (1994) Station 76+26.55;
Thence N 880 16' 17" W a distance of 59.59 feet along the south line ofthe Grantor and the
north line of Schlotterer passing through the existing easterly line of S.R. 257 at 17.46 feet to the
TRUE PLACE OF BEGINNING, containing 0.534 acres, more or less, including the present road
which occupies 0.354 acres, more or less;
The Grantor claims title by instrument of record in O.R 25815 D18 Franklin County
Recorder's Office.
Grantor, for himself and his heirs, executors, administrators and assigns, reserves the right of
ingress and egress to the residual area.
The bearings of the herein-described tract were based upon the grid bearing ofN 210 59' 12"
E from the Ohio Coordinate System, South Zone, as determined by field measurements between
Franklin County Engineer's Monuments Station FRANK 189, and Station FRANK 89.
